M. - Acting yor The Council met pursuant to recess and acknowledgement of notice in the following form: We, the undersigned Acting Mayor and Members of the City Council of the City of Caldwell, Idaho, each hereby acknowledge notice of a Recessed Meeting of the said City Council, to he hold in the Council Chambers in the City Hall in the City of Caldwell, Idaho, at the hour of 8 :00 P. A cting Mayor / �i / A �/ u Councilman t f Counci Councilman Acting Mayor &&eery L. Vassar presiding. Upon Roll Call, the following Councilmen answered presents E. L. Vassar, Emile Shorb, Max Luby, C. A. Davenport, V. Jay Martin, and N. E. "Coley" Smith. Acting Mayor Vassar called the meeting to order and recognized Mr. Childs who was present for the meeting. Request from Blackers for placing a trailer house on their property Mr. Childs addressed the Mayor and Council and stated that he was present to petition the Council for permission to place a trailer house on property near the store of Blackers on Cleveland Boulevard for the purpose of having a night watchman to keep watch over their premises. He said that they had had a lot of trouble with burglaries and vandalism - they had tried several times to solve the problem and had used a dog only to have it killed and that they felt this was about the only way out - to have a watchman on the premises at all times. He stated further that they have a man working for them now who has a trailer house and they would like to move him out there. The trailer was now located on Bast Chicago and Mr. Childs told the Council that they had the water, sewage and electric facilities at the property for its use. It was moved by Councilman Short, seconded by Councilman Luby that Blackers be permitted to place a trailer on their property for the purpose stated. A vote was taken and the motion unanimously carried. Request to change Code as it pertains to Pool Halls The Acting Mayor then called upon Yosis Ogawa from Nampa, Idaho who informed the Council that he wanted to open a Billiard Hall here in Caldwell at 703 Main Street but had been informed that the City Code did not allow minors under the age of 18 in Billiard Halls. He said that the place he had in mind was not like the old Pool Hall and that he had been asked by the Brunswick people to refrain from referring to the business as a Pool Hall. He then displayed to the Council some pictures which were to illustrate the equip- ment which would be placed in the building and he said that the facilities would be available to all childre wives, girl friends and to the whole family. He gave his reason for attending the meeting as being to see if the Council would consider changing the present Code so as to permit this type of business in Caldwell. In answer to the question, Mr. Ogawa stated that they would only serve soft counter drinks and sandwiches, as well as various candies. Councilman Davenport raised the question of whether or not children under the age of 18 could fre- quent the Pool Halls now licensed if the Code was changed when Chief Astleford stated that this could be controlled in that those Pool Halls now licensed were also licensed to sell Beer. It was then moved by Councilman Smith, seconded by Councilman Martin that the City Cade be redesigned to permit children under 18 years to frequent Billiard Halls. A vote was taken and the motion unanimously carried. The City Attorney was then instructed to prepare the necessary Ordinance. Rodeo facilities discussed Mr. Glenn Munn was then recognized and he inquired of the Coundl as to what had been decided on the Rodeo facilities which were discussed at the last meeting. He was informed that it appeared that a decision on this question would have to wait for consideration in the Budget for the coming Fiscal Year. Hr. Munn stated that he would carry the message to the Rodeo Board. Appeal by Mr. Munn regarding decision of Board of Adjustment Mr. Munn then continued by stating that he was also present this evening to appeal a decision of the Board of Adjustment with regards to a drive -in facility which would serve food to take out and would be located at the intersection of Paynter and Kimball, directly West of the new Armory facility. He said that they had secured the proper signatures on a petition and believed this was all in order but at the last meet- ing of the Board of Adjustment, they were refused the necessary permission. He stated that the Building Inspector had the petition but that the Council may not have had an opportunity to review this but it is known generally as a "Red Steer" Drive -in and that their primary function is preparing meals to go - he said that he had seen the one at Mountain Home which was a comparitively new installation; that it was a very nice building and that everything was quite busy and orderly; there were two entrances and two wilts with no evidence of anything being eaten on the premises or being thrown on the ground. Mr. Munn further stated that his plans, if accepted, were to plat the 12 acres in the bottom and that he would deed to the City the Streets which would amount to a fraction over 2 acres; that they would tile the spring water that now runs through there in an open ditch and make provisions to either make a fish pond or cover the spring. He pointed cut that in the past this had been a nuisance due to misquitoes, etc. In answer to the question, he said he would sell one piece either 120 feet frontage or 150 feet frontage and 200 feet deep; that he would remain the owner of the balance of the property. The proposed location of the property and building was discussed as well as the necessity for hav- ing a definate entrance and a definate exit. Mr. Lewis pointed out that it would be had to have an exit or entrance directly into the intersection at Paynter and Kimball. Councilman Davenport inquired as to the hours of operation. Mr. Munn stated that he thought they would be from 9100 A.M. to - 10:00 P.M. on week days and from 9:00 A.M. to 12:00 midnight on Fridays and Saturdays. It was moved by Councilman Martin that the matter be held in abeyance until it could be discussed completely with the full membership of the Board of Adjustment. The motion was lost for want of a second. It was then moved by Councilman 5nith, seconded by Councilman Martin that a special meeting for t City Connoil and Board of Adjustment be called for Friday the 21st day of December, 1962, at 6100 A. M. in the Council Chambers for further consideration of the matter. A vote was taken and the motion unanimously carried. Permission requested for placing street planters on sidewalks Mn Pete Haman was then recognized when he informed the Council that he was present, representing the Chamber of Commerce on the street planters. He stated that, at present, they had definate orders for eleven planters and they needed the permission of the City to place them upon the sidewalks. Acting Mayor Vassar stated that he was interested in knowing who was going to maintain the planters and see that they were kept looking nice. Mr. Haman stated that it was more or less the census of opinion that the City would be asked to keep them watered with the City Sprinkler. Various means of maintenance as well as those being used in other Cities were discussed after which it was moved by Councilman Luby, seconded by Councilman Davenport that the matter be tabled for further investigation. A vote was taken and the motion was unanimously carried. (Letter from Caldwell Ministerial Association The following letter was then read from the Caldwell Ministerial Association) December 12, 1962 To the Mayor of Caldwell, Mr. E. L. Vassar, and Members of the City Council: Dear Sirs: The Caldwell Ministerial Association, in their December session recently, voted unanimously to command our City Council for supporting the continuance of Caldwsll�s fine reputation of having no beer sold in grocery stores. Logically a product which is forbidden to our youth because it is demoralizing to them, should not be sold in places where children and youth are freely allowed. The atmosphere of a grocery store is not improved by the presence of a product with such a reputation as beer has. From 25% to 40% of traffic accidents are "under the influence." About 75% of divorce litigation testimony reveals an alcoholic- beverage relation. X65 Fights and killings are very often reported as occurring at taverns, or associated with intoxication. Much juvenile delinquency is related to beer - drinking. May we urge you to continue to resist any effort to extend or increase the sale of alcoholic beverages in our fine town. Hall Vice - President Mayor's Report to Council - Police Department The following report was read to the Councils ` 12/17/62 MAYOR'S REPORT TO COUNCIL On or about the 10th of October there appeared in the Caldwell Neese- Tribune an article with reference to the resignation of the one, Floyd Szafrajda from the Caldwell Police Department. The resignation, in part included the following statement -Quote - eFor the benefit of the public there should be an investigation made of the Police i Department and some of its members" -- End quote - I wish to advise that I have conducted such an investigation by inspecting the Police records, making personal contacts associated with my own observations. I have been unable to find any evidence of irregularity in the handling of funds or derlict of duty on the part of the Chief of Police or his staff. Therefore, I am of the firm opinion that the Chief of Police, Charles Latleford and his Staff are rendering a distinct service to the City of Caldwell, which is a real credit to the City and the surrounding community. I wish to take this opportunity to assure you that I shall continue to maintain surveilance over the Police Department as well as all other Departments which come within my jurisdiction. Airport Lease - Robert Madden approved A lease between the City of Caldwell and Robert Madden for the construction of a hangar and storage facilities at the Airport with a term of 20 years commencing on the 1st day of December, 1962 and ending on the 30th day of November, 1982 was presented to the Council. It was moved by Councilman Smith, seconded by Councilman Luby that the Mayor and Clerk be authorized to execute the Lease with Robert Madden on behalf of the City. Berenter A claim was then presented to the Council from Joe H. Perenter for $49.00, covering the cost of repairs for damages caused by backing of the main City sewer line into their basement on the evening of Sunday, November 4, 1962. It was moved by Councilman Luby, seconded by Carneilman Shorb that the claim be denied and refer- red to the Insurance Company. A vote was taken and the motion unanimously carried. City Attorney announces suit against the City by Caldwell Memorial Hospital The City Attorney, Dean Miller, informed the Acting Mayor and Council that the City had been sued by the Caldwell Memorial Hospital for the bill. incurred as a result of the shooting incident with a Mr. Dale Turner by one of the City's Police Officers; Canyon County was also named in the suit and the City Attorney stated that he would recommend to the Council that the City try this case and get a determination in the matter. Recreation Center dances discussed The dances at the Recreation Center were discussed with the Chief of Police informing the Council that he understood the students signed a pledge card which the Mecarvins considered as being on a membership basis. The pledge cards were issued to the students as they entered the door for attendance at the dance. In answer to the question, the City Attorney advised the Council that he didn't think this proesedure constituted membership in that they had to have certain requirements for membership, as well as certain rules and regulations. The manner of operation as set forth in the application to the Zoning Board was discussed with it being understood that the permit had been issued in the particular one based on a long range program of developing certain things and that a permit for remodeling had been issued for a market and dance studio to he located where the dances are now being held. The City Clerk was then instructed by the Council to write the McOarvins a letter requesting that they meet with the Council at their regular meeting in the Council Chambers at the City Hall on January 7, 1963, at 8:00 P. M. for the purpose of clarification of the type of dances being held at the Recreation Center. State Highway Board meeting reported Councilman Shorb reported that he had attended a meeting in Boise as a representative of the Idaho Municipal League. He said that he attended a meeting with the State Highway Board and that the Executive Director of the League, Mr. Simmmerman, was present and could probably explain the meeting and that he thought It would be of interest to the Council. Mr. Ed Simmarman then addressed the Council and explained some of the items concerning Cities whic were to be brought before the Legislature this year. He explained the present apportionment of the Liquor Fund which returns 28 314% to the Cities and said the League was asking the Legislature for an additional proportionment which would amount to 74% plus 25 %. He said that the State collects a gas tax from gasoline used on Airports and that they were asking that 50% of the tax paid be returned to the Cities. Of the Highway Users Fund, 70% was going to the State with Cities getting 2.7% of the total fund and they were asking for 15% of this Fund, or that, as a possible alternative, they may ask that Cities be declared as a Highway District which would increase the return of these monies to the Cities. It was moved by Councilman Smith, seconded by Councilman Martin that the bills presented for Mid - December-be approved and that warrants be issued in the various amounts for payment of them.
