IT IS TH^REFORS ORDERED, That the City Treasurer is hereby authorized to transfer from the Water and Sewer Fund to the General Fund, the sin of Thirty Nine Thousand Dollars and no /100 ($39,000.00) DOLLARS. i Upon Roll Call the following Councilmen voted in the affirmative : Vassar, Blomquist, Shorb, i l l Eldredge and Finley. Negative: None. Absentand not voting: Luby. l Thereupon the Mayor declared the motion carried and the Resolution adopted. I This matter was referred to the City Engineer. Thereupon Councilman Finley introduced Bill No. 6, entitled: AN ORDINANCE CONFIRMING THE CREATICN AND ESTABLISHMENT OF LOCAL IMPROVEMENT DISTRICT N0. 44 FOR it THE CITY OF CALDWELL, IDAHO: CONFIRMING AND APPROVING THE ASSESSMENT ROLL FOR SAID DISTRICT AS FILED IN THE 'I OFFICE OF THE CITY CLERK ON THE 6th DAY OF OCTOBER, 1958; PROVIDING FOR THE PAYMENT IN INSTALLMENTS OF THE I it COSTS AND EXPENSES OF THE IMPROVEMENTS MADE OR TO BE MADE IN SAID DISTRICTL ASSESSING THE COSTS AND EXPENSE$ OF SAID IMPROVEMENTS UPON OR ACROSS THE ABUTTING, ADJOINGING, CONTIGUOUS, AND ADJACENT LOTS, BLACKS AND LANDS AND PARCELS OF LAND, UPON THE LOTS, BLOCKS, LANDS AND PARCELS OF LAND, UPON THE IATS BLOCKS, LANDS AND I, PARCELS OF LAND BENEFITED AND INCLUDED IN SAID IMPROVEMENT DISTRICT, AND PRESCRIBING THE MANNER FOR THE I COLLECTIONAND PAYMENT OF SAID ASSESSMENT; PROVIDING FOR THE ISSUANCE OF INSTALLMENT BONDS OF SAID DISTRICT: PRESCRIBING THE FORM, MATURITIES, MAXIMUM INTREST RATE, AND ALL OTHER LEGAL REQUIREMENTS RELATIVE TO THE ISSUANCE OF SAID BONDS. i� which was read for the first time and the Council proceeded to a consideration of Bill No 6. It was moved by Councilman Vassar, seconded by Councilman Blomquist that the rules requiring that the reading of a Bill I on three seperate days be suspended and that Bill No. 6, be read the second time by title and the third time; in full section by section and placed on the final passage, The Mayor directed the Clerk to call the Roll II on the above motion with the following result; Those voting in the affirmative were: Vassar, Blomquist, Luby, Shorb, Eldredge and Finley. Negative; None. Absent and not voting: None. The Mayor declared the motion had passed by the necessary three - fourths majority and directed the Clerk to read Hill No. 6, the second time by title and the third time in full section by section. I Section 3346 Idaho.Code, grants authority to the City to establish a public library and to make an annual levy not exceeding three mill to constitute a library fund. This Hind is to be kept by the treasurer, se +arate and apart from other moneys of the cite, and to be used exclusively for the purchase of books, periodicals, necessary furniture and fixtures, j. and vhtever is required for the maintenance of such library and reading room. i I take it that the word, "treasurer ", here refers to the City Treasurer. Section 33 -2604, Idaho Code, provides that the directors of the library, as a pointed �! by the Council, are given the following powers: - "They shall make and adopt such by -laws, rules andrerulatinns for th =;r o - Wid nce and for the government of the library and reading room as may be expedient. They shall have the exclusive control of the expenditure of all moeeys collected for the library fund, 'I and the supervision, care, -and custody of the room or buildings constructed, leased or set apart for that purpose; and such money shall be drawn f• the treasury by the proper officers, upon property authenticated vouchers of the board of directors, without otherwise being audited. They may, with the aonroval of the common council, lease and occupy, or purchase it or erect on purchased ground, an appropriate building; provided, that not more than one -half i of the income in any one year can by -et apart in said year for such purchase of building. They may appoint a librarian and assistants, and prescribe rules for their conduct." �I Section 33 -2605 provides that the library shall be free for the use of the inhabitants i of the city, subject to reasonable rules and regulations. Section 33 -2606 requires that the board of directors shall make an annual report to the State Library Commission. Section 33 -2607 states that persons having a desire to make donations of money, per- sonal. property or real estate for the benefit of such library, shall have the right to vest the title to the same in tt,. board of directors, to be held and controlled by theboard. I, Reading all of these sections together, it would appear to me that the intention of the legislature was that the library and the library board of directors were to be free from control of any other board. It would appear to me that the library fund, as collected by the three mill levy, must be kept. by the City Treasurer, and in a separate fund. It would annear, further, that this money can beexoended upon the voucher of the board of directors of the library, and that the Mayor and Council are neither authorized nor required to pass upon the expenditures of the library board. II ThAse conclusions are further bolstered by the fact that donations to the library, whether in r..cney or real Ar ate, are held in the name of' the library board, as trustee. I know of no other department of the city which has the right to take and hold title to real property in it own name. ' I I , I conclude, therefore, t. -at the library board has the cntrol of its expenditures, - and that the :•cuchers of the library oard are sufficient authority for the City Treasurer to draw upon the library fund. 1 This raises one additional nroblem, and that is with respect to the collection o; taxes, -£taxes, in the situation where taxes have not been colle ^ted an the City j a e i y has issued tax anticipation notes. • I It would annear to me that as the librs r• fund is created by city mill levy, that the 1:� proportion of uncollected taxes represented by the three -mill. levy could be included in the notes issued, and the library board receive its proportionate share of tax note money. 1 Yours bery truly, /s/ Dean E.
