The Council met in regular session, Dedember 6th, 1926 at 8 P.M. with Mayor Kaley, presiding, Councilmen, Conley, Dutton, Mumford, Mo and Wheeler, present, and Kimbrough, absen . Jess Kipp appeared before the Council relative to the vacating of Block 107 Goandu A dition to Oaldwell, This Idatter was referred to Fred Va" onnel for investigation. Mr. W.H.Redway appeared before the Council relative to his being granted permission to lace a gasoline storage tank either underground or overhead of more than 800 gallbne on Lots 11 and 12, Block 89 Original ' +'+®smite. It was voted on motion of 'TheelarWseconded 4 Mcconnel, tI. at the aforesaid matter be referred to a committee of three to be appointed by the Mayor to invs igata the same and report back at the earliest possible date. The Mayor appointed MoGonnel, Who er, and Mumford. Il l Bill No. 23, by Wheeler, entitled " AN ORDINANCE AMENDING SECTION 5, OF ORDINANCE NO 428, ENTITLED " AN ORDINANCE CREATING AND ESTABLISHING A LOCAL STREET IMPROVEMENT DISTRICT M 1E CALLED "LOCAL STREET IMRPOF=NT DISTRICT NO. 5 ", IN THE CITY OF CALDWELL, =aON COUNTY, IDAHO; DESIGNATING THE STRE,= AND POINTS BETWEEN WHICH SAID IMPROVEMENTS SHALL BE MADE, AND FR IDING FOR THE CONSTRUCTION OF dURBS AND GUTTERSTHEREON :PROVIDING THAT THE COST AND MHUSE OF SARD IM- PROVEMENT SHALL BE TA%ED AND ASSESSED UPON ALL TEE PROPERTY IN SAID IMPROVEMENT DISTRICT 2 OXTTNG OR ABUTTING OR CONTIGUOUS OR TRIBUTARY TO THE PORTIONS OF SAID STREETS SO IMPROVED: AND SCRIB- ING THE METHOD OF SUCH ASSESSMES7T AND THE PAYMENT THEREOF; REPEALING ALL ORDINANCE$ 1XVWX RESOLUTIONS OR ORDERS, OR PA=TS THEREOF IN CONFLICT HEREWITH, AND DPCLARING AN EMERGENCY" RE- PEALING ALL ORDINANCES OR DARTS OF ORDINANCES IN CONFLICT HEREWITH." was read for the fitet time. A motion was made by Mumford, seconded by Wheeler, the' the rules requiringthe reading of a bill on three seaorate days be suspended, and Bill No. 23 read the second time by title or the third time in full and placed on its final passage. The Mayor caused the Clerk to call the roil on the aforesaid question with the folowing result: AYES: CONLEY,DUTTON, TTUIviFORD, MCCONNEL, AND WHEELER. NAYES: NONE. ABSENT: KIMBROUGH. SO the Mayor decbired the motion had carried bythe necessary 3/4 major and caused the Clerk to read Bill No. 23 the second time by title, and the third time in f section by section, and on the question , as put by the Mayor, SHALL BILL 110. 23 PASS? The Mayor directed the Clerk to call the roll on the same with the following result to -wit: AYES: CONLEY, DUTTON, MUMFORD, MCCONNEL, AND WHEELER. NAYES: NONE. ABSENT: =ROUGH. Whereupon the M�U or deoalred the Bill No. 23 had passed and now became ante No. 429, duly signed and approved the same in open session of the Council, and direct Clerk to make proper entry of the same and cause the same to be publdehed in the Caldwell the official newspaper of the City of Caldwell, Canyon County, Idaho. It was voted on motion of Wheeler, seconded by Dutton, thNt the following bills as appx be allowed and warrants ordered drawn on the various funds to -wit: NO.
