Mr. Lewis then inquired as to when the money should go into escrow. Be added that although the bi was being awarded now, it would take several days to have it executed and agreed to. Councilman Gamboa stated that he felt it should be in escrow prior to the City's committment with Boise Paving. I Councilman Dakan moved to accept the low bid of Boise Paving and Asphalt for $11,942.50, subject to Mr. Lasher's signing an agreement to put the money in escrow as on the previously oral co=dttment. The motion was seconded by Councilman Gamboa, and after a vote, carried. The regular monthly meeting of the City Council met in the Council Chambers of the City Hall with Mayor Charles W. Carpenter presiding. Upon Roll Call, the following Councilman answered present: Alfred H. McCluskey, Charles C. Banks, Joe Gamboa, and Lester E. Carter. Absent: James R. Dakan. Introduction of guests For the first order of business, Mayor Carpenter acknowledged citizens who requested audience with the Council. He first called the name of Mr. Earl Westmark and then M. Houston Willis, representing Circle E. Stores. Neither were present. Bill No. 45 - Ordinance No. 1283 Councilman McCluskey introduced in written form Bill No. 45, entitled: AN ORDINANCE RECITING THE PASSAGE APPROVAL AND PUBLICATION OF ORDINANCE NO. 1282; DETERMINING THAT NO OR=- TICKS TO THE VACATION OF A PORTION OF CEDAR STREET AND THE VACATION OF A PORTION OF SPRUCE STREET WITHIN THE CITY OF CALMELL, CANYON COUNTY, IDAHO, DESCRIBED AS FOLLOWS, TO WIT: which was read for the first time, and the Council proceeded to consideration of Hill No. 45. It was moved by Councilman McCluskey, seconded by Councilman Carter, that the rules requiring the reading of•a Bill on three separate days be suspended and that Bill No. 45 be read the second time by title and the third time in full, section by section. The Mayor then directed the Clerk to call the roll on the above motion which re- sulted as follows: Those voting in the affirmative: McCluskey, Banks, Gamboa and Carter. Those voting in the negativsv fine. Absent and not voting; Dakan. The Mayor declared the motion had passed by the necesm one half plus one of the members of the full Council and directed the Clerk to read Bill No. 45 the second time by title and the third time in full, section by section. The Clerk read the Bill as directed. It was moved by Councilman McCloskey, seconded by Councilman Carter, that Bill No. 45 do pass. Thereupon, the Mayor declared that Bill No. 45 had passed, and the Mayor in open session of the Council duly signed and approved the Bill and the Clerk duly signed and attested the same which became ordinance No. 1283. The Mayor directed the Clark to make proper entry of the same and to cause Ordnance No. 1283 to be published in the News- Tribune, the official newspaper of the City of Caldwell, as required by law. Mobile Home Ordinance report In reference to the proposed Mobile Home ordinance, Councilman oamboa stated that both he and Coun- cilman Carter had selected Nampa ordinance No. 1187 to be used as a guideline in the preparation of the Cald- well ordinance. Councilman Carter suggested that the City Attorney draw up an ordinance to be presented at the nex meeting as the first reading. Councilman McCloskey then suggested that the proposed ordinance be distribute to each Councilman for study prior to the nest meeting. A motion was made by Councilman Oamboa, seconded by Councilman Carter, to instruct the City Attorn to draw up the necessary ordinance. Upon vote, the motion carried Adult book store discussion Councilman Carter stated that he had received several calls regarding the adult book store, The Pussycat, which was located on Main Street. He added that he would like to have the City Attorney check int the situation to see if there was any way to control it. Councilman McCluskey then c ommented that he, too, had received calls on the store, and he concurred in that something should be done to alleviate the problem. Councilman McClus1my added that as little publicity as possible should be given to the store as it is only a means bf free publicity and advertising. Mayor Carpenter stated that it would be hard to do anything abou the store because of the legislative actions and the recent Supreme Court decision, but that he hoped that this could be solved from another angle. Letter from Robert Pasley Councilman McCloskey proceeded to read the following letter from Mr. Robert E. Pasley: December 4, 1972 To the Mayor and City Council: With knowledge that a vacancy would exist but prior to Mr. Davenports resignation from the Council, a group of Caldwell Citizens approached me with a request that they submit my name for appointment to the impending vacancy. Having a desire to serve in this capacity, I assented. Because of the circumstances that have occured since that time and with full know- ledge that I will not be recommended to fill this position, I believe I should release the members of the Council from their support of my appointment. I do so regretfully, but with the conviction that continuing dissection, of this nature, may impair the cooperation sought by the Council from the Mayor while they are attempting to solve the many existing problems of the city. I would take this opporunity to thank the numerous Caldwellites that have supported me with particular thanks to the Council for their justified fortitude. Currently, I do intend to seek an elective City office next November which will allow the voters to make a determination. Yours truly, /s/ Robert E. Pasley Councilman Carter commended Mr. Pasley for making the statement, thus eliminating the stalemate between the Mayor and Council. He then suggested that the name of a prospective appointee be presented beta the Council prior to a regular meeting. The Mayor stated that he would be willing to adhere to this. Comments from Councilman McCloskey regarding sewer Councilman McCloskey stated that there was a great deal of misunderstanding in his mind, primarily regarding sewers. He added that he was not referred to the Sewer ordinance, butto the things the Mayor and Council had been trying to accomplish regarding sewers and a sewer disposal syste. Councilman MoCluskey sei, that, as he had understood it, the Environmental protection Agency (EPA) gave information that in May of 197. the City of Caldwell would have increased sewer disposal facilities. In May of this year, the City made ap- plication for a federal grant to develop the sewer system, andthe application was not approved because of more regulations imposed by EPA and BUD (housing and Urban Development). Councilman McCluskey stated that i' was confusing to him because it seemed that whatever the City did was not snought. He added that now it was necessary for the County to have a county -wide plan and engineering services developed, and, also, to hire a full -time, professional engineer, and until this was done, the City would not be eligible to receive a feller grant for sewer development. 443 Councilman Gamboa stated that he had discussed the problem with County Commissioner, Idlliam Norberg, who informed him the Federal Government allowed money for a planning engineer for one year only, an it was then up to the County to take over the salary though there was no assurance that federal funds would be made available, and because of this, the County turned down a planning engineer. Mayor Carpenter stated that he was sppposed to receive from the HID office a detailed breakdown as to why the application that was presented from the Council of Governments was turned down. He added that some of the reasons were (1) there had to be an overall water and sower study of the county, (2) a five year workable program developed for the county and (3) also the full -time planner established for the county. In response to Councilman McCluskey, Mayor Carpenter stated that in order to accomplish the neces- sary program for obtaining Federal funds, pressure would ham to be put on the County Commissioners so that ample money would be appropriated in their budget to property fund the Canyon Davelopment Council. Comments from Councilman Banks regarding swilling pool Councilman Banks inquired as to what information had been received from Luekenga Construction re- garding the swimming pool. City Engineer, Mel lewis, stated that the contracts had been placed on his desk the previous Friday, and after checking with the City Attorney, they had been returned to Luekenga for props and complete signature. He added that from Mr. Luekenga's indication, the signing would be imminent, and after the contract was properly signed, the Notice to Proceed would be issued. Councilman Banks then suggested that the present bleachers at the swimming pool be moved to the small baseball diamond. Mr. Lewis said this would be taken under consideration. Final Plat of Lasher Addition approved Mr. Lewis presented the Final Plat of Lasher Addition for the consideration of the Council. He commented that the Council should settle whether this plat should be accompanied by a bond. To this, Coun- cilman Gamboa stated that since the Preliminary of the Plat had been approved without any stipulation, this Final Plat should also be approved unconditionally. Councilman Gamboa than moved that the Final Plat of Lasher AddUon be approved. The motion was seconded by Councilman Hanks and, upon vote, carried. Final Plat of Owyhee Village Subdivision approved Mr. Lewis next presented the Final Plat of Owyhee Village Subdivision. He stated that the subdivi lion was South and East of Blaekers Appliance and Furniture, outside the city limits, and was in order. Councilman Gamboa commented that not all of the easements were labeled and this should be done. The representative of Mr. Weissroek, the land surveyor for this plat, stated that this could be corrected. It was moved by Councilman Gamboa, -seconded by Councilman Carter, to approve the Final Plat of Owyhee Village Subdivision subject to the additional labeling of the 20 feet drainage easements. After a vote, the motion carried. Bid opening for Electronic Accounting Equipment For the next order of business, Mayor Carpenter recognized John Englehart, Finance Director, who proceeded to open bide for Electronic Accounting Equipment. Englehart Finance Director City of Caldwell Dear Mr. Englebart: Thank you for the opportunity to respond to your Invitation to Bid, dated November 17, 1972. After thoroughly studying the specifications and information to bidders, we respectfully sub- mit the following observations and recommendations: 1. We understand the general requirements and intended use of the electronic equipment and sub- aystema mentioned, however, there are essential details which we feel still need to be specified. a. For example, page 1 of the Information for Bidders implies that only portions of Exhibit "A" are applicable to meet the requimrcets of the accounting system for the City of Caldwell. We hesitate to bid a price for that pro gramming when it is not clear what portions of the system are actually applicable. b. Paragraph (B)1 of the General Specifications states that the Payroll System must produce 'reports for the City of Caldwell and reports re- quired for other governmental reporting;" Again, it is unclear what specific reports are desired. c. Paragraph (B)6 is also vague in that it specifies no reports, but only a "system of accounting for inventories... as determined by the City of Caldwell." 2. The Information for Bidders states that all bids must be submitted in a lump sum basis. We feel this is somewhat limiting to the City of Caldwell for the following reasons: a. By providing an equipment purchase analysis which includes other factors such as residual values of equipment, we can give you more amplete infor- mation for making a sound decision. b. Programming doesn't need to be done by the equipment manufacturer, and in fact could be contracted to local firms or individuals on a bid basis. In addition, the qrstems design and the programming are separate acti- vities which could be done by separate contracts, and therefore at dif- ferent prices. c. Package programs are available and should be evaluated to see if they fit your needs. If so, they can sometimes be obtained at not cost at all. In view of the above observations we feel that the City of Caldwell deserves the benefit of a further study of its needs to more completely specify the requirments for competitive bidding. We would be glad to assist you in any way in carrying out this study. Again, than you very much for your Invittion to Bid. Mayor Carpenter then acknowledged Mr. Paul Jones, representative of Singer- Friden, who stated that he and his company would be glad to meet with any of the Councilmen regarding the equipment. Mr. Jim Wozniak of Burroughs Corporation commented that the most important thing his company had t offer was experience, and he added that he would offer his assistance to this Council. Also offering his assistance was Brent Bel.iiston of NCR. Mr. Jack Magdiel, IBM representative, recommended further study to recognize some of the impacts Involved. Re added that he would like to meet with the Council to have the requirments more clearly defined Letter from Ron Blakely Mayor Carpenter then read the following latter from Ron Blakely regarding the retention of percen- tage of Engineering Fees under the Contract for Proposed L.I.D. No. 68: 44� i Honorable Mayor and City Council Members City of Caldwell 704 Blaine Street Caldwell, Idaho 83605 December 1, 1972 Re: Retention of percentage of Engineering Fees under the Contract for Proposed L.Z.D. #68 Dear Sirs: In accordance with Article 16, Item H. in our agreement for the Proposed local Improvement District #68, monthly payments were to be made by the city to the engineer in the amount of 90% of requests submitted month by the engineer. The monthly requests were submitted an the basis of time spent on the project at the hourly rate as scheduled in the agreement. This is the method used for arriving at interim progress payments toward a final engineer- ing fee which is a percentage of the cost of construction. The original agreement was drawn to cover engineering design work for area numbered 1 through 10 throughout the city. Some work has been done in all of these areas and the design for each area was in various stages of completion when we were requested to hold up any further work until a method of proceeding was studied further by the city. Daring the period in which we were submitting monthly estimates, the 10% retention fee amount to $4,570.00. At the present time we have completed design and obtained a construction contract for a small portion of the aswer main on Marble Front Road and for the Lasher Development which is in area #3 of our original agreement. The city has been billed for the engineering de- sign on this portion of the work on the basis of a percent of the construction fee rather than a monthly estimate. We have credited a percentage of the monthly estimate which we received for area #3 to this project so that the city is not paying twice for this work. Since it has been some months since any work has been done on ary of the areas other than that on Marble Front Road, it would be appreciated if the rentention noted above could be released at this time without jeopardizing our contract with the city. It would also be an aid to us if we could be informed whether or not the city plans to con- tinue with wrk in the other areas in order to bring the engineering design more nearly to completion in each area, or if you plan to hold at the present stage of design. This infor- mation will help as in planning for our future work load. We will be happy to continue to work with the city in whatever capacity you decide. However, as indicated in the fee schedule in our agreement it is somewhat more economical from a design fee standpoint to design an area as large as possible. Very truly yours, Ronald M. Letter from Van Buren P.T.O The Mayor proceeded to read the following letter from the Van Buren School P.T.O: November 27, 1972 Dear Sirs, We the members of the Van Buren P.T.O. wish to express our thanks for the curb and gutter you had installed along Denver Street. Thank you, Van Buren P.T.O. Mariann Crowe, Secretary Request from Library Board Mayor Carpenter stated that since the resignation of C. A. Davenport from the City Council, the Library Board had not had a representative from the Council. Mr. Frank Payne, Chairman of the Libra79 Bo commented in a letter that the Board would like to request the appointment of Councilman Carter to the Bo Upon request and question, Councilman Carter stated that he would be happy to serve. Letter from the Chamber of Commerce The Mayor read the following letter from the Chamber of Commerce: Mayor Charles Carpenter City Hall Caldwell, Idaho Dear Charlie: Just a brief note this morning to appraise you of the outstanding job done by your City Crews, with the approval of City Works Director Mel Lawi.s, in erecting the downtown Christmas Atmosphere. We are fortunate in Caldwell to have a Mayor and Council so understanding as to allow time by city employees to do jobs such as this. I know other communities have it 'hired' done. Mel and Pete Wykert have been very cooperative in all labor tasks requested by the Chamber of Commerce and/or the Merchants Association. November 30, 1972 446 Caldwell Chamber of Commerce Joe Jensen Executive Vice President Action on application to State Plumbing Hoard Mayor Carpenter stated that he had received a claim form from the State Plumbing Board for the pay- ment of $357.07 to the City, which is 10% of the plumbing inspection fees collected in the City of Caldwell (from November, 1971 to November, 1972. Councilman Carter moved, Councilman McCluskay seconded, to authorize the Mayor and Clark to sign the form requesting the $357.07 payment. A vote was taken, and the motion carried. Comments by Councilman Gamboa regarding water bills Councilman Gamboa stated that in discussion with members of the Realty Board he was asked why if renters moved leaving a delinquent bill and the water disconnected, the owner was required to pay the bill before water could be turned on again, but yet the City would turn on the water at a new residence for the same individual who had just left the delinquent bill when he moved. Upon request from Mayor Carpenter, Johr Englehart explained that this form of forcing collections had been set up in the revenue bonding ordinance. Discussion of Corner Bar & Grill Mayor Carpenter said he had received from Mr. Earl Young of the Corner Bar and Brill, a letter whic was sent to Mr. Young from Mr. Dufur, Building Inspector. Councilman Banks commented that in his conversation with Mr. Young he had suggested that he send a letter to the Mayor and Council regarding the situation. He explained that Mr. Young had a ]ease purchase agreement on the Corner Bar and Grill which held the owner responsible for the repair and maintenance of the building, and as this had not been done, he wanted to get some kind of condemnation on the property. Mr. Dufur reported that he had requested Steve Howard of Howard Electric to get at least the dan- gerous problems corrected, but Mr. Howard had reported to him that Mr. Young would only allow him to work between the hours of 2:00 and 3:00 P.M. and would give him no cooperation. Mr. Dufur added that Mr. Howard had corrected much of the problem, but was unable to bring it completely up to Code. Mr. Dafur then commented that he believed there was a personal reason on Mr. Young's part involved due to his purchasing the building. Councilman Gamboa suggested that Mr. Dafur go down and check the building, and if the work was not completed, insist that it be done. Mr. Dufur stated that Mr. Young had begged him to close down the buildin; since he apparantely wanted the Building Department to force the owner to get the building up to Code before Mr. Young took possession as owner. The Council recommended that Mr. Dafur continue to check into the situation and report back to the Mayor as to the dispostion that was taken. Variance approved - Earl Wehtmark The Mayor next recognized Mr. Earl Westmark who was called upon at the beginning of the meeting was not present. Mr. bkstmark wequested a variance to build a two family dwelling on a 50 x 120.26 lot at 3111 South Illinois. It was moved by Councilman McCloskey, seconded by Councilman Gamboa, to grant the variance to Mr. Westmark. Upon vote, the motion carried. Quitclaim Deed approved - Alex R. and Anita Winn City Engineer Mal Lewis presented a Quitclaim Deed from Alex R. andAnita Winn for the area bounded and particularly described as follows: Beginning at the Northeast corner of the Seuth half of the Southwest Quarter of the Southwest Quarter of the Northwest Quarter of Section 23, Township h North, Range 3 West of the Boise Meridian; thence South, along the East boundary of the Southwest Quarter of the Southwest Quarter of the Northwest Quarter of Section 23, 3000 feet; thence West, parallel with the North boundary of the South half of the Southwest Quarter of the Southwest Quarter of the said Northwest Quarter, 402.84 feet; thence North, parallel with the West boundary of the said South Half, 30.00 feet; thence East, along the North boundary of the said South Half, 402.84 feet to the Point of Beginning. Mr. Lewis recommended that the Quitclaim deed be approved and the Clerk be instructed to record it. A motion was made by Councilman Carter, seconded by Councilman Gamboa, to approve the Quitclaim Deed and in- struct the Clerk to record it. A vote was taken, and the motion carried. Application for Secondhand Store license approved An application from A. G. Erskine d/b /a Erskine's Secondhand Store, 1215 Cleveland Boulevard, for z secondhand store license was next presented for the Council's consideration. 47 It was moved by Councilman McCluskey, seconded by Councilman Banks, to approve the application a secondhand store license and to issue same. Award of bid for Electronic Accounting Equipment Mayor Carpenter stated that this meeting had been scheduled to consider the three bids which had been submitted for electronic accounting equipment. He added that the bide met the specification, and it wee the Council's percgative to either accept one of the bids or reject all bids and call for bide again. Upon question f rom Councilman Gamboa, Finance Director John Englehart stated that all machines which were bid would be capable of doing the present work under the uniform accounting system and would only become inadequate if more capacity were required due to future grwwth of the City, that then, at such time, he would assume that the calling for bid would again be required.
