Council met in regular session persuant to law, with Mayor Mcconnil presiding and Councilmen, DICnNS, GORDON, JOHNS, LEIGHTY AND SAN=ff2R, present. Absent, BOLLMAN. Owing to the absence of the City Clerk, the Mayor appointed Mr. W. C. Dyer Acting Clerk, and announced that the Council was in session for the consideration of amy business which might lawfully come before it. The mayor directed the Clerk to read the minutes of the previous meeting, which was ordered approved as read. L. D. Horn, appeared before the City Council in behalf of Columbia Gorge Motor Company and requested a loading zone be established in front of their office on seventh Street and extending North to the Home Cafe. Motion by 8andmeyer, seconded by Johns, That the flatter of the Loading Zone of the Columbia Gorge Motor Company be referred to the Street Committee with Power to Act, consisting of Councilmen Dickens, Leighty and Chief of Police Fred Rowland. N A RESOLUTION ACCEPTING THE ASSESSMENT ROLL OF LOCAL STREET ITTROVEMBNT DISTRICT N0. 7, UPON RE- ASSESSMENT OF BENEFITS IN SAID DISTRICT, AUTHORIZING THE CLERK TO GIVE NOTICE OF THE TIME AND PLACE FOR HEARING AND CONSIDERING OBJECTIONS TO SAID ASSESSMENT ROLL AND FIX12TG A TIDE FOR HEARING AND CONSIDERING SUCH OBJECTIONS. WHEREAS, the assessment roll of Local Street Improvement District No. 7, for the reassessment of benefits in said district, has been completed in compliance with the provision of the laws of the State of Idaho, and the ordinances of the City of Caldwell, said assessment roll having been prepared and certified to the Council by the Committee o Streets and the City Engineer; now, therefore, be it RESOLVED, by the Mayor and Council of the City of Caldwell, Idaho: Section 1. That the assessment roll of Local Street Improvement District No. 7, for the City of Caldwell, Idaho, for the reassessment of benefits in said district, be accepted and placed on file in the office of the City Clerk; and the said Clerk is hereby authorized and directed to give due and legal notice in compliance with the provisions of law, to property owners that objections to said assessment roll may be filed within ten days from,the first publication of said notice of filing of assess- ment roll, which objections will be considered by the Council on Monday, December 23, 1929, at 8 :00 o'clock P.M. Motion by Dickens, seconded by Gordon, adopting said Resolution #19. The Mayor directed the Clerk to call the roll on the question as stated with the following reeplte. AYES, DICKENS, GORDON, JOHNS, LZIGHTY,.AND SAIMMEYER, Absent, BOLLYAN. The Mayor declared motion carried and Resolution #19 adopted, The Mayor and Clerk approved and pigned same in open session of the Council. Thereupon Councilman Diokens introduced Bill No. 9 By Dickens Entitled: AN ORDINANCE GRANTING TO THE OREGON SHORT LINE RAILROAD COMPANY, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE AND RIGHT TO CONSTRUCT, OPERATE AND MAINTAIN A STANI)ARD GAUGE RAILR( TRACK IN THE ALLEY IN BLOCKS EIGHTY -SEVEN (87) AND EIGHTY -EIGHT (88) AND OVER AND ACCESS NINTH AVENUE NORTH AND TENTH AVENUE NORTH, IN THE CITY OF CALDWELL, IDAHO. which was read for the first time,and the Council proceeded to a consider Bill No. 9. It was moved by Johns, duly seconded by Dickens that all rules requiring the readin€ of a bill on three separate days be suspended and that Bill No. 9, be read the second time by title and the third time in full and placed on its final pasaa -a. The Mayor caused the Clerk to call the roll on the motion with the following results: Those voting in the affirmative: Dickens, Gordon, Johns, Leighty and Sandmeyer. Those voting in the negative: None. Absent: Bollman. So the Mayor declared the motion had passed by the necessary three - fourths majority, and directed the Clerk to read Bill No. 9, the second time by title end the third time in full, section by section. The Clerk re bill as directed. The Question being "Shall Bill No. 9 pass ". The Mayor directed the Clerk to call the roll which resulted as follows: Those voting in the affirmative: Dickens, Gordon, Johns, Leighty and Sandmeyer. Those voting in the negative: None. Absent, Bollman. Thereupon the Mayor declared Bill No. 9 has passed, and thereupon the Mayor and Clerk in open session of the Council duly signed and approved said Bill which became Ordinance No. 476. The Mayor thereupon directed the Clerk to make the proper entry of the same and cause Ordinance No. 476 to the published in the Caldwell News Tri- bune, the, official newspaper of the City of Caldwell, County of Canyon, State of Idaho. Motion by Councilman Sandmeyer, seconded by Councilman Johns, City continue water contract with Oregon Short Line Railroad Company. Motion Carried. RESOLUTION 110. 20 By Gordon whereas, H. J. McNeal, has presented his application for cancellation of city special taxes for the years 1919, 1920, 192x, 1922, 1923, 1924, 1925,1926 upon Lots 5 to 12 inclusive in Block No. 8 of the Original Town of Caldwell, Canyon County, Idaho, and Whereas, it appears to the best interests of said city to cancel all of said special taxes upon said lots, NOW THEREFORE BE IT RESOLVED, by the Mayor and the Council of the City of the L 1 J Caldwell, that said taxes be and the same are hereby cancelled. !r y Passed. by the Council this 2 day of December, 1929, Approved by the Mayor this 2 day of December, 1929.
