The Council met pursuant to Call and Acknowledgement of Notice in the following forms
Wa the undersigned, Mayor and members of the City Council of the City of Caldwell, Idaho, do
each hereby acknowledge notice of a special meeting of said City Council to be held at the council chambers l h
in the City Ual in the City of Caldwell, Idaho at the hour of 8sO0 P.M., on the 10th day of November, 1947m
for the transaction of all business in connection with the following objects Application for Special
Building Permit to construct grocery store in Class epn Residence Zone.

On Roll Call the following Councilman answered presents Leo J. Mason, Wn olaisyer, L. E. Burrell,,
John Myers, Dale Fenrich and Bryan Harding.
The Mayor informed the Council the meeting was called to take up the petition of J. P. Garber and
: Ralph Garber for a special building permit to construct a grocery store in Class "All Residence Zone. i
This matter had been previously considered by the Board of Adjustment. H. D. Henna and others
had questioned the proceedings of the Board of Adjustment.
Information presented to the meeting disclosed that the petition failed to contain the signatures l
of 75% of the owners of the area within 300 feet of the proposed store building. Upon this finding Lawrence

N. Smith, Attorney at Law representing J. P. Garber and Ralph Garber state that they would not make further
request for the special permit until they could comply with the ordinance requirements.
There being no further business to come before the Council, it was moved by Councilmen Mason,
seconded by Councilman Burrell, that Council adjourn. Motion carried. I,

The Regular Monthly Meeting of the City C,uncil met in the uauncil Rooms of the City Hall, with
the ka R. H. McNeill presiding.
On Roll Call the following dooncilmen answered presents Wks Glalayer, L. E. Burrell, John H.
Myers, D Fenrich and Bryan "arding. Absents Leo J. Mason.
The Mayor announced the following temporary appointments to the Police Department.

Moved by Fenrich, seconded by Burrell that these temporary appointments be confirmed.
on Roll Call it appeared the motion was unanimously carried.
i Application for Punch Board License was read from Rill's Market, the fee accompanying the ap-
plication.
Moved by My ers, Y seconded b Sorrell that this License be granted. Morton carried.
The Bills for November were read and on motion by Glaisyer, seconded by Myers that these Bills be
allowed and warrants ordered drawn for the various amounts all of which had been approved by the Finance
Committee. Motion carried.

Councilman Myers ragaested the Mayor and Council to charge off the ".dater Fund a check;in the amamn'
of $2.50, withost si&nature, dated May y, 1947.
Moved by P.lvers, seconded by Burrell that the City Treasurer be qathorized to deduct $2.50 from
the Mater Hind to cover this check.
On Roll Call it appeared the motion was unanimously carried.
Thereupon Councilman Olaisyer introduced Bill No 16, entitled:
AN ORDINANCE K ENDING SECTION 1-607, CALwELL CODE OF 1942, uzuNG IT NO IRNGER NECESSARY FOR ANY
PERSON APPOINTED AS AN OFFICER OR ANY FIEMBER 01' THE POLICE DEPARTMENT TO BE A gUALIFIED ELECTOR OF THE
CITY OI'CAIr.ELL AT THE TIME OF HIS APPOINTMENT TO SUCH OFFICE, AND PROVIDING AN EFFECTI7E DATE FOR THIS
ORDINANCE TO TAKE EFFECT.
which was read for the first time and the Council proceeded to a consideration of Bill No 16. It w as
moved by Councilman Fenrich,seconded by Councilmay Myers that the rules requiring that the reading of a Bill
on three separate days be suspended and Bill No 16, be read the second time by title and the third time ;in
fullssetion by section and placed on the final passage. The Mayor directed the Clerk to call the roll on
the above motion with the following result -i Those voting in the affirmative weret Glaisyer, Myers, Burrell,
Fenrich and 'Harding,'iegative: None. Absent and not voting. Mason. The Mayor declared the motion had
passed by the necessary three - fourths majority and directed the Clerk to read Bill No 16, the second time
by title and the third time in full section by aaction. The Clerk read the Bill as directed. The question
beint. "Shall Bill No 14 pass ?s The Mayor directed the Clerk tocall the roll on the amove question which
resulted as follows: Those voting in the affirmative wares Glaisywa, Myers, Burrell, Fenrich and Harding.

Thereupon the Mayor declared Bill No 16, had passed and the Mayor:in open session of the Council
duly signed and approved the Bill, and the Clark duly signed and attested the same which became Ordinance
No 718. The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance No 718, to be,
published in the Caldwell News - Tribune the official newspaper of the City of Caldwell, Idaho.
There being no further business to come before the Council it was moved by Councilman Burrell,
seconded by Councilman Glaisyer that Council adjourn. Motioncarried.
