The Council met pursuant to call and acknowledgement of notice in the following form: We, the undersigned Acting Mayor and Members of the City Council of the City of Caldwell, Idaho, do each hereby acknowledge notice of a Special Meeting of the said City Council, to be held in the Council Chambers in the City Hall in the City of Caldwell, Idaho, at the hour of 5:00 P. M., on the 26th day of November, 1962, for the transaction of all business in connection with the following object: Consideration of protest on the Assessment Roll for Local Improvement District No. 50. Upon Roll Call, the following Councilmen answered present: E. L. Vassar, Emile Shorb, Max Luby, C. A. Davenport, V. Jay Martin, and N. E. "Coley" Smith. Consideration of protest - Assessment Roll, L.I.D. #50 In answer to the question, the City Attorney, Dean Miller informed the Council that he didn't know for sure about the title of the property of the Black Canyon Irrigation District but that if it was in the name of the U. S. Government, it cculdntt be assessed and if it was in the name of the Black Canyon Irrigatior istrict, there may be some question. The Acting Mayor referred to the complaint registered by Mr. N. C. Lester and the City Engineer informed the Council that the cracks referred to in the curbing by Mr. Lester had been examined and there w ere construction joints every tan (10) feet as well as the required expansion joints which numbered six (6) n each fifty (50) feet. He said that in his opinion, there was nothing wrong with the Curbing construction; j he grade was good and the appearance was good. Mr. Lewis also informed the Council that he was still withholding the Contractor's retainer and j ould pay it when he knew that one of the Sub- Contractors had been paid. Order No. 2 - Confirming and Approving Assessment Roll, L.I.D. #50 After some further discussion, Councilman Shorb sponsored Order No. 2. ORDER NO. 2 ORDER CONFIRMING AND APPROVING THE ASSESSMENT RCLL IN LOCAL IMPROVEMENT DISTRICT N0. 50 OF THE CITY OF DWELL. IDAHO. The Committee on Streets of the City of Caldwell, together with the City Engineer of said City of aldwell, has thretofore certified and submitted to the Mayor and Council, the Assessment Roll of Local Improvement District No. 50 of the City of Caldwell, Idaho, and it appearing that the assessment roll was received in the office of the City Clerk of the City of Caldwell, at 5 --00 o'clock P.M. on the 5th day of November, 19621 and that said Assessment Roll is now on file in said office; And it further appearing that the Mayor and Council of the City of Caldwell, at a meeting of said yor and Council, held in the City Hall of said City, on the 5th day of November, 1962, passed a resolution ordering said assessment roll to be placed on file in the office of the City Clerk of the City of Caldwell, and fixing the 19th day of November, 1962, at 8:00 o'clock P.M., in the Council Chambers in the City Hall of said City of Caldwell, as the time and place for hearing and considering objections to said assessment roll; and directing the City Clerk of the said City to give due and legal notice in compliance with the provisions of law, of the filing of said Assessment Roll in his office, the data of filing the same and the time and lace at which the Council would hear and consider objections to said Assessment Roll by parties aggrieved by uch assessments and the persons by whom and the time within which said objections should be filed, and directing that said notice be published in three successive issues of the News - Tribune, a daily paper II printed and published in the City of Caldwell, Idaho, and the official newspaper of the City of Caldwell; sl: of which more fully appears in said resolution; And it further appearing that the City Clerk of the said City gave notice of the receipt of said Assessment Roll and of the time and place fixed for hearing protests thereto, directing the time, place and manner of filing said objections; all of which more fully appears by said notice, dated the 5th day of November, 1962, and now on file in the office of the City Clark of the City of Caldwell; and it further appearing that said notice was published as directed in the said resolution above mentioned, in the News - Tribune, the official newspaper of said City, in the issues of November 8, 9 and 10, 1962, as more fully appears by the affidavit of publication of said notice on file in the office of the City Celrk of said City of Caldwell; and it further appearing that notice was duly and regularly given in all respects as required by law and the orders of the Mayor and Council; And it further appearing that the time for filing objections and protests having expired and the time fixed for hearing and considering such objections and protests having arrived and it further appearing that a protest was duly filed on behalf of Black Canyon Irrigation District against the assessment of property belonging to the United States of America and under the control of said Black Canyon Irrigation District and it further appearing that said assessment is not authori by law; And the said assessment roll having came on regularly for hearing and considering and the same having been duly heard and considered by the Mayor and Council of the said City of Caldwell, Idaho, and said assessment roll together with all proceedings in making such assessment having by said Mayor and Council bee found regular, valid, correct, equitable, fair, just, proper and in all respects legal and according to the laws of the State of Idaho, and the ordinances of the City of Caldwell, save and except the assessment again the Black Canyon Irrigation District above mentioned; Naq, THEREFORE, IT IS HEREBY ORDERED By the Mayor and Council of the City of Caldwell, Idahoa Section 1. That the assessment roll of Local Improvement District No. 50 of said City of Caldwell Idaho, be and the same is hereby amended by deleting therefrom assessment No. 27h in the amount of $5,639.20 Section 2. That said assessment roll of Local Improvement District No. 50 as amended herein be and the same is hereby approved and confirmed. Section 3. That the City Clerk shall immediately certify and file said assessment roll with the City Treasurer of the City of Caldwell, for collection of said assessments according to law; and that due notice of time, place and manner of making these payments of assessments contained in said assessment roll be given by said Treasurer of the City of Caldwell, in the manner provided by the laws of the State of Idaho, and the ordinances of the City of Caldwell. It was moved by Councilman Shorb, seconded by Councilman Luby that Order No. 2 be passed. A vote was taken and the motion unanimously carried.
