COUNCIL CHAMBERS
November 20, 1930
8:00 o'clock Pm.
Council met in adjourned session pursuant to law with Mayor go Connel
presiding, and Counoilmen Bollman, Dickens, Gordon, Johns, Leighty and Sandmeyer,
- present. Absent, none.
Owing to the absence of the City Clerk the Mayor appointed Mr. W. C.-Dyer
Acting Clerk and announced that the Uounoil was in session for the consideration
of any business which might lawfully come before it.
Walter Griffiths asked Council to accept 030.00 as payment on Lots
13 to 18 Block 18 Dorman's Addition to Caldwell. motion by Soll an seconded by
Leighty the offer of Walter Griffiths for $30.00 be accepted.' Motion carried.
motion by Dickens seconded by Gordon a committee be appointed to In-
vestigate irrigation ditches on 10th street, motion carried. The mayor
appointed Councilmen Leighty, Diokens and L. M. Porter City Engineer.
. J. fit. Ho& &old presented through the City ,Engineer a proposition to
license electricians, J. R. Ho�tAold, C. D. Purkhiser and Frank B. Meek City
Attorney, with-L. M. Boiler City Engineer were instructed to draw an Ordinance
covering some and present to Council at their next meeting.
Motion By Johns seconded by Dickens the Bill of Canyon County
for $280.00 be allowed, motion oarried.

Thereupon Ocunoilman Dickens introduced the following resolution and
moved its adoption:
RESOLUTION NO 54.

A RESOLUTION ACCEPTING THE ASSESSMENT ROLL OF LOCAL STREBT W ROPEMENT
DISTRICT N0. 13, FOR THE CITY OF CALDWELL, IDAHO, AUTHORIZING THE CLERK TO GIVE
NOTION OF THE TIME AND PLACE FOR HEARING AND CONSIDERING OBJECTIONS TO SAID
ASSESBMENT ROLL AIM FIXING A TIME FOR HEARING AND CONSIDERING SUCH OBJEOTIONS.
WHSRFAS, the assessment roll of Local Street improvement District No. 13,
_ for the City of Caldwell, Idaho, has been completed in compliance with the provisions
of the laws of the State of idsho; and the ordinances of the City of Caldwell,
said assessment roll havibg b &en prepared and certified to the Council by the
Oommitteo on Streets and the City Engineer; now, therefore, be it
RESOLVED, by the mayor and council of the City of Caldwell, Idaho:
Section 1. That the Assessment Roll of Local Street Improvement
1pistriot No. 13, for the city of Caldwell, Idaho, be accepted and placed on file in
the office of the City Clark; and that the said City Clerk is hereby authorised and
directed to give due and legal notice in compliance with the provisions of law,
to property owners that objections to said Assessment Roll may be filed within
ten days from the first publicat ion of the notice of time to file objections to said
Assessment Roll, which objections will be considered by,the Council op.monday,
December 8, 1930, at Bb00 o'clock P.M.
The motion for the adoption of said resolution was duly_seoonded by
Leighty. The question being "Shall,the resolution pass?" The mayor directed the
Clerk to call the roll which resulted, as follows: those voting in the affirmative:
Bollman, Dickens, Gordon, Johns, Leighty and Sandmeyer. Those voting in the
negative: None. Absent and not voting: ,none. Whereupon the Mayor declared the

It was moved by Leighty and asoonded by Johns tb4t the Clerk be instructed
to insert said Affidavot of Publication §s a part of the minutes of this meeting. Kati
carried. Thereupon it was mow& by Dickens, seconded by Bollman that the Clerk proceed
to open the bide for the boing of the work and furnishing the materials in Local Street
improvement District No. 13. Motion carried. The Clerk announced that no bide had
been received for doing the work and furnishing the materials for the improvement in
said improvement district. Whereupon Councilman Dickens presented the following
resolution and moved its adoption.
RESOLUTION N0. 65

A RESOLUTION PROVIDING I'OR THE PURCHASE OF THE MATERIAL AND HIRING OF LABOR
NECESSARY FOR HAVING THE WORK DONE BY THE CITY OF CALDWELL, IN THE CONSTRUCTION OF THE
IMPROVEMENTS IN LOCAL STREET IMPROIEMENT DISTRICT N0. 13, WITHOUT THE LETTING OF A CON-
TRACT MREFOR AND WITHOUT FURTHER CALLING FOR BIDS.
WHEREAS, heretofore pursuant to Resolution No. 53 0 passed and approved by
the Mayor and Counoil on November 3, 1930, the Clerk of the City of Caldwell, advertised
for nids to be rgoeived by the Council of said city at the office of the City Clerk
until the 20th day of November, 1930, for the graveling, grading, surfacing aft oiling
of the streets in Local Street Improvement District No. 13;. and
WHEREAS, no bids have been received by said City Council pursuant to said
advertisement, or otherwise, and it appearing for the beet interests of the City and
of said improvement district that no further call for bids be made-, and
WHEREAS. it is provided in Section 4153, Idaho Compiled Statutes and Section
37, Chapter 257, Laws of 1927, of the state of Idaho, that the city may purchase the
materiels and hire the labor necessary for having, the wer1X done without the letting of e
contract therefor and without the further oslldng for 'bids,-now, therefore

section 1. That the City of ealdwell, in the County of Canyon, State of
Idaho, purchase the materials and hire the labor necessary for having the work Hone

motion carried sit Resolution No. 64,ddopted and directed the Clerk to record the same
upon the :ournal of the proceedings of the Council as a part of the minutes of this
meeting. Thereupon the Mayor in open session of the Council duly signed mud approved
said resolution and the Clerk duly signed and attested the awe.
This being the date set for opening bide called for in Local Street. Improve-
ment District No. 13, the Clerk presented to the Council the Affidavit of Publication
of the Notice of Receiving Bids in Local Street Improvement District No. 13, which
affidavit wea and is in words and figures as follows, to wit;

in the County aforesaid, end•bas been for a period of 78 weeks preceding first publica-
tion of this advertisement ,. -v°e opy of which is attached hereto, and was published in the
regular edition of said The Caldwell News - Tribune two consecutive weeks beginning with
the issue of November 10, 1930 and ending with the issue of November 17, 1930.

any contract therefor, end without further calling for bids.
Beg. 2. That in doing such work the whole cost thereof shall not exceed
the a= of $54,$42.78, being the estimated oast of the work as specified in the
Resolution Declaring the Intention of the City to Create and Establish said Local
Street Improvement District No. 186
The motion for the adopt ion of said resolution was duly seconded by
Leighty, the question being 'Shall the resolution pass ?" The Mayor directed the Clerk
to call the roll which resulted as follows: Those voting in the affirmative; Bollman,
Dickens, Gordon, Johns, Leighty and Sandmeyer. Those voting in the negative: None.
Absent and not voting; none. Whereupon the mayor declared the motion carried and
Resolution No. bb, adopted and directed the Clerk to record the same upon the
journal of the proceedings of the Council as a part of the minutes of this meeting.
Thereupon the Mayor in'open session of the Council duly signed end approved said
resolution and the Clerk duly signed and attested the same.
Motion by Leighty seconded by Johns that the Council adjourn.
