Council met in regular session persuent to adjournment of November 16, 1928, with Mayor Dunlap presiding end Councilmen DAVIS, DUTTON, HOFMAN, JACKSON, MOCONITEL AND MUMFORD PRESENT. ABSENT: NONE. This being the time dat for conaid+sration of objections to the Assessment Roll of Local Street improvement District No. 8, the Clerk presented to the Council Affidavit of Publioation of the Notice of Filinf of Assessment Roll of Local Street Improvement District No. 8, which affidavit was and is in words and figures as follows, to -wit: STATE OF IDAHO ) ) as. County of Canyon ) council: Emile A' Shorb being duly sworn, deposes and says that he is foreman of the CALDWELL PUBLISHING COMPANY, publisher of The Caldwell News - Tribune, a semi - weekly newspaper published at Caldwell, Idaho; that the said paper is in general circulation in the County. and has been for a period of 78 weeks preceeding first publication of this advertisement, a copy of which is attached hereto, and was pub- lished in the regular edition of said Caldwell News- Tribune, three consecutive weeks beginning with the issue of November 1, 1928, and ending with the issue of November lb, 1928. Whereupon the following Order was made and entered by unanimous action of the ORDER NO. 1. " AN ORMH APPROVING AND CONFIRMING THE ASSESSMENT ROLL OF LOCAL STREET IMPRO- VHUENT DISTRICT 170. 8 ". "It appearing to the Council that the Assessment Roll of Local Street Improve- ment District 110. 8, of the City of Caldwell, Idaho, has been certified by the Committee on Streets of the City of Caldwell, snd was filed in the office of the City Clerk of the City of Caldwell, State of Idaho, on the 29th day of October, 1928, and is now on file in said office; and "IT APPEARING that the 19th day of November, 1928,at 8:00 o'clock P. M., in the City Hall of said city, was fixed by the Council as the time and place for hearing and considering objections to said Assessment Roll; and "IT FURTHER APPEARING, that the time for filing protests having expired, and the 1 for hearing and considering the some having arrived, and said Assessment Roll having been and fully and duly considered by the " and Council of the City of Ualdwell, /having been found legal, valid, correct, fair and just and in compliance with the laws of the State of Idaho, and the ordinance of the City of Caldwell, in all particulars; now, it is hereby, "ORDERED, by the Mayor and Council of the City of Caldwell, Idaho: "Section 1. That the Assessment Roll of Local Street Improvement District No. 8, in the City of Caldwell, Counby of Canyon, State of Idaho, be, and the came is hereby approved and confirmed. "Sea. 2. That the said Assessment Roll be placed in the hands of the City Treas. urer, for collection, and that due and legal notice of the time, place, and manner of making cash payments of the Assessments contained in said Assessment Roll, be given in the manner provided by the laws of the State of Idaho, and the Ordinances of the City of Caldwell." III I I 11 E A N" This being the time set for consideration of objections to the Assessment Roll of Local Improvement District No. 7 of the City of Caldwell, Idaho, for Oiling Streets; the Ulerk presented to the Council, Affidavit of Publication of the Notice of Filing of Assessment Roll of Local Improvement District ,do. 7 of the City of Caldwell, Idaho for Oiling Streets, which affidavit was and is in words and figures as follows, to -wit: AFFIDAVIT OF PUBLICATION STATE OF IDAHO ) ) Be County of Canyon ) Emile A. 8horb being duly sworn, deposes and says that he is foreman of Caldwell Publishing company, publisher of the Caldwell News- Tribune, a semi- weekly newspaper published at Caldwell, Idaho; that the said paper is in general circulation in the County aforesaid, and has been for a period of 78 weeks preeeding•flrst publication of this advertisement, a copy of which is attached hereto, and was published it the regular edition of said Caldwell News - Tribune one consecutive week beginning with the issue of November 8, 1928. There being no objections filed with the Clerk, the following Resolution by 200onnel was presented to the Council: RESOLUTION N0. 2f BY MOCONNEL, ENTITLED, " A RESOLUTION CONFIRUING AND APPRO- 7ING THE ASSESSLENT ROLL OF 'LOCAL I11PROVIIdENT DISTRICT ITO. 7 OF THE CITY OF CALDWELL, IDAHO, FOR OILING STREETS' ". "L'lHEREAS, The Assessment Roll of 'Local Improvement District No. 7 of the City Of 0sldwell, Idaho , For Oiling Streets' was filed bu order pf the City Council of Cald- well, Idaho, persuant to Resolution No. 27, and "WHEREAS. Time for hearing objections to said Assessment Roll was filed by the Council as the 19th day of November, 1928, at eight o'clock P. M. in the Council Chambers of the City Hall in said City of Caldwell, Idaho, and "IMREAS, Due notice of such time and place was given by the City Clerk of the City of Caldwell, Idaho, sa required by law, and "WHEREAS, Upon the hearing of said matter it appeared that no objedtions to said Assessment Roll have been filed, "NOW, THEREFORE, BE IT RESOLVED By the Mayor and Council of the City of Cald_ well, Idaho: "Section 1. That the hearing of objections to said Assessment ?toll having came on regularly for hearing perauant to the order of the Council of the City of Caldwell, Idaho, and persuent to due notice thereof, made and given in all respects according to law and no objections having been filed by any person whatsoever, said Assessment Roll is hereby confirmed and approved in all respects as filed and now of record in the office of the City Clerk of the City of Caldwell, Idaho ". On motion made by McConnel, seconded by Mumford, that Resolution No. 2p be approved. On the question as put by the Mayor, "Shall Resolution No. 2V Pass"? The Mayor directed the Clerk to call the roll with the following result: AYES: DAVIS, DUT -DU, HOFI AN, JACKSON, MCCONAEL AND 11UMFORD. NAYES: NONE. Whereupon the Mayor declared the motion carried and Resolution No. 21, approved. The Mayor and Clerk signed and approved same. R. S. Madden appeared before the Council asking for permission to erect a Filling Station on the Corner of Cleveland Boulevard and Kimball Avenue by the Texaco Oil Company. It was voted on motion of Hoffman, seconded by Davis, that the matter be taken under consideration until the next meeting. J. B. Gowen, Amos J. YSiller, Frank Roberts and Mr. Ritchie appeared before the Council in the interest of development of the Nunicipel Airport. It was voted on motion of Hoffman, seconded by McConnel, that the City Attorney be instructed to draft an ordinsnce regulating and controlling the Municipal Airport; providing for the appointment of two members of the Council and two citizens together with the Mayor. The Mayor to act as chairman of the board or commission. It was voted on motion of Jackson, seconded by Mumford, that - Council adjourn. I APPROUD: a r t. AAYO�R. i I i
