COUNCIL MEETING
November 16, 1982
7:30 p.m.
The Meeting was called to order by Mayor McCluskey.
The Mayor requested that everyone stand and give the Pledge of
Allegiance to the Flag.
The Roll of the City Council was called with the following members
present: Raymond, L. Carter, J. Carter, Mallea, Betts, and Cowles.
Absent: none.
(APPROVAL OF MINUTES)
It was MOVED by Cowles, SECONDED by 'L. Carter to dispense with the
reading of the minutes of the Regular City Council Meeting of
November 2, 1982, and the Regular City Council Meeting of November
9, 1982, and approve them as written.
MOTION CARRIED
(AUDIENCE PARTICIPATION)
The Mayor asked if there was anyone from the audience who cared to
bring anything before the City Council that was not on the
prepared Agenda. Since there was no one, the Mayor declared that
the meeting would continue as outlined.
OLD BUSINESS
(AWARD BID FOR FIRE DEPARTMENT VEHICLE)
The Mayor stated that the first item on the Agenda under Old
Business was to award the bid for the pickup for the Fire
Department. The Mayor called on Councilwoman Mallea to report on
behalf of the Bid Committee.
Councilwoman Mallea reported that the Committee reviewed the bids
and on the recommendation of the Fire Department and the Committee,
the lowest bid that met all specifications was Lanny Berg for a
1983 1/2 ton pickup in the amount of $8,928.51.
MOVED by Mallea, SECONDED by L. Carter that the bid of Lanny Berg
for a 1983 1/2 ton pickup in the amount of $8,928.52 be accepted.

(AWARD BIDS FOR PARKS AND RECREATION VEHICLES)
Councilwoman Mallea reported that the Bid Committee went over these
bids along with the Parks and Recreation Department and the low bid
which met the specifications was a Mazda mini truck from Tom Scott
in the amount of $5,288.00; and the low bid which met
specifications for the economy wagon was Twin Cities Toyota in the
amount of $6,333.25.
It was then MOVED by Mallea, SECONDED by Cowles that these two low
bids from Tom Scott and Twin Cities Toyota for the mini truck and
the economy wagon be accepted.

NEW BUSINESS
(BID OPENING FOR SURVEY VAN FOR ENGINEERING DEPARTMENT, PICKUP FOR WATER
DEPARTMENT, AND LOADER FOR STREET DEPARTMENT)

The Mayor stated that the first item under New Business was bid
openings for three vehicles; a survey van for the Engineering
Department, a pickup for the Water Department, and loader for the
Street Department. He then called on the City Engineer, Ron
Redmond, to open the bids. They were as follows:

The Mayor stated that he would turn the bids over to the Bid
Committee and they would bring their recommendation back to the
City Council at the next meeting. He thanked all of those who
submitted bids and their interest in the City of Caldwell.
(DISCUSSION ON INDUSTRIAL REVENUE BONDS)
The Mayor informed the City Council that he put copies of the
Ordinance passed by the City of Boise regarding Industrial Revenue
Bond in their boxes and would ask them to take a good look at it.
The Council was requested by the Chamber of Commerce to take action
on this as soon as possible. This would be discussed at the next
meeting and the Mayor would hope to have some suggestions.
(RESOLUTION NO. 57 -82 - CARL AND LILA WILCH)
The Mayor stated that the next item on the Agenda was a Resolution
for a Rehab Loan for Carl and Lila Wilch. Councilman J. Carter
read the Resolution by title only as follows:
RESOLUTION APPROVING A HOUSING REHABILITATION FOR CARL AND
LILA WILCH AND PROVIDING AN EFFECTIVE DATE
It was then MOVED by J. Carter, SECONDED by L. Carter that
Resolution No. 57 -82 be passed authorizing the Rehab Loan for Carl
and Lila wilch.
Roll call vote. Those voting yes: J. Carter, Mallea, Betts,
Cowles, Raymond, and L. Carter. Those voting no: none. Absent
and not voting: none.

(COMMITTEE REPORTS)
Councilman L. Carter reported that he attended a Senior Citizen's
Meeting last Tuesday and they are finally getting their kitchen
straightened out which has been a long, drawn out affair. They
will be having a Christmas Bazaar on December 15th at the Center.
Councilman Carter also reported that the Centennial Calendars were
going fast and they found it necessary to order another two
thousand.
Councilman Cowles informed the City Council that he would be out of
town on vacation from November 22nd through December 2nd.
(FINANCIAL REPORT)
Councilman Betts reported that the Finance Committee did go over
all of the Requests for Payment. The total expenditure for last
month was $587,171.98; the payroll was in the amount of $198,028.32
of which $41,497.88 was fringe benefits and the regular accounts
payable was $380,143.00.
It was then MOVED by Betts, SECONDED by J. Carter that the checks
be issued and the Requests for Payment filed in the Office of the
City Clerk.

(TELEPHONE PROPOSAL)
Councilman Betts stated that the City Council or the Mayor turned
over to him a telephone proposal for a Watts Line for the City of
Caldwell. A presentation was made by a representative from
Mountain Bell and Councilman Betts said that at that point he
wanted to compare with some figures that he had from a previous
study done for his office. Two things have happened; number one

was that when he did his study, the Watts line both inter and intra
State was only allowing ten hours of usage a month until it went
into another rate which was considerably higher than to direct dial
long distance. If you went over the ten hours by very much, you
were much further ahead not to have the Watts line at all.
Mountain Bell changed and have extended the ten hours to fifteen
hours now and reduced the rate too. Basically, the proposal given
to the City and the comparison given was correct and it looks like
with the two lines and after the initial installation cost, the
City would realize a fifty percent reduction on long distance
charges.
Councilman Betts went over the cost's for the benefit of the City
Council and explained how and where the phones would be installed.
It was Councilman Betts' recommendation that the City install an
inter and intra Watts line only on long distance calls.
The City Council discussed this recommendation at some -length. It
was - then MOVED by Raymond, SECONDED by Cowles that the City of
Caldwell install the Watts line as recommended by Councilman
Betts.

(PROPOSAL FOR NEW GOLF FEES FOR 1983)
Councilman Betts informed the City Council that last Friday the
Golf Board of Control met and he attended along with Councilman L.
Carter. The courses did do very well in their golf receipts this
year. The major item at the meeting was to establish - the rates for
the next year and was very difficult for them to do as they were
not only talking about their friends and neighbors, but themselves
as well. The Board increased rates and they eliminated categories
as far as Season Tickets were concerned. The proposed 1983 fees
for golf were as follows:

Councilman Betts further said that the categories eliminated were
the Senior Citizen rates for ,people over 75 yrs. both the single
and man and wife; the family ticket for families of three or four
and the College of Idaho student non- resident. It took a lot of
courage and intelligence for them to approve the rates as they did.
This increase for this year will be put into a dedicated fund for
Capita]_ Improvement and equipment and they would like to have a
percentage put into this fund from now on. There has not been any
monies put aside for replacement of equipment or a new clubhouse
that has been needed for some time. Councilman Betts stated that
he would like to commend them for taking this positive step.
It was then MOVED by Betts that the City Council accept - the Golf
Board of Control's .recommendations for golf fees for 1983 season
which runs from January 1„ 1983, through December 31, 1983.

Councilman L. Carter SECONDED the motion, but stated he would like
to offer an amendment to the motion. Councilman Carter informed
the Council that towards the last of the lengthy Board meeting, he
felt that they rushed through too fast. The Seniors, 75 yrs and
over and Seniors, man and wife 75 and over, was eliminated and put
them in the 65 yrs and over category which actually raises their
tickets from $105.00 to $200.00 for a single and man and wife from
$150.00 to $275.00. Councilman L. Carter stated that he felt the
Board didn't take this into consideration and he would like to
refer this one particular category back to the Board. It was
Councilman L. Carter's suggestion that the motion also include that
the rates be approved subject to this one category being referred
to the Golf Board of Control. - to take whatever action they would
feel necessary. Councilman L. Carter further said he did not mean
for the Council to take action, but rather that it be sent back to
the Board for reconsideration.
The Council discussed this item at some length with several of the
Council expressing concern that the recommendation came from the
Board. Councilman Raymond stated that he felt the Council should
approve the rates and then the Board could bring this portion back
if desired with a recommended amendment to the approved rates.
Councilman Betts stated that the Council could approve the rates as
presented now and then the City Council members of the Golf Board
could take this recommendation as presented by Councilman L. Carter
back to the Board for consideration and then bring it back to the
Council. It was also suggested that if those in this particular
category do come in to buy their season tickets that they be told
to wait as there may be a change. Councilman L. Carter then stated
that he would second the motion and after a vote would propose
another motion.
The Mayor then asked for a vote on the motion as made.
MOTION CARRIED
Councilman L. Carter then MOVED, and it was SECONDED by Betts that
the rates for Senior Citizens 75 yrs. and over be referred back to
the Golf Board of Control for their :reconsideration.
Councilman Betts stated that the only problem he had with this
motion was that by doing this the Council was sending back a
recommendation made by the Board and it would seem to the Board
that this request was the feeling of: the entire Council. It was
still Councilman Betts' recommendation that the two Council members
assigned to the Golf Board take this request back to the Board and
ask them if they would like to make a change in this category.
Councilman L. Carter then stated that he would withdraw his motion
with the consent of the second and make another motion. Councilman
Betts agreed to withdraw his motion. and it was then MOVED by L.
Carter, SECONDED by Mallea that Councilman Betts and Councilman L.
Carter take this proposed amendment with regard to the 75 yrs. and
over golf fees back to the Golf Board of Control for discussion.
MOTION CARRIED
Councilman Betts also commented that he would like to hear a report
from Sue Gilroy with regard to the Hoedown.
-- (CONTINUATION OF COMMITTEE REPORTS)
Councilman Raymond reminded the City Council of the Firemen's Ball
which was this coming Friday night at the Elks Club.
Councilman Raymond also said that 'he would like to discuss the
Christmas Tree that was always put up in the downtown area.
Several citizens have suggested that the City change the location
of the tree this year. If it was in an area close to the downtown
area such as a large parking lot, there could possibly be caroling
and other activities around the tree. The Mayor agreed that this

was a good suggestion and informed the City Council that he had
already received a tree from Harry harper_. It was agreed that some
thought would be given to this suggestion.
Sue Gilroy was then recognized and gave a report with regard to the
Hoedown - that was sponsored by the Library.
(MAYOR'S COMMENTS)
The Mayor informed the City Council that he placed in their boxes
information on Sexual Harassment which was prepared for the
employees of the City of Pocatello. It was mandated that this be
included in the City Policy and he would as] the Council members to
give it some study.
The Mayor also stated that he had a- call from Mr. Harris, the new
Prosecuting Attorney, and the Mayor said he would like to have the -
City Council give consideration to hiring Mr. Harris at this time
and having him work with Dennis Goff. If it was decided to
continue with Mr. Harris, who was very interested, between January
and the lst of March and then they could take a look at it again
the 1st of March when the law was changed. The Mayor further said
that this was just mentioned for Council's consideration and
information.
The Mayor further said that there was to be a Parade in Boise on
the 27th and he was not able to attend. Councilman Cowles stated
that he would attend.
The Mayor then read a letter addressed to whom it may concern from
Gene R. and Phyllis Baxter as follows:
In a desire to increase the property base in Caldwell, we are
building two patio homes. In order to obtain the first
mortgage it is necessary that the City of Caldwell Local
Improvement District 081 subordinate their position to the
financial institution. Gene and Phyllis Baxter agree to be
responsible to insure the payment of the L.I.D. #81 on Block 2
lots 1 and 2 of the De La Cherie subdivision. We also agree
to reimburse the City of Caldwell any legal cost to make this
possible. We respectively request that this be granted.

The City Engineer, Ron Redmond, addressed this item and stated that
he had talked with Mr. Baxter. Mr. Baxter intended to construct
townhouses on these 2 lots and the bank that he is going through
apparently has an inhouse policy that won't let the bank hold a
second on any kind of a loan. With the City holding first mortgage
due to the L.I.D., the bank won't =Loan the money for construction
without having a first mortgage. Mr. Baxter is requesting that - the
City change their first mortgage and the City take a second. Mr.
Redmond said that he did not think it was possible to do this, but
did calf_ the City Attorney with regard to the possibility. Mr.
Smyser suggested that Mr. Baxter write this letter and Mr. Smyser
also indicated that it was probably legally possible to do it as
long as the City was satisfactorily covered from a monetary
standpoint. However, this could be setting a . precedent which may
not be the wishes of the Council.
The City Council discussed - this at some length and it was then
MOVED by Mallea, SECONDED by Raymond that the City Council approve
this request subject to agreement by the City Attorney and the City
Engineer.

The Mayor said that he would like to have a volunteer from the City
Council to attend a dinner on the 30th of November at 7 :00 p.m.
which was a Legislative Committee Meeting at the Nazarene Church.
