No. 45 adopted.

It was voted on motion of Dutton, seconded by IUmford, that the bid of H.C.Durham fol 22 ots.

The City Clerk presented the form of contract with "elvert, ''elvert, and jchroeder, for the
construction of curbs and gutters in Local Street Imppovement District No. 5. The Council proceeded
to a consideration of the form of said contract. Thereupon Councilmen McOOnnel presented a follow
ing resolution and moved its adoption:
RESOLUTION NO. 46, BY MCCONNEL.
" A RESOLUTION AUTHORIZING AND DI THE MAYOR AND CITY CLERK OF THE CITY OF CALDI ELL, IDAHO
TO ENTER INTO A CONTRACT WITH CALVERT, CALVERT, AND SCHROEDER, TO CONSTRUCT CURBS AND GUT ERS IN
LOCAL STREET IMBROVEMENT DISTRICT NO.5, OF THE CITY OF CALDVMLL, IDAHO, AND APFRDVING THE BOND
FIXED BY SAID CALVERT, CALVERT, AND SCHROEDER, IN CO ARCTION t ITH SAID CONTRACT.
WHEREAS, at a duly convened meeting of the Council of the City oP Caldwell, held Pn the
fourth day of November, 1926, the bid of Calvert, `elvert, and Schroeder, was accepted f0 the
construction of curbs and gutters in all those streets described in Local Street Ipprovem nt
District No.S, in said City, in the manner provided for by Ordinance No. 428; and there 1 i now
before the Mayor and Council of: °said City, a form of emntract with Calvert, Calvert, and
Schroeder, which provided for the construction of said curbs and gutters in said improves nt
district, and,
WHEREAS, Such form of contract has received the careful. consideration of this body, and it
is beleived that it is for the best intteest of this municipality that such contract be a eouted
forthwith; and,
WHEREAS, the said Oalvert, balvert, and Schroeder have signed a bond, executed by Fid lity
and Deposit Company of Maryland, in the penal sum of 051, 539.82, conditioned for the fa thful
performance of said work, as provided by said contract, and it appearing that said bond Le in
proper form and sufficient to protect the City as contemplated by said contract; now, the refcre,
BE IT RESOLVEB. by the Mayor and Council of the City of Caldwell, Idaho.
Section 1. The bLeyor aFA of the City of Caldwell, Idaho. is hereby authrrized and directed in
his official capacity, to execute the contract above described, with Oalvert, 8alvert, a
Schroeder, and the Clerk of said City is authorized amd directed to affix the corpoarte Wal

of this m icipality to said contract, and when said contract has thus been executed and has also
been properly executed by Calvert, "alvert, and Schroeder, the Clerk of said city is hereby
dieeated to file said contract as a part of the records of his offices
Section 2. The Bond signed by Calvert, "alvert, and Schroeder, as n riboipal, and Fidelity

and Deposit Company of Maryland as surety in the penal aum of 51,539.82, conditioned for the
faithful I arformance of said eontr:.ct, and filed in accordance therewith, be and the same Is
hereby aplrovea.
The notion for the adoption of this Resolution was duly seconded by Kimbrough. The question
being "SHALL THE RESOLUTION PAS07 The ""ayor directed the Clerk to call the roll which resulted
as follows:
AYES: CO Y, DU:TON, KIMBROUGH, MU:IFORD, MCCONNEL, AND WHEIMER.
NAYES AND BSENT: NONE. Whereripon the Mayor deoalred the motion carried and Resolution No. 46
adopted, des directed the Clerk to record the same upon the journal of the proceedings of the
Council is.s. part of the minutes of this meeting; thereupon the Mayor in open session of the
Council Mily signed and approved said a esolution.
