The Mayor informed the Council the meeting was called to take up the petition of J. P. Garber and
v
Ralph Garber for a special building permit to construct a grocery store in Class "A" Residence Zone.
This matter had been previously considered by the Board of Adjustment. H. D. Hanna and others
had questioned the proceedings of the Board of Adjustment.
Information presented to the meeting disclosed that the petition failed to contain the signatures
of 75% of the owners of the area within 300 feet of the proposed store building. Upon this finding Lawrence
N. Smith, Attorney at Law representing J. P. Garber and Ralph Garber statn that they would not make further
request for the special permit until they could comply with the ordinance requirements.
There being no further business to come before the Council, it was moved by Councilsm Mason,
 I
seconded by Councilman Burrell, that Council adjourn. Motion carried.
