The regular monthly meeting of the City Council met in the Council Chambers of the City Hall with
Mayor Charles W. Carpenter presiding.
Upon Roll Call, the following Councilmen answered presentt Alfred H. McCloskey, Charles C. Banks,
Joe Gamboa, James R. Dakan and Lester E. Carter. Abseatt None.
Sanitation and Beautification Commission Recommendations - Lonnie Spath
Mayor Carpenter acknowledged Lonnie Spath, Chairman of the Sanitation and Beautification Commissio
who made the following recommendations:
1. That the City repair the sidewalks in the Caldwell Park which have been broken by
tree roots.
2. That the Council recommend to the Recreation Department that the stands at the old
softball diamond either be repaired or replaced.
in response to Councilman McCloskey, Mr. Spath stated that the Sanitation and Beautification Com-
mission would Meant the budget that would be turned into the State; and if the Council would not approve
the recommendation of repairing or replacing the stands, this could be added to their requested amount from
the State. Mayor Carpenter commented that he had received from Mr. Weber the proposed cost of redoing the
stands, both at Luby Park and the City Park along with suggested designs for public address system booths,
concession booths and restrooms.
The Mayor stated that the City was considering changing and redoing South Kimball Avenue to complel
the work that had been done up to Arlington Avenue a few years ago, adding that it was planned to construct
the sidewalks beside the curb to eliminate the problem of tree root growth in the future.
Councilman Banks said that there was a section of bleachers at the swimming pool which world not
be incorporated in the new plane, and they possibly could be moved to the softball park.
In response to Councilman McCloskey, George Dufur abated that if something wasn't done, the stands
at the park would have to be condemned as they were beyond repair.
Mayor Carpenter informed Mr. Spath that he should present his proposed budget as soon as it was
prepared.
Councilman Carter stated that he and Councilman Hanks were meeting with the Park Supervisor the
coming week, and they would go over these things with him at that time.
Honor Award Certificate - Glen Hollis
Mayor Carpenter acknowledged Mr. Glen Hollis who introduced City employees, Joe Franklin Jerry
Harness and Floyd Tracy, adding that one of his men, Bill Bremer, was usable to attend. Mayor Carpenter
then read the following letter addressed to the Treatment Plants

The Mayor then presented the Certificate of Award to Mr. Hollis and extended the congratulations
of the Mayor and Coanoil. _
Approval of Final Plat - Spruce Addition
Mayor carpenter recognised Mr. John Hove who presented the Final Plat of Spruce Addition for the
Coamil.'s consideration. Mayor Carpenter stated that the preliminary of the plat had been approved at a
prior Council meeting, and if approved, would necessitate the vacating of Cedar Street.
It was moved by Councilman Gamboa, seconded by Councilman Banka, to approve the Final Plat of Spra
Addition. Upon vote, the motion carried.
Retail Merchants Association Request approved
Mayor Carpenter elated that there ware several mambare of the Retail Merchants Association in the
audience, and then read the following letter from Mr. Gale Bums, Prudent of said Association:

The Retail Merchants again this year request permission to cover the parking meters for use
by downtown choppers daring the period from Friday, November 24th through December 31st.
Proper publicity and public relations will be followed by the Retail Nerohaints Association.
Also, permission is requested to erect a large tree in the middle of Kimball Street between
Kiug's and Moore Ia Stationery - similar to what we had last year.
A letter granting this permission to Chief Aslteford and the Retail Merchants will be greatly
appreciated.

Mr. Earl Lovan commented that the covering of the parking maters had worked out very well the year
before, and this year the merchants would have their employeas sign a pledge stating that they would not parl
on the streete.
It was moved by Councilman Mocluskey, seconded by Councilman Carter, to support the merchants in
their project and approve their request. Upon vote, the motion carried.
Request for variance - John Bishop
Mayor Carpenter acknowledged Mr. John Bishop who requested a variance for a house he had been con-
tracted to build in Block 1 of Mountain View Subdivision. Mr. Bishop stated that when the owner had purchase
the lot he had assumed there was a five foot easement, but later found out that the easement was for 10 feet
Mr. Bishop, therefore, requested a variance for a save. foot easement. 0.11. 11. Gambol ...td that if
the easement was dedicated to the utility companies, the Council would not have the authority to grant the
variance.
It was moved by Councilman Mccluskey, seconded by Councilman Carter, to leave the determination of
the easement factors to the Building Department and Councilman Gambol for presentation at the next Council
meeting.
Bill No. 43 - Ordinance No. 1281
Mayor Carpenter then announced that this was the time set for hearing amy objections to the vacatic
of the alley located in Block 82 of Mountain View Addition as described in Ordinance No. 1280 and inquired
if anyone was present for this purpose. No objections were offered and no written objections had been filed
with the Clerk.

which was read for the first time and the Council proceeded to consideration of Bill No. 43. It was moved
by Councilman McCloskey, seconded by Councilman Carter, that the rules requiring the reading of a Bill on
three separate days be suspended and that Bill No. 43 be read the second time by title and the third time in
full, section by section. The Mayor then directed the G7erk to call the roll on the above motion, which
resulted as follows: Those voting in the affirmative: McCluseey, Banks, Gamboa, Dakan and Carter. Negati
votes: None. Absent and not voting: None. The Mayor declared the motion had passed by the necessary owe

The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance No. 1261 to
_ be published in the News- Tribane, the official newspaper of the City of Caldwell, as required by law.
Councilman Vacancy
IIpon question from Councilman Carter, Mayor Carpenter stated that he was considering another name
to submit to fill the vacancy on the Council, and this would be done in the next few seeks.
Legal opinion on sewer construction charge - Wayne Davis
Wayne Davis stated that after doing research, his position on the proposed ordinance setting sewer
construction charges had not been changed, and as stated in the previous meeting, he was in disagreement wit
Mr. Schiller who had appeared at that time before the Council in behalf of the Snake River Builders. He
added that he would welcome any suggestions from the builders. He then read the following from the Idaho
I Code:
The power to regulate and control Bawer and drains carried with it as a necessary incident
authority to compel, regulate and control all indispensable, desirable or convenient con-
nections, subject of course, to the observance of private property rights.
Mr. Davie stated that there was no question but that the municipalities had the power to require
that people connect to the sewer if the public health demanded it. He added that he thought the Council had
the power to pass this ordinance, pointing out that most cities in Idaho had much the same type of ordinance
Mr. kiwis stated that one draw back to the ordinance might be that payment was required for sewer
service which might not be available at the time of payment, but the wording of the ordinance could be chazigi
to correct this.
Mr. Davis stated that it had been pointed out by Mr. Schiller that this ordinance sold be in can -
aitutional violation of the law; but he could not find this so and read the following from the Idaho Code:
A municipality may fix fee a, rents, charges and rates for making connections with and for
use of sewers and drains outside the municipal limits as wall as within, and may by law
have a lien upon the property therefore. Sever charges are usually established by ordi-
naneee the validity of which is presumed. Sewer charges and fees are not time or special
aeseemsente, but are in the nature of tolls or rents paid for services furnished or avail-
able.
mr. Davis stated that he had talked to Richard Rosenberry who also represented some of the builder ,
and that Mr. Rosenberry had said that he did not concur with Mr. Schiller. Mr. Davis informed the Council
that Mr. Rosenberry had sent him a copy of Boise's ordinance, and if anyone on the Council would like a copy
N would furnish one to them.
Mr. Davis stated that there was no question in his mind but that the Council had the power as this
would not be an assessment, but rather a charge for services.
After a brief discussion, it was decided to have a meeting to finalize the proposed ordinance befo
the next Council meeting, and if any builders wished to come, their suggestions would be welcomed.
Bids for Malti -Plate Arch
Mayor Carpenter than asked Mr. Iawia to present the bids for the corrugated metal pipe mniti -plate
arch to be erected on Linden and Indian Creek at the end of Chicago Street. Mr. Lewis explained that this
was to be done jointly with the County, and they would be invoiced for their half, and the City for theirs!

3.972 summer recreation program report - Charles Alvaro
The Mayor then read the following summer recreational program for 1972 from Charles Alvaro, Be
tional. Director:
The participation in our summer recreational program for 1972 was outstanding. In almost all
areas, the participation was up from last year. The one thing that was real noticeable this
year in comparison to other years was the continued participation throughout the entire summer
program. In years past, this has not been the case.
In some areas we had butstanding instruction while in others the instruction was no so good.
When the instruction was poor usually the participation was down. I know that this is not
always the case but in most instances this will hold true.
little league baseball again is our biggest area of participation. This summer we had thirty -
three sponsored little leaps teams, ranging in ages from six years old to seventeen years old.
All told we had about four hundred and seventy -five people taking part in this one area of our
program.

Continued participation in our Arts and Crafts and lancing and Dramatics classes was outstand-
ing especially in the latter two areas. Instructors with backgrounds in these two areas are
most important to ]seep the interest of the participants through the entire program. This has
not bean the case over the last two or three years. This area of the program attracted between
fifty and a hundred children per day.
Our library reading program under the direction of Uley Uyematea has had tremendous partici-
pation over the last two years. over four hundred youngsters took part in this years program.
Cur Wednesday mo rning story hour in the city perk is beginning to catch on.
Over two hundred youngsters between the ages nine through sixteen took part in our bowling
program held at Caldwell Bowl and Talbot Lanes. This year for the first time, a ten cent fee
was charged at Talbot Lanes and this didn't make any difference in the number of participants
at Talbot Lanes. The proprietors at both of these places furnish everything free of coot to
all people earol.led in our program. A deep appreciation goes out to these two fine alleys for
making this all possible.
This year our golf program was moved from Fairview to Purple Sage Golf Coursep To my surprise,
we had about the same if not more people taking part. The reason the program was moved out to
the Sage waa because the Sage bad more or better facilities to accommodate the learning situa-
tion. About fifty -five youngsters took part in this phase of the program.
In tennis, certain age groups attracted a large turn out. Ages ten and under started out with
a tremendous turn out but then it fell off sharply. Our other age groups didn't get the numbers
that we had anticipated. Certain things will have to be changed to make our tennis program
grow.
I think we have a tremendous program. Our city is growing and we're getting more youngsters
into the program. But I also think we are not reaching all of the youngsters that we could
reach. Maybe a survey should be taken in the near future to see what other activities that
are not offered now that maybe we should have. This is something that I think we should
think about now.

It was moved by Councilman Risks, seconded by Councilman Gamboa, to approve the appointment of
Warren Strong as winter program coordinator. Upon vote, the action carried.
Easement from Robuck, Schmidt, Ram, Truesdell & Spear Cattle Co., Inc. approved
Mr. Lewis presented sewer easements from R. M. and Ona M. Robuok, Gus and Nettie Schmidt, Charles
and Ardes R. Barn, W. H. Jr. and Mary F. Truesdell and Spear Cattle Co., Inc. Be explained that these were
serer easements which the city had requested when the ordinance had been passed to vacate the alley in Block
82 of the Mountain View Subdivision.
It was moved by Councilman McCluskey, seconded by Councilman Carter, to accept the easements and
have them recorded. Upon vote, the motion carried.
Highway right- of-way from Cooper & Lasher Construction Co. approved
Mr. Lewis then presented right-of- deeds from Lacher Construction Co. and Lisburn and Irene
Cooper and explained that one was for Cedar Street and the other for Wisconsin Avenue for a block between
Cedar and Spruce and for an additional five feet on Spruce.
It via moved by Councilman Banks, seconded by Councilman McClusksy, to accept these highway right-
of-way deeds and have then recorded. Upon vote, the motion carried.
Bond for Spruce Addition set
Mr. Lewis stated that it would be necessary to set the crown of bond which Mr. Lasher would have
to provide in connection with Spruce Addition. He added that it would probably involve curb, getter and
sidewalks if they were desired. He stated that the sewer was already in, and though underground wires were
required, in this instance these were already serially provided so probably would remain that way. He added
that the bond may or may not include the paving.
After a discussion on the merits of sidewalks, Councilman McCluskey stated that he felt the Counet
should abide with the subdivision ordinance and require that they be put in. It was the concurrence of the
Council that Mr. Lasher be required to post bond for the curbs, gutters and sidewalks, and that he would pro
mote the creation of an L.I.D. to pave the streets.
Equipment for uniform accounting
Mayor Carpenter referred to the copies of a letter from Tory Messuri, Auditor for the City, and
recommendations from John L. Englehart which had been provided for the Councilmen for their personal perusal
in regard to the new equipment necessary for the new Uniform Accounting System.
It was moved by Councilman NeOluskey, seconded by Councilman Banks, to authorize Mr. Englehart to
prepare specifications for the purpose of obta the necessary equipment. Upon vote, the motion carried.

Leave of Absence - LeRoy Dibbins, Ted Morrison, Volin Bollman
Mayor Carpenter stated that LeRoy Dibbins, Ted Morrison and Volin Bollman had requested a leave of
absence. He added that there men worked for the City during the summer montha, and in order to comply with
provisions under the Public Employee Retirement System, and, in as much as they would return to work in 1973
it was recommended that they be granted a leave of absence.
It was moved by Councilman Carter, seconded by Councilman MoCluakey, to grant a leave of absence t
LeRoy Dibbins, Ted Morrison and Volin Bollmaa. Upon vote, the motion carried.
Parks & Sons meeting report
Mayor Carpenter reported that he, George Dufur and Jim Vizzini had had a meeting with three repre-
sentatives of Parks and Sons. He stated that the trucks they had ordered for the City had not arrived yet;
that they had made some organizational changes which should help, and had hired another man which would re-
lieve Gary to work the problem areas in garbage pickup. Mayor Carpenter added that the latter would relieve
George and Jim, and that time would be alloted for them to review and check on the commercial accounts and
bring them up to order as per the agreement with Parks and Sons.
The Mayor stated that Mr. Parks said that they were interested in staying in Caldwell and would do
their utmost to provide the necessary service. He added that he had stressed the need for public relations
and what would be expected of Parks and Sons and also what part the City would play in keeping the program
going.
In response to Councilman Dakants comments about garbage pick up on holidays, Mr. Dafur stated
this should be brought out in the magotiations for the new contract and felt that it could be worked out.
Letter from Department of Housing and Urban Development
Mayor Carpenter then read the following letter from the Department of Housing and Urban Develop

Subject: Sewer Application
This office has completed its rating of projects eligible for assistance under the
Department of Housing and Urban Development's Water and Sewer Grant Program. Your
project has not been rated this funding period. in order for your project to receive
consideration, the City must be part of a certified planning organization which is
undertaking comprehensive water and sewer planning.
It is our understanding thatyour planning organization is presently undergoing the
certification process. In anticipation of a favorable decision on certification, we
will hold your application until our next rating and funding period in January 1973.
Should your organization become certified, this office will still require letters of
approval from the State and your certified regional clearinghouse.
It is suggested that the self - evaluation form be radon with a short paragraph justi-
fying the points given in each subject area. A copy of that rating is attached.

Mayor Carpenter informed the Council that the information was sent in to HUD about four or five
days prior to the application that the City sent in, but as yet nothing had been heard of any action on the
certification, and it was his intentionto check on this. The Mayor stated that he would redo the applicatio:
forms which HOD had sent.
Proposed Mobile Home Ordinance
Mayor Carpenter stated that he had copies of the mobile home ordinance of Twin Falls, Meridian and
Nampa, and because of their content had made only two. He then gave said copies to Councilman Gamboa and
Councilman Carter who he appointed to work on the proposed ordinance and give a report at the next meeting.
Damage Claim denied - Merl Wilcuts
The Mayor then read the following claim for car damage from Marl Wilcuts:
Accident happened on October 24, 1972 between 3 & 4 P.M. Weather clean and dry. I was
parked at Hirsh parking lot in first apace off the street on Hirsh aide. A city pick -up
was parked nearly opposite on City Hall side (Lic. No. 20805) I started to back away
and noticed the pick -up was backing too. I stopped thinking the pick -up would stop too
but he apparently did not see me and backed into the side of my car just behind the rear
wheel on the right side.
Estimate cost of repair by Bums Chevrolet - $ 45.65

It was moved by Councilman Banks, seconded by Councilman Gamboa, to deny the claim and refer it to
the City's Insurance Carrier. A vote was taken, and the motion carried.

It was moved by Councilman Banks, seconded by Councilman Gamboa, to deny the claims and refer them

Indemnity Agreement approved
The following Indemnity Agreement was next presented for consideration of the Council, indesniifyin
and saving harmless the City of Caldwell, its Mayor and Council against any and sll loss, damage, cost and

Transfer of Beer License approved
The application for the transfer of beer license to Edward A. Claycomb d/b /a *stern Bser & lunch
was presented to the Council for their consideration and the following letter from the Chief of Police was
read:

Lunch to him. Mr. KHIE has signed his license over to Mr. CLAYCOB.
Mr. Edward A. CLAYCOMB was licensed to do business at the Western Beer and Lunch in March
of 1970. I can find no reason why the transfer of these licenses to Mr. CLAYCCMB should
not be made at this time.

It was moved by Councilman Carter, seconded by Councilman Mocluskey, to approve the 4th Quarter

Applications for Bartender Permits approved
The application and receipt for the required fee for a Bartenders Permits from Dorothy Mohr was
presented for the Council's consideration.
It was moved by Councilman Banks, seconded by Councilman Dakan, to E:prove the application and issu
the permit. A vote was taken, and the motion carried.
E.D.A. Meeting
Mayor Carpenter then reminded the Council of the meeting with E.D.A. which was set up November 10
at 7:00 A.M. Councilman McCluskey stressed the importance of attending the meeting.
Ustick Road Interchange discussion
Mayor Carpenter stated that he had had a call from Dean Dishman who had suggested that the City
should put forth some effort to develop the interchange at Ustick Road for the benefit of the City of Caldwe
Attar a brief discussion, it was moved by Councilman McClpskey, seconded by Councilman Gamboa, tha•
the Council go on record in favor of the interchange at Ustick Road. Upon vote, the motion carried.
Linden Street Permanent paving
Councilman Banks then read the following letter from Mel Lewis:

Dear Chuck:
In line with the thinking that Linden Street should permanently be improved from Indiana
to Georgia if all of the curb and gutter is installed by the adjacent owners, I have
enlisted quotations on a plant mix from likight Construction and Idaho Concrete.
As I have outlined, the City would do the excavating and would place the gravel bass
courses, 3- inches of asphalt and would then be placed over the base courses to complete
the street.
I have received the quotations, and they are as follows:
Wright Construction Company $ 8.75 per ton
Idaho Concrete Pipe Compar:y $10.25 per ton
Approximately 1,000 tons will be required. Since this is an expenditure of approximately
$9,000.00, 1 would enlist the direction of the Street Committee on how to proceed.
All of the curb and gutter in the section of Linden is completed except that of the Elks.
Councilman Carter has given the go ahead in so far as the Elks are concerned, and they
intend to have A and J Construction put in the curb and as soon as the contractor is
available to do it.
In ta] with the plant mix suppliers, I understand that the asphalt for the mix would
be available until around the first of December. Hopefully, we can get the excavating
and the base courses in within the neat two weeks which would then leave another two
weeks in November to be selected in accordance with the weather to complete the paving.

1973 budget discussion
In response to Councilman damboa, Mayor Carpenter stated that about all budgetary materials that
were available at this time were information on special projects which had been acquired in meeting with the
department heads, and because of the work necessary in changing to the Uniform Accounting System, it would b
impossible to have the total budget by November 15.

Councilman McCloskey stated that he had all the recommendations from the departments, and he won
make copies for all Councilmen so this could be studied and the priority decisions made to facilitate the
setting up of the budget after all the financial data is obtained. John Englehart stated that he would no
direction from the Council as to the projects they would designate for expenditures in the 1973 appropriat:
of the Revenue Sharing money.
Opening of swimming pool bids
Mayor Carpenter announced that the opening of the bids for the switmdng pool had been set for
November 15 at 3:00 P.M.

Variance approved - Carl Krebs
Mayor Carpenter then called upon Carl Krebs representing Bob and Johns who stated that there was
an old house on the property which was used for security measures, and they wanted to remove the house and
