A RESOLUTION AUTHORIZING THE TERMINATION OF PR°_VIOTIS AIRPORT AGREEMENTS; WHEREAS, Heretofore a certain Agreement entitled "Airport Agreement" was made and entered into, dated August 23, 1943, between the City of Caldwell, Idaho, as party of the first part and Vack S, Johnston, party of the s econd part, leasing and granting to the party of thee econd part therein, certain rights and privileges in the Municipal Airper of the City of Caldwell, Idaho; and WHEREAS, Said a greement above mentioned wee a ssigned by the said Mack S. Johnsto to JaQk W.- Medlin and John Medlin, which said assignment was consented to in writing by the City of Caldwell, and WHEREAS, It is desired by all of the parties hereto that all of said agreements shall be terminated; NOW, THEREFORE,? E IT RESOLVED, That said agreements above mentioned, made and entered into August 23, 1943 be and the same hereby are by mutual consent with the parties thereto cancelled and that Thurlow Bryant, Mayor of the City of Caldwell be and he hereby Is authorized for and on behalf of the City of Caldwell, to execute an agreement with the said Aack S. Johnston, Jack 110 Medlin, and John Medlin, dated October 2 1944, cancelling and terminating said agreements above mentioned, made and entered into Autust 23, 1943, and that the City Clerk of the City of Caldwell is hereby authorized to attest said signature and affix the seal of the City of Caldwell thereto. Whereupon it was moved by Councilman, Fresher, seconded by Councilman Newman that said resolution be adopted. Motion unanimously carried. Thereupon the following EEsolution was presented to the Mayor and Council by Councilman Frashert RES OLTTT I ON By Fresher. A RESOLUTION ATTTRORI2iNG "AIRPORT AGREEMENT" BETWEEN THE CITY OF CAIDWELL, AS PARTY 'OF THE FIRST PART, AND MACK S. JOHNSON AND MERRITT COOK, OF CALDWELL, AS PARTIES OF THESECOND PART, TO BE DATED OCTOBER 1ST, 1944, RELATIVE TO CALDWF,LLL MITNTCIPAL AIRPORT: WHEREAS, The City of Caldwell desires to enter into an agreement to be known as "Airport Agreement" to be dated October let, 1944, between the City of Caldwell, Idaho, as party of the first part, and ' S. Johnston and Merritt Cook, as parties of the econd part, relative to the leasing by said parties of the second part of a certain portion of the Caldwell Municipal Airport according to the terms and conditions of that c ertain "Airport Agreement" dated October let, 1944, between the above mentioned parties and sub- mitted to the Mayor and Council of the City of Caldwell for arrrovel; NOW THEREFORE, Be it resolved by the Mayor and Council of the City, of Caldwell, that said "Airport Agreement" above mentioned be entered into between said parties and that Thurlow Bryant, Mayor of the City of Caldwell, be and he hereby As authorized by and on behalf of the C_ty of C be end he hereby is authorized by and on behalf of the City of Caldwell, to execute said agreement above mentioned, and that the City Clerk of the City of Caldwell ba,a nd he hereby is authorized to attest said signature and affix thes eal OC'tha City thereto. WHEREUPON It was moved by Councilman Fresher and seconded by Councilman Newman that said resolution be adopted. Motion unanimously carried. Thereupon the following Resolution was presented to the Mayor and Council by Councilman Newman: A RESOLUTION CANCELLING75% OFSPRTNKLTNG ASSESSMENTS OF THE CITY OF CATIA7 - LL ' LEVIED AND ASSESSED A^ -AINST LOTS 1 TO 12 BOTH INCLTTSIVE, OF BLOCK 15, ORIGINAL T07MRITE OF CALDIVELL, IDAHOK FOR THE YEARS 1927 TO 1930, BOTH INCLT'SIVE, UPON CONDITION THAT THE REMAINING 25,% OF SAID ASSESSP.IENTS BE PAID AND THAT ALL OTHER ASSE °SMENTS TOR THE YEARS 1931 AND SUBSEQUENT THERETO BE PAID IN FULL. WHEREAS, there appears to have been assessed by the City of Caldwell, Idaho, against the followingd ascribed property, to-wit- Lots 1 to 1Q both inclusive, in B lock 15 of the Original Townsite of the City of Oaldwell, Idaho, sprinkling assessments for the years 1927 to 1930 both inclusive; and WHEREAS, It appears that said property was sold to Canyon County on January 4th, 1930, and was thereafter sold by Canyon County to J.rrank Bales on April 9th, 1970; NOW, THRREFORE, BE IT RESOLVED by the Mayor and Council of the City of Caldwell, L Idaho, that 75% of said sprinkling assessments levied or assessed a gainst said premises for the years 1927 to 1930, Both inclusive, be and the same hereby are cancelled upon the £ollwoing conditions, to -wit: Provided howeger that said cancellation shall not b aroma effective unless or until the remaining 25% of scid assessments, which shall be a lien against said premises for the years 1927 to 1930, both inclusive, shall have been paid to the City of C Idaho, together with all n ssessments of the City of Caldwell, Idaho (together with penalty and interest thereon, if any) for the years 1931 and subsequent thereto shall have been paid in full; it being understood that this resolution does not contemplate the cancellation of any portion of said assessments due the City of Caldwell, against said premises for the yeara 1931 and subsequent thereto; and IT B EING FURTH'R'RESOLVED that when said assessments have been paid as herein provided the City Treasurer of the City of Caldwell, Idz o, shall be, and hereby is authorized and directed to c areal on the records -of the City of Caldwell that portion of said taxes as herein directed to be cancelled and to file with the Clerk of Canyon County, Idaho, a' certified copy of this resolution together with the certificate andcertification Of the City Treasurer of the City of Caldwell, that said a ssessments have been paid ar,ainst said premises in accordance with the provisions of this resolution; in which event the cancellation of that portion of said assessments as herein provided, shall thereupon become fully effective. And is is further directed that two copies of this resolution duly certified by the City Clerk of the City of Cejdwell,b a served upon the City Treasurer of the City of Caldwell. Whereupon it was moved by Councilman Newman and secondedly Councilman Frasher L I that said resolution be adopted. Motion unanimouslq carried. Thereupor the following R was presented to the Mayor and Council by Councilmen Newman: RES OLUT I'!N . BY NEWMAN. A RESOLUTION CANCELLING 75% OF SPRINPLING A °SESSMENTS OF THF, CITY OF C ALDWELL, IDAHO, LEVIED AND A SSESSEDA3AINST THAT PORTION OF FRACTIONAL BLOCK 106 OF STRAHORN AD- DITTO'T TO CALDWF.LL, IDAHO (NOW ASSESSED IN THE NAME OF H. M. MILLIKEN) 70R THE YEARS 1924 to 1937, BOTH INCLUSIVE, TTPON CONDITION THAT THE REMAINING 25% OF SAID ASSESSMENTS BE PAID AATD THAT ALL OTHER ASSESSMENTS FOR THE YEARS 1938 AND SUBSKURYT. THERETO BE PAID IN FULL. WHEREAS, there appears to have been assessed by the City of Caldwell, Idaho, against the follooing described property, to -wit: Fractional B1001C 106 of Strahorn Addition to Caldwell, Idaho, (now-assessed in the name of H. M. Mulliken), J C iS sprinkling assessments for the years 1924 to 1937, both inclusive, and, WHMAS, It appears that said property was sold to Canyon Cotmty and taken by tax d eed and was thereafter sold by Canyon County to H. M. Milliken on October 25, 1937; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Caldwell, Idaho, that 75% of said sprinkling assessments levied or assessed against said premises for the years 1924 to 1937, both inclusive, be and the same hereby are cancelled upon the following conditions, to -wit: Provided however that said cancellation shall not become effective tnless or ftntil the remaining 25% of said assessments, which shall b e a lien against said premises for the years 1924 to 1937, both inclusive, shall have been paid to the City of Caldwel, Idaho, and until all, assessments of the City of Caldwell, Idaho, (together with penalty and interest thereon, if any) for the years 1938 and sub- sequent thereto shall have b een paid in full; it being understood that this resolution does not contemplate the cancellation of any portion df said assessments due the City of Caldwell, a gainst said premises for the years 1938 and subsequent thereto; and i. IT BEING FURTHER RESCLVED that when said assessments have b een paid as herein provided the City Treasurer of the City of Caldwell, Idaho, shall be, and hereby is author. ized and directed to cancel on the records of the City of Caldwell that portion of said taxes as herein directed to be cancelled and to file with the Clerk of Canyon County, Idaho, a certified copy of this resolution together with the certificate and certification of the City Treasurer of the City of Caldwell, that said assessments have been paid against said premises in accordance with the provisions of this remt.ution; in which event the cancellation of that pdrtion of said assessments as herein provided, shall there• upon become fully effective. And It is further directed that two copies of this re- solution duly certified by the City Clerk of the Cijay of Caldwell, be served upon the City Treasurer of the City of Caldwell, Idaho. WHEREUPON it was moved by Councilman Newman, seconded by Councilman Fresher that as id resolution be adopted. Motion unanimously carried. The question of the nuisance in Indian Creek caused by the refuse from the Sugar Plant wea b rought up for discussion. Walter Griffiths appeared on behalf of the Chamber of Commerce. Protests were made also by representatives on behalf of the Merchants Association, Rotary Club, Junior Chamber of Commerce, Grocateria and Mrs. Bayhouse. After cbnsidarable a committee was appointedfrom the Council consisting of councilmen Thornock, McNeill and Clasen to consult with the Sugar Company.
