It was voted on motion of Dutton, seconded by Mumford, that the City buy Cooking Range from C. C. Gurwell at the price offered, $40.00. M. S. Sandmeyer representing the Trap Club, asking for permission to use a part of the Airport for trap shooting. It was voted on motion of MaBonnel, seconded by Mum f ord, that the matter be taken under consideration. RESOLUTION NO. 27, BY DUTTON, was presented as follows: "A RESOLUTION ACCEOTING THE ASSESSMENT ROLL OF'LOCAL IMPROVEMENT DISTRICT NO. 7 OF THE CITY OF CALDWELL, IDAHO, FOR OILING STREETS', AND ORDERING THE SAME FILED IN THE OFFICE OF THE CITY CLERK; FIXING THE TIME AND PLACE WHEN AND WHERE PROTESTS THERETO BY PROPERTY OWNERS IN SAID DISTRICT SHALL BE HEARD; AND AUTHORIZING AND DIRECTING THE CLERK OF SAID CITY TO GIVE NOTICE OF THE T11Z AND PLACE FOR HEARING AND CONSIDERING OBJECTIONS TO SAID ASSESSMENT ROLL BY THE PARTIES AGGRIEVED BY SAID ASSESSMENT AND CONSIDERING SUCH OBJECTIONS ". "WHEREAS, The Assessment Roll of 'Local Improvement District No. 7 of the City of Caldwell, Idaho, for Oiling Streets', has been completed in compliance with the pro- f9 visions of the laws of the State of Idaho, and the ordinances of the City of Caldwell, said Assessment.Roll also having basin prepared and certified to the Council by the Com- mittee on Streets, together with the City Engineer. "NOW, THEREFORE, BE IT RESOLVED, By the Mayor and Council of the City of Cald Idaho: 'Section 1. That the Assessment Roll of 'Local Improvement District No. 7 of the City of Idaho, For Oiling', be accepted and placed on file in the office of the City Clerk of said city; that November 19, 1928, at B o'clock P. Id. in the Council Chambers in the-City Hall of the City of Caldwell, Idaho, be and the same hereby is fixed as the time and place when and where objections to said Assessment Roll by the property owners in said district will be heard and considered. "Section 2. That the said Clerk is hereby authorized end directed to give due and legal notice by publication in compliance with the provisions of law, to property owners; that objections to said Assessment Roll may be filed within 10 days from the first publication of the Notice of Time to File Objections to said Assessment ?loll, which said objections will be heard and considered by the Counoil•st the time and place above fixed in Section 1 hereof ". Motion was made by Hoffman, seconded by Dutton, that Resolution No 27 be appro On the question as put by the hayor, "Shall Resolution No. 27 be approved"? The Clerk was directed to•call the roll with the following result: AYES: DAVIS, DUTTON, HOFF=V, JACILSON, MCCONNEL AND TMIMFORD. NAYES: NONE. The Mayor declared the motion carried and Resolution No. 27 approved. The Mayor end Clark approved end signed same. It was voted on motion of MoGonnel, seconded by Davis, that Council adjourn to November 16, 1928, at 8 :00, P. M. APPROVED: COUNCIL CHAMBERS, NOV. 16, 1928, 8:00, P. n. ABSENT: NONE. J. L. Eberle, representing Richards & Haga, Boise, Idaho, Attorneys for John L. Porter, owner of the franchises held by the Boise Velley Traction Co., appeared be- fore the Council and presented a Stipulation of adjustment and settlement of the action of the City of Caldwell vs Boise &:.Intprurban'_Railway Company, Ltd., the same being in full as a pert of the minutes of this meeting. The STIPULATION was considered at some length by the Llayor and Council and City Attorney, and the following resolution eonfirminE some was presented. RESOLUTION NO. 28, BY MCCONNEL, ENTITLED "A 117SOLUTIOR CONFIRMING THE SETTLEMENT C? THE CLAIM OF THE CITY OF CALDWELL, AGAINST TH;. BOISE VALLEY TRACTION COMPANY ". "BE IT RESOLED by the Mayor ano Council of the City of Caldwell, Idaho; "Section 1. That certain etipulationmade and entered into by and between the City of Caldwell and certain defendants in the ease entitled 'The City of Caldwell, etc. vs. Boise and Interurban Railway Company, a corporation, at al.,' pending in the District K. 0
