COUNCIL CHAMBERS, NOVEMBER 1, 1937.

The Regular Monthly Meeting of the CAty Council met in the Council Room of the
�I City Hall with the Mayor, W. R. Hollingsworth presiding.
111 On Roll Cikll the following Councilmen answered present: Edgar L. Oakes, F. D.
Mumford, W.S. Boynton, G. M. Fenrich,: :W. E..Babcock and,Norvil T. Hinds.
The Minutes of October 4th., 18th., and 20th., were read and approved as read.
Mr, J. H. Lowell and Mr. Frank Itoberte
appeared beRore the Council and petition-
ed the Mayor and Council to repair the gutters in the alley between Arthur Street and Main
Street'between Seventh Street and Kimball Avenue.
The 19ayor referred this matter to the Road Committee and the City Engineer.
Moved by Oakes, seconded by Boynton that the City co- operate with the State if
they d esirw� a building site in Caldwell for the State Tuberculosis Hospital.
A yea - end nag vote was had thereon with the Following result: Yeg: Oakes, Mum-
ford, Fenrich, Boynton, Babcock and Hinds, Nay; None. Absent and not voting: None.
Whereupon the Mayor declared the motion carried.
A Petition was presented to the Mayor and Council by the owners of lots between
19th., and 20th,, Streets facing Blaine Street for the removal of one foot of dirt to make
these lots low enough to irrigate.
Moved by Oakes, seconded by Boynton that this petition be referred to the Road
Committee and the City Engineer. Motion carried.
Thereupon the following preamble and resolution was presented by Councilman
Boynton who moved its adoption, which motion was duly seconded by Councilman Mumford:
RESOLUTION.
WHEREAS, Bill No 10, introduced April 26th., 1937 entitled: 74 ORDINANCE REGULAT-
ING THE PLANTING OF FLOWERS, ,TREES- AND SHRUBBERY IN THE PARKS ALONG THE STREETS, AND ALL
OF THE CITY OF CAIJ)W L, DECLARING DEAD TREES A HUSIANCE AND PROVIDING FOR THE PRUNING OF
TREES AND SHRUBBERY, PROVIDING FOR A FORM OF NOTICE TO BE GIVEN BY THE SUPERINTENDANT OF
PARKS REQUIRING PROPERTY OWNERS TO CONFORM WITH SUCH NOTICE AND PROVIDING THAT INCASE THE
ROPIMTY OWNER SHALL'NOT PERFORM THE DUTIES REQUIRED BY - NOTICE AND SAME SHALL, BE
CHARGED TO THE PROPERTY OWNER AS OTHER SPECIAL ASSESSMENTS, AND PROHIBITING THE PLANTING
OF CERTAIN SPECIES OF TREES IN THE BITY OF CALDWELL, PROVIDING FOR A FORM OF APPLICATION
FOR PERMIT TO REMOVE, PLANT ON PR TREES WITHIN THE CITY OF CALDWELL, REPEALING ALL OR-
DINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE, AND PROVIDING FOR A PEN*
ALTY TO BE CHARGED.

Whereupon the following resolution was presented by Councilman Boynton who
m oved ate adoption which motion was duly seconded by Councilman Mumford:
RESOLUTION

WHEREAS, Bill No 6, introduced August 2, 1937, entitled; AN ORDINANCE REGULATING
AND LICENSING CERTAIN MACHINE AND THE OPERATORS THEREOF, AND PROVIDING A PENALTY THE
VIOLATION OF SAID ORDINANCE,

A Yea and Nay vote was had thereon with the following result: Yea: Oakes,
r Mumfo rd, `Boynton. Fenrich, Babcock and Hinds. Nay: None. Absentand not voting: None.
Whereupon Councilman Hinds reported that the Road Patrol heretofore contracted
for with,the Austin- Western Road Machinery Co., and arrangements have been made to pay
one -half, of the purchase price or there about at the present time and the remaining one -
half to be paid on or about April 28th., or 29th., 1938, for the reason that it is believed
that it will be more convenient for the City to pay the second half of the purchase price
of said Road Patrol on different payment at said time.
Whereupon Councilman Hinds presented the following resolution to the Mayor and
Council who moved the adoption thereof, which motion was seconded by Councilman Fenrich.
RESOLUTION.
By Hinds.
WREREAS, arrangements have, been made for the purchase of a Road Patrol for the —fl i
use of the Road Department of the City of Caldwell, and
WHEREAS, it appears to the Mayor and Council that it is for the beat Interest
of the City to purchase said Road Patrol partly for cash and partly on different payment
NOW THEREFORE, BE IT RESOLVED, that the City of Caldwell complete the purchase
of said Road Patrol for the Road Department- of said City and that the payment be made ae
follows: One -half of said purchase price thereof to be paid in c ash upon the delivery of
said Road Patrol the remaining portion of the purchase price thereof to be paid on different
ayment on or about April 28th., or 29th,, 1938, and that the Mayor and City Clark of the
City of Caldwell be and they are hereby authorized and directed to execute a conditions. 1
sale contract on behalf of the City in the usual form, and,
FURTHER RESOLVED, it appearing to the Mayor and City Council that there are suf-
ficient funds in the Cemetery Investment Find which may be used as an investment on such
( securities as said conditional sale contract so executed by the City and that the City
Treasurer of the City be and he is hereby authorized and directed to advance and pay from
said Cemetery Investment Fund from money on hand and not otherwise appropriated sufficient
sum of money to said Austin - Western Road Machinery Co., and-take an assignment of the con.
ditional Sale Contract to be held by him in lieu of cash in a 11id fund.
A Yea and Nay vote was had thereon with the following result:
Yee: Oakes, Mumford, Fenrich, Boynton, Babcock and Hinds,
Nay: None.
Absent and not voting: None.
Whereupon the Mayor declared the motion carried and the resolution duly adopted.
The Bills for October were read and on motion by Oakes, seconded by Mumford that
these Bills be allowed and Warrants be ordered d raven for the various amounts all of which
had been approved by the Chairma n of the Finance Committee. Motion carried.
