Upon Roll Call the following Councilmen answered present: E. L. Vassar, N. E. "Coley" Smith,
Max Luby, Emile Shorb, L. P. Eldredge and Leland Finley.
The Mayor informed the Council this was the time set for hearing protests to the Assessment Roll
: of Local Improvement district Number L7.
There were no protests filed.

The Committee on Streets of the City of Caldwell, together with the City Engineer of said City of
Caldwell, has heretofore certified and submitted to the Mayor and Council, the Assessment Roll of Local
Improvement District N L7 of the City of Caldwell, Idaho, and it aooearing that the assessment roll was
received in the office of the City Clerk of the City of Caldwell, at 8;00 o'clock P. M. on the 1st day of
October, 1959; and that said Assessment "oll is now on file in —id office;
And it further anoearing that the Mayor and Council of the City of Caldwell, at a meeting of said
I!ayor and • 'ouncil, held in the City Hall of said 'ity, on the 15t day of October, 1959, passed a resolution
ordering said assessment roll to 'Le placed on file in the office of the City Clerk of the Citv of Caldwell,
and fixing the 19th day of October, 1959, at 8:00 o'clock P. P1., in the Council Chambers in the City Hall
of said City of Caldwell, as the time and place for hearing and considering objections to maid assessment
roll; and directing the City Clerk of the said Citv to five due and legal notice in compliance with the
Provisions of law, of the filing of said .Assessment "oll in his office, the data of filing the sa:,le and the
I. time and place at which the V ouncil would hear and consider objectipns to said Assessment Roll by parties
aggrieved by such assessments and the oersons by whom and the time within which said objections should be
filed, and further rirecting that said notice be oublished in three successive issues of The News - Tribune,
a daily paper printed and published in the City of Caldwell, Idaho, and the official newsoaper of the City
of Caldwell; all of which more fully aouears in said reRolution;
And it further aopearing that the Citv Clerk of the said Citv gave notice of the receipt of said
assessment Roll and of the time and place fixed for hearing prote -is thereto, directing the time, place and
manner of filing said objections; all or w:dch mora fully annears by said notice, dated the 1st day of Oct-
Ober, 1959, and now on file in the office of the City Clerk of the Cit• of Caldwell; and it further aooearing
that said notice was published as directed in the said resolution above mentioned, in the News- Tribune, the
official newspaper of said Cityof Caldwell; and it further anoearing that notice was duly and regularly given
in allresaects as required by law and the orders of the Mayor and louneil;
And it further a:oearinp that the time for filing obiections and protests having expired, and the
time fixed and apnointed 'or hearing and considering such objections and orotests having expired, and the
time fixed and a poointed for hearing and co ssidering such objections and nrotesta whatsoever have been filed

Section 1. That said Assessment Roll of Local Improvement District No. 0 of the City of Caldwell
Idaho, be and the same is hereby approved and confirmed.
Section 2. That the City Clerk shall immediately certify and file said Assessment "oll with the
Citv Treasurer of the Citv of Caldwell, for collection of said assessments according to law; and that due
notice of time, glace and manner of malcin^ these payments or assessments contained in said Assessment Roll
be .given by said Treasurer of the City of Caldwell, in the manner provided by laws of the State of Idaho,

TO; CITY 0
ATTENTION OF; Mayor and City Council:
We, the undersigned property owners, do herewith submit this petition in protest avainst
proposed remodelling of the present rodeo arena, and herewith petition for the removal
of the rodeo arena from its present location, in the interest of residential property
values in the a rea, and in the interest of the health, welfare and peaceful habitation
of the residents of the area that wouldresult £ron the removal or odors, noise, traffic
hazards, end other undesirable conditions attendant to the oneration of the rodeo arena
in its present location.
Mayor Simm =rman read the following report from the Roden Board: —

Jas ' -n Smith, President of the Caldwell Night Rodeo today stated. "In view of th fact
that the plans for r—od of the rodeo grounds as recommended by the special rodeo committee
to the Rodeo Hoard and in turn submitted to the City Council did not meet with the approval of the
_City Council or Mayor. The Rodeo Hoard is making plans to hold the rodeo in it's present location
vithput remodeling the present plant. Plans to rebuild the rodeo grounds on a different site gill
be made as soon an nossible. Full inspection of the present facilities will be made and all renoirs
necessary for the safety of the 1960 rodeo patrons will be taken care of. However the "Go ;astern"
theme as proncsed by the snecial committee is an excellent idea and will be followd by the board for
the 1960 show. President Smith further stated that we hope all the rodeo 'ans and all the people of
Caldwell will of this clan and will .pet behind the rodeo board and help to make the 1960 rodeo
a big success and help to further the Plans of rebuilding the rodeo grounds at a new site."

The Mavor informed the croup evert effort was being made M: the Council to come to a decision re-
garding the rodeo that would he agreeable to all parties concerned.
Councilman dldredge stated that over a year ago the Council set a time when the rodeo was to be
moved from its present location which would tie in frith the bui.lcing of the new Armory in 1960 or 1961.
Mojed by Eldredge, the Council go on record allowing until April 1, 1961 for the final termination !':
of the rodeo at the present location and the City Attorney orenare the necessary capers to nut this into
effect, seconded by Shorb.
Councilman Smith: I think a great many people feel that to move the rodeo from the pres location'
would kill the rodeo and I feel that we the Co will coenerate with the Rodeo Board in evaryraay because -
we have an obligation there.
V. .7. Martin: I think it has been brought out that the rodeo is a vood thi,nF for Caldwell and we -

will do everything to help the rodeo in their new location.
Councilman 'Vassar: If the Rodeo Board acceptnour decision I feel the Council and the citizens
grill help in everyway, both financially and in the donation of lanes
Upon Roll Call those vot'ng in the affirmative were: Vassar, Smith, Luby, Shorb, Eldredge and
Finley. Negative : None. Absent and not voting: None. y
There,nnon the Mayor declared the motion carried.
Mayor Simmerman renortad the Street Lighting �o"mtittee of the Chamber of Commerce have requested i
the Citv to donate $500 to help finance the Xmas decorations, also, the City electrical firms would only
donate one day's labor toward this project.
Councilman �,horb: I feel the merchants have already been taxed for the Xmas decorations, as the
Chamber of Commerce increased dues to cover this.
Mayor Simmerman: I believe the raise in dues was to purchase more decorations not for installation
and for the past two years the Street Department have placed the decorations and removed them.
Councilman Smith: The Chamber of Commerce is receiving mom ?coney than ever for decorations and
I am very much unposed to giving anything but the labor the Street Denartment, will furnish.
Movad by Smith the City c❑ntiaue to provide the labor for installing the Xmas decorations, seconded
by Vassar.

r— Councilman Sldredv_e: The dmas liehting program is for the benefit of the City and I feel we should
help ix this program in any way oossible,
Joe Driscoll, representing Flight Service Tne, discussed airport problems among which was char ring
the flight pattern so nlanes would not fly directly over the City, also that Eugene Franks was constructing
an airport west of the Municipal .Airport and there would be dancer of collision.
Mayor Sin:merman informed the Council this matter has been taken up with Chet Moulton but to date
the City or Mr. Driscoll have not received a renly.
Moved by Vassar, seconded by Smith the regular Council Meeting be held November 5, 1959.

Loren Marmon aiscussed covering an open ditch which crosses Walnut between Colorado and Montana.
This wasreferred to Councilman Smith and City Engineer and report back to Council.
Frank Meek discussed the crossing at Ninth and Cleveland.
City En�aneer informed Mr. Meek the crossing required under ground drainage and would be taken
'care of this fall.
City Engineer reported it woiild be advisable for the City to execute a quit claim deed to Leo A.
and Eleanor M, Maxwell and to obtain an easement from Jchn C. and Hilda h. Roney.
Voved by Sm -th, sec -naed by Eldredge the City .Attorney prepare the necessary papers to rut this
into effect.
Upon "roll Call it appeared the motion was unanimously carried.
