situation. John Holland, the City Treasurer, is going to make
a work flow sheet that Mr. Massuri is going to analyse. Mr.
Massuri felt that too much detail work is being done that is
not necessary. The Mayor said he felt the machine was slow which
is part of the problem. The girls run the machine from 7 :00 A.M.
to 7:00 P.M. If the L 5,000 is used over eight hours a day, the
maintenance contract is voided. The Mayor stated that he
felt the City should acquire another L 5,000 machine on a
lease- purchase arrangement over a seven year period so that
it will be possible to have two girls posting at a time. This
would eliminate at least one girl and give the office a back
up machine in case the other would break down as well as cut
down on the detail work being done now. The machine could be
leased for $253.13 a month for a seven year period. In addition,
there would be a maintenance contract of $80.00 a month. If
permission is given for this acquisition, the Company would be
able to install the machine within a month at no cost to the
City for the balance of this year. The Contract would start
in•:January. The new machine would be a used machine. Another
advantage of a second machine would be that the office could
go off the cycle billing system.
Councilman Gamboa made the Motion that the machine be tried,
but withdrew his motion after more discussion and the suggestion
by Councilwoman Williams that the Barrough °s man came to the
City Hall and talk to the City Council about not only the new
machine, but also to answer questions as to why the work is not
getting done with the machine now being used.
The Mayor said that he would arrange a meeting with the Burroughs
people on Friday, October 25th, at 4:00 in the Council Chambers.
(LETTER FROM THE GRIEVANCE COMMITTEE - FIRE DEPARTMENT)
The Mayor read a letter addressed to the Mayor and the City
Council from the Grievance Committee of the Fire Department
' concerning the termination of employment of Ben Parker on
October 3, 1974. The Committee, consisting of Harlan Dilley,
Charles Phillips, Dale Fleetwood, and Galen Woods, claimed
that Mr. Parker was not informed as to the reasons for his
dismissal and felt he should have a written reprimand: The
Committee asked the Fire- Chief, Harold Perfect, to reverse his
decision which he refused to do. The Mayor stated he had since
talked to Mr. Dilley and Mr. Woods and asked them to withdraw the
letter, but they refused to do no.
The Mayor said that in the Contract it states that if a. grievance
does exist they shall, with or without the employee present, submit
this grievance to the Chief of the Fire Department for adjustment.
If within five days.the grievance has not been settled, it shall
be submitted to a delegated Committee comprised of- members of the
City Council, which •now consists of Councilwoman Williams and
Councilman Gamboa,:for- adjustment. The Committee will within five
days submit their decision to the City Council for approval. If,
within 15 days, no settlement has been reached, then the grievance
shall be submitted to an arbitration board consisting of a
representative of the City, a representative of the Union and the
third person chosen by the two representatives. The findings of
this Board shall be binding upon all parties concerned.
The Mayor further stated that Don Machos and Harlan Dilley were
in the office with the Fire Chief, Harold Perfect, when W.
Parker's employment was terminated and that all of the reasons for his
termination were given to him. The Union then demanded that this
be in writing. Mr. Tunnicliff, the City Attorney, told the Mayor
that there was nothing in the State Code, in the agreement, or in
the City Code that states that when you fire someone you have
to give the reasons.
