October 24, 1910. Council met in regular session pursuant to adjournment
with Mayor Gowen presiding, and Councilmen Revers, Farrar, Gartin, Harris, Paynter,
present, Shorb, Clerk.
liessrs. Turner,and Ruby appeared making verbal petition for bridges across
Indian Creek at Tenth Avenue, bridge to be full width of street, and also for a street
light at the intersection of Rrthur Street and Tenth Avenue. The matter of the con-
struction of the bridge was referred to the street committee and city engineer to
report at next meeting.
G. H. Van Wyngarden makes verbal petition for the opening of the alley through
clock 24, Washington Heights Addition, he agreeing to give the alley if the city should
reimburse him to the amount of $65.00 paid by him For right -of -way. A motion was
made by Devers that a warrant be ordered drawn on the Road Fund to the amount of 465.00
in favor of G. H. Van Wyngarden and pt ;id to him when he gave the city a right -of -way
through Block 24, as stated. The roll being called on the motion, the vote resulted:
Ayes -- Devers, Farrar, Gartin, Harris, Paynter - -5.
Nays- -O. Absent -- Clark. So the motion prevailed.
D. H. Andrews makes inquiry respecting the cost of certain sidewalks, and
objecting to fills which he claimed were not made. Mattar referred to Sity Engineer
to adjust with Mr. Andrews.
Bill No. 73 by Farrar, entitled, "An Ordinance authorizing the issuance of
Special Assessment Sewerage Improvement Bonds of the City of Caldwell, in the sum of
t5e,000. for the purpose of paying the coat of construction of Sewers in Local Sewerage
Improvement District Plo, 3, 1n -i provi -lin for the payment of said bonds out of the
collection of the assessments levied against the property benefited within said District'
was read the first time.
A motion wan made by Devers that the rules be suspended and the readings on
three separate days be dispensed with and Bill No. 73 be read the second time by title
and the third time in full and rlaced on itn final passage. The roll being called on
the motion, the vote resulted:
Ayes -- Devers, Farrar, Gartin, Harris, Paynter - -5.
Nays - -0. Absent -- Clark. So the motion prevailed.
Bill No. 73 read second time by title.
Bill No. 73 read third time in full and placed bn its final passage. On the
question, Shall Bill No. 73 pass 7 the roll being called the vote resulted:
Ayes -- Devers, Farrar, Gartin, Harris, Paynter - -5.
1 - -0. Absent--Elark. So Bill No. 73 passed becoming Ordinance No. 187.

Deed of V. J. Devers, et ux, for Block 70, and land between Block 70 and the
present reservoir site was presented to the Council and having bedn approved by the
City Attorney, a motion was made by Farrar, that a warrant be drawn on the Water Works

A motion was made by Clark that the warrants issued to Chas. H. Hanson on the
Water Works Fund for drilling wells be cancelled, and that warrants be drawn for the
amounts with accrued interest on the Water Works Extension Fund. The roll being call-

Protests against the assessment roll of Local Lateral Sewerage Improvement
District No. 4, of J. A. Dement. G. S. Branard, Clara L. Iffatkins, J. W. Watkins,
Martha A. Boone, Jacob Leick, W. W. Simmonds, Lettie P. Askey, L. Mesler, Frank J.
Holderman, Charles S. Gibson, J. M. Patton, Jacob Stroup, Dorothy Denton Dement, Ida
Mabel Norton, G. L. Crookham, were filed according to law and protest of J. A. Dement,
as follows, was reads
"In the matter of the proposed assessment against Lots 1, 2, 3, 4, 5, and 6,
Block 52, Original Townsite and Lots 7 to 24 Dement Block Caldwell, Idaho, owned by
J. A. Dement for the construction of a sewer in Local Lateral Sewerage Improvement
District No. 4, of the City of Caldwell, Idaho.
To the Mayor and City Council of the City of Caldwell, Idaho:
Comes now J. 'A. Dement and protests against the proposed assessment against
Lots 1, 2, 3 4 5 and 6 in Block 52, Original Townsite, and Lots 7 to 24 Dement
Block, Caldwell, Idaho, for the expense of constructing a sewer in Local Lateral Sewer-
age Improvement District No. 4, of the City of Caldwell, Nato, on the following
grounds, to -wit:
I.
That in the proposed assessment for said sewer and in the proceedings organ-
izing the said sewer district and leading up to said proposed assessment, the City
Council of the said City of Caldwell, and tl_e alleged Sewer Committee for said Sewer
District have not proceeded according to law, and such proposed assessment is null
and void for the following reasons, to -wit:
(a) That the affidavit of publication of Ordinance No. 173 of said City was
not filed with the clerk of said city on or before the 27th day of June, 1910, the
time fixed for the hearing of protests against the organi:�ation of said sewer district.
