Council met in regular session persuant to adjournment of Cot. 17, 1927, with
Mayor Dunlap presiding and the following Qonnoilmen present; DUTTON, HOFFMAN, JACKSON,
MCOONNEL AND MWORD. ABSENT:. DAV,IS.
RESOLUTION NO. 6, ENTITLED " A RESOLUTION ADOPTING AGREEMENT BEMEN OREGON
SHORTLINE RAILROAD COMPANY AND CITY OB CALDWELL RELATIVE TO CONSTRUCTION OF WATER MAIN
THROUGH RIGHT -OF -WAY OF THE RAILROAD COMPANY 01 4VBN STREET."
"WHEREAS, -The City of Caldwell contemplates the construction and subsequent
maintenance and operation of a four inch water pipe line underneath and cross a portion
Of the right of way of the Oregon Short Line Railroad Company within the limits of Avon
Street in the City of Caldwell, Canyon County, Idaho; and
"WHEREAS. it is necessary to the construction of said main, to enter into an
agreement with the Oregon Short Line Railroad Oompany for the privilege of constructing
said water main through and along the right of wqy of said railroad company; and
" WHHREAS, Motion was duly made,cedoonded and carried that proper resolution be
drawn authorizing the Maypr of the dity of Caldwell to enter into proper contract with
said railroad company for securing the privilege of constructing said water main;
"NOw, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THIS CITY OF CALDWELL
IDAHO:
"Section 1, That the Mayor of the City of Caldwell be, and he hereby is, author
ized and directed to enter into such contract with the said Oregon Short Line Railroad
9ompany on behalf of the sand City of daldwall, for the purpose of Securing the privilege
of building and constructing said water main through and across a portion of the right of
way of said railroad o =pang within the limits of Avon Street in the 8ity of Caldwell."

AND MAINTAIN A STANDARD GAUGE RAILROAD TRACT IN THE ALLEY IN BLOCK NINETY -ONE (91) AND

OVER AND ACROSS SIBTH (6) AVENUE NORTH; IN TIE CITY OF CALDWELL, IDAHO." wee read for
the first time. A motion was made by Mamford, seconded by Mobonnel, that. the raise
requiring a bill to be read on three separate days be suspended, and Bill Bo. 10 be
read the second time by title and third time in fall section by section and plooed on
its final passage. The Mayor directed the 01erk to call the roil with the following
result: AYES: DUTTON, HOFFMAN, JACKSON, MCOONNEL AND RUMFORD. HAYES: ROSE. ABSENT:
DAYIS. The Mayor declared the motion had oavried by the necessary 3/4 majority, and
directed the clerk to read the bill the second time by title and the third time in fall
and placed on its final passage. On the question as pat by the Mayor, "shall Bill No.
10 pass?" The Mayor directed the Olerk to call the roll with the following result:
AYES: DUTTON. 1101PIOW, JACKSON, MCCONNEL AND MUMFORD.
RAYES: BORE. ABSENT: DAVIS. The Kayor declared that Bill No. LO had passed and now
became Ordinance Bo. 446, and approved same in open session off the Council.
It was voted on motion of Modonnel, seconded by Mumford that Council adjourn.
