M. city C eyW COUNCIL CHAMBERS OCTOPFR 19, 1964 The Council met pursuant to recess and acknowledpment of notice in the following form: We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do each hereby acknowledge notice of a Recessed Meeting of the said City Council, to be held in the Council Chambers in the City Hall in the City of Caldwell, Idaho, at the hour of 8:00 P.M., on the 19th day of October, 196h, for the transaction of all business in connection with the following object: New and un- finished business. Witness our signatures this 19th day of October, 1964. "mayor Akli I ccunciiman ro Conn man Mayor N. F. "Coley" Smith presiding. Upon Roll Call, the following Councilmen answered present: E. L. Vassar; Max Luby; James W. Keys; V. Jay Martin and C. A. Davenport. Absent: Charles W. Carpenter. Purchase of property Elk's Lodge Mayor Smith stated a problem has resulted due to the fact that the local Elk's Lodge have not yet made up their mind regarding the usability of the tract of land owned by the City on Smith Kimball . adjacent to the National ('niard Armory, which tract of land has been offered in trade to the Elks for pro- perty owned by them at 18th and Main Street. The Lodge has agreed, however, to make this property available to the City now and work out an agreement later, either by a trade or the payment of $2800.00. A motion was made by Councilman Martin, seconded by Councilman Vassar that the Mayor be authorized to work out a property transferral with the Flk's Lodge for the well site at 18th and Main Street, to he either traded for with land available or paid for in rash. Upon Roll Call the motion carried unanimously. Stop Signs at Fillmore, 13th and Idaho Streets Mrs. Earl Brockman Jr., President of Lincoln PTA and also representing Washington PTA oresented a request for a stop sign to be installed at Fillmore, 13th, and Idaho Streets. She stated there are five intersections at this point where these streets come together and there is not even a "School 7one" sign posted. She further stated this situation is within a block of two schools. After discussing this with the Council, Mayor Smith informed Mrs. Brockman this matter would be referred to the Police Department. Protest of lighting sign at B15 Galveston St. Mrs. Charles Basey and Mrs. A. L. Rinearson appeared before the Council in protest of the liphtii 326 of the sign at 815 Galveston St. erected by The Sundowner Motel and H. J. McNeel, Inc. She stated she had read in the paper where it might take from one and a half to two years before the pending suit of The City of Caldwell vs. The Sundowner Motel; H. J. McNeel, Inc., and Robert Bushnell, Manager of both companies, would be settled. She said she didn't understand why the residents in that locality should have to put up with a nuisance of this kind when Mr. Bushnell had caused the sign to be erected and lighted illegally. She thought her rights as a citizen were being violated if she had to tolerate this nuisance for possibly that period of time and asked the Mayor and Council if there was anything they could do to abate this nuisance. William Gigray, City Attorney, replied that he had entered in court an action to cause removal of the sign and also asked that the lights be taken off the sign or not lighted during the pendency of the action but that the Judge had ruled he would not enter a temporary injunction in this regard because this would change the status quo between the narties involved and inasmuch as the sign was lighted at the time the suit was brought he would leave the sign lighted until the matter could be heard on merits. Mr. Gigray also stated that if the City wins the case, there is nothing to keep Mr. Bushnell from appealing to the Supreme Court, which could cause another delay in the settlement. Mrs. Basey stated she didn't understand how he could have the lights on when he didn't have a permit for such. Mr. Oigray replied that Mr. Bushnell had hired an electrical contractor, Caldwell Electric, to prepare the sign for lighting and in accordance with a prevailing custom the contractor had not taken out a permit prior to doing the work. He had, however, ceased work immediately upon being contacted by the Building Inspector . Mr. Bushnell then completed, or caused to be completed, the lighting of the sign himself by hooking it up with a cord to an adjacent house owned by him. Mrs. Basey again asked if there was not something that could be done immediat to stop this procedure and Councilman Luby informed her she had a right to sue as an individual. Mrs. Basey replied she didn't think she should be out the expense of a suit when a man had broken a City Ordin- ance which we're all supposed to abide by and furthermore she would have to sue the City Council and the Mayor and she didn't propose to do that. Councilman Martin asked Building Inspector Barney Goul if the code required a contractor to take out a permit before work was started. Mr. Goul replied the code states specifically that they shall take out a permit to do any electrical work before the work is started and the penalty is a double fee if they do not. Mayor Smith stated he had discussed this with the Building In- spector and it seems a practice has developed during the years whereby a contractor completes his work befm he takes out a permit so he will know exactly how much the fee will be. On small ,jobs where the work is done on a time and materials basis, it is difficult to determine the exact cost so they are sometimes granted permission to do the work with a record being made in the office and a follow -up made later. Prior to this time there has been no difficulty encountered in this practice, he stated. Councilman Martin asked if a permit for this job had been denied and the Building Inspector told him it had. Mayor Smith asked Mrs. Basey if, considering what she had learned at the meeting, she was satisfied to let this civil case take it's time in the Courts. Mrs. Basey replied that she apnarentl,y didn't have any choice. After some further discussion on the subject of issuing permits, Mayor Smith suggested all the facts regarding the wiring and lighting of this sign be given to our City Attorney by the Building Inspector and he will make a report to the Council at the next meeting. Proposed Election for Fire Station Building Mayor Smith presented to the Council the matter of a bond election for the purpose of raising $100,000.00 to build a new Fire Station building. He suggested this election be held in early December to avoid coinciding with a bond issue the Library Board is proposing for consideration in January or February. He stated it mould be built on property owned by the City. Councilman Vassar and Luby stated they would not support a bond election because they thought this could be handled another way. Councilman Luby suggested all the budgets be cut by three per cent. Councilmen Martin and Davenoort stated they were in favor of presenting this to the people through a bond issue bat after some further discussion suggested this be postponed until next Council meeting. Irrigation Assessments for 1965- 10% increase Mayor Smith stated due to the fact that some equipment needs replacing, Public Works Administrator Melvin Lewis recommended an increase of 10°. in the irrigation rates for 1965. A motion to this effect was 329 made by Councilman Keys, seconded by Councilman Luby. A vote was taken and the motion carried unanimously. Power Company Luncheon re: rates Mayor Smith announced the Idaho Poorer Company will hold a luncheon Monday at noon at the Saratoga Hotel for a full nower rate explanation of the reduced rates and that he would like to have the Councilman attend if possible. Special Course at Ontario in City Administration The City of Nyasa, Oregon is offering a special thirteen weeks rite course at the Junior College in Ontario in City Administration, Public Works, Ancounting and all types of Administrative work at the city level. Mayor Smith suggested City Clerk, John Enplehart, and Public Works Administrator, Melvin Lewis attend and that the expense of 860.00 for the two be paid by the City. A motion to this effect was made by Councilman Vassar and seconded by Councilman Davenport. A vote was taken and the motion unanimously carried Airport Hangars Lease A motion was made by Councilman Luby, seconded by Councilman Martin that the Airport hangars lease between the City of Caldwell and Boyd Harris, Dean Dishman, James Batt and Roger Sayre be accented. A vote was taken and the motion unanimously carried. This Way Avenue Mayor Smith reported the City has completed running, their share of the water line, 600 feet, down This Way Avenue. He stated two parties who are adjacent property owners are reeuesting the City pave the street if they out in their own curb and gutter. He said this was discussed at a meeting he had attended and he informed them as far as the City is concerned they will put in an oil met down This Way Avenue 800 feet for 83.00 per running foot provided the Parties will sign releases stating the City will never have to replace any of it and that they will maintain the oil strip themselves. Old City Dump A report was made by the Mayor that some neonle had been using the old city dumn down on Elgin Street and this practice should be discouraged. Application for Bartenders Permit Application for Bartenders Permit from Kenneth Shift was presented for the consideration of the Council. It, had been approved by the Chief of Police and was accompanied by the required fee. It was moved by Councilman Martin, seconded by Councilman Davenport the application be anoroved and the permit issued. A vote was taken and the motion carried unanimously. Boy Scout Troup to use Island off Curtis Park City Engineer Lewis stated a reel+est had been made for permission to use an Island adjacent to Curtis Park by a Boy Scout Troop sponsored by the Elk's Lodge. After some discussion it was decided this matter would be referred to the City Attorney and brought up at a later date when the nroper information regarding ownership of this Island could be de- termined. Bills presented for mid - October It was moved by Councilman Martin, se m nded by Councilman Vassar that the bills presented for mid- October be approved and warrants be issued in the various amounts for Payment of them. A vote was taken and the motion unanimously carried. NO.
