The ouncil met in regular session, pursuant to adj^urnmcnt, Oct.11th 1926 at 8 o'clock, P.M. with Mayot Kaley, presiding, Councilmen, Conley, Dutton, Kimbroug , 11umford, Yo Connal, and Wheeler, present. s. Anne W.Young, respresenting the Forward Club of Caldwell, Idaho, asked the 000perat ono& the Council in the proposed swimming pool, to be sponsored by the Forwatd Club. It was v ted on motion of A4oConnel, seconded by 70heeler, that the City of Caldwell grant the Ladi a Forward Club of the City of Caldwell, Idaho, a franchise for a suitable tract of land, preferra lr,.Block 20 pair Acres Addition to Caldwell for a swimming tool, the City to furnish the water fo the same. "A SOLUTION AUTHROIZING AND DIPECTING THE CLERK OF THE CITY OF OALDWELM, IDAHO, TO ADVERTI R FOR BIDS FOR THE CONSTRUCTION OF A BRIDGE ACROSS INDIAN CR SK ON NINTH AVENUE SOUTH IN SAID CITY. n IT RESOLVED, by the Mayor and City Council -f the City of Caldwell, Idaho.: Se tion 1. " A RESOLUTION AUTHORIZING AND DI "ECTING TEE LLAYOR AIM CITY CLERK OF THE CITY OF CALDWELL IDAHO, TO EH!ER ISTTO A CONTRACT WITS RIVERSIDE IRUIGAT ONDISTRICT, LIIIIT3D,VPAI7I170 1IUTTTAL DAMAGES BY REASON OF EITCROACBtTENT OF T= HIGINAY UPON THE RIGHT OF STAY OF THE RIVERSIDE CATTAL, I I THE CONSTRUCTION OF TEE PAVING ON T`M OLD OREGON TRAIL FEDERAL AID PROJECT 110.86B, OR DAMAGE IHICH MAY ACCRUE IN THE FUTURE ON ACCOUNT OF SEETAGE,SUBIR?IGATIN,OR EROSION FROM SAID CANAL. * WBEREAS, there is now before the Mayor and Uouncil of the City of Caldwell, Idaho, form of contract with Riverside Irrigation District, Limited, which provided for a waiver of d mages by said irrigation districts by reason of the encroachment by said Uity upon the right off way Of the Riverside Canal in laying the ravement in the constructions of Old. Oregon rail Federi 1 Aid Project 1Qo. 86B, and prvides for a release by said Uity from any damages which may ac rue -in the future on account of seepage, subirrigation,or erosion from said canal, causing in my to said paving or highway, and; l7HEPEAS, such form of contract has receive, the careful consideration of this body, sod it is beleived that it is for the best interest of this municipality that such contract be a eouted forthwith; now, therefore, ` it resolved by the ITayor and Ccuncilof the City of Caldwell, Idaho; Section 1. The Iiayor of the City of Caldwell,Idaho, is hereby authorized and d rested in his official capacity, to execute in duplivatre, the contract above described, dtith Rillerside Irrogation District, Limited, and the Cleric of said City is hereby authorized and directed to af+ Pig the corporate seal of this municipality to each of the said duplicates of said contract, and to attest the same and to certify such duplicates as the contract authorized by this resolitinn. And whensaid co tract has thus been executed and has also been properly executed by t he Riverside Irrigation District, Limited, the Clerk of said City, is hereby directed to deliver one of said duplicates to the secretary, of the Riverside Irrigation District, Limited, and to re ain the other as a part of the records of his office. A motion was made by Idumford, seconded by Mc that the two aforesaid resolutio s be passed and adopted. The Mayor directed the Clerk to call the roll on the aforesaid mots n with the following result: AYES: CONLEY, DUTTON, KILTBROUGY, MUITF077, XM 11000IINEL. ITAYES: NONE. ABSENT: 17HERLER.
