I. D. No. lift Assessment Roll The Mayor informed the Council this was the time set by notice for receiving and hearing protests the assessment roll of Local Improvement District No, ht!. A number of nroperty owners within the district were present a nd protested on the gronnds the pav- ing was inferior. The following property owners recueStdd some action be .taken by the Council in regards to the oav Pelmar Keck; Bob jfoward, Mrs, dames Backman, Lewis Dretke, Monroe Dille Eldon Darling, Harry Wilson, Leo m'atrick, Mrs. Elmer Kellhofer, Stanley E. Lenson, Ray Dunlap, Chas Warren and Everett Brock. Mavor Simmerman informed the group the City Engineer, Mayor and members of the Council would join a designated group from the district to inspect the paving. No action was taken on the Assessment Roll of Local Improvement District No. 48, at this time. The following letter was read and ordered spread on the Minutes: To the Mayor and City Council Caldwell, Icaho Pear Sirs: July 28, 1960 I've been repuested by the Hoard of .Adjustment to advise you that the Board, at its regular meeting on Tuesday evening, July 28, 1960 anproved without dissent a motion to recoimned such additions to our present codes as will make mandatory the consideration of off- street narking for all Special Permit annlications places before it. Congestion and inconmeni.ence to the public generally are especially evident near the larger churches in the city during their services and around some hnsiness installations both in residential end commercial areas. Attached hereto are suggested wordings that might be included (or amended to make more acceptable) that are, offerer for inclusion in anlicable portions of the codes as the re- codification is considered and anproved. Daird Secretary Board of Adjustment (Proposed Inclusion in Re- codfication) ( of City Ordinances ) I It shall be incumbent upon the Board of Adjustment to consider and red - necessary oSS- street paring before issueing Special Permits in any case. Churches, auditoriums, amusement or entertainment centers, and all other businesses or establishiients involving the assembly or parking of customers, owners, emnloyees, or tenants vehicles, shall be reruired to present evidence of provision for such off- street parking as may be deemed necessary by the Board prior to their approval of such Special Permit The Building Official mayre „er any application for a building permit to the Board of Adjustment where, in his judgment, a question of sufficient and necessary off-street parking may be crated by the proposed consturction. Chuck Banks was present and recommended the Council approve the recommendations of the Board of Adjustment regarding off street parking by commercial businesses. The City Attorney stated there were cases coming uo in court regarding the right of a City to require parking areas. Permission for Trailer House (Mrs. Yost) Mrs. Amos Post, owner of Post's Drive Inn requested permission to place a small trailer house on her pronerty, the trailer house to be used for storage and a place for a school child to rest. Simmerman Mayor /stated this matter had been taken up with the Building Inspector and there was no objection. Mayor Simmerman instructed Mrs. Post to obtain s signed statement from residents in the area ao-,roving the trailer house at this lbaation and upon receipt of this signed statement giving approval a temporary permit will he issued; permit to exoire May ist, 1960. Request of Mrs. 'kiKf .qaq to have property an Rexed Mrs. Dorothy Aikman was present an ' requested the City to annex her property located on Canyon Hill. Reports by the Mayor Mayor Simmerman reported the new parking meters were nearly all insta:led and the new street lighting system was progressing favorably. Mayor Simmerman reported the Union Pacific Railroad Co, has two areas on their right -af -way be- tween the passenger depot and the freight denot which the City could lease for a parking area. No action was taken at this time. - Damage claim Idaho Power Cc A uamage claim was filed by the Idaho Power Company for labor, material and equipment hire for restoring street light and pole at 5th and U. W. Hignway h 3D, damaged by City of Caldwell Payloader. Moved by Councilman Shorb, seconded by Councilman Eldredge this claim be referred to the Max Lewellen Agency. ' Upon Roll Call it appeared the motion was unanimously carried. Sprinkling system Caldwell Memorial Hospital It wasreported the Kiwanis Club o Caldwell was donating $500 towards the new sprinkling system for Caldwell Memorial Hospital and requested the City to dig the trenches. It was unanimously agreed by the Council to grant this request. A meeting s by Idaho Municipal League will be held October 20, at the City Hall to meet with County legislators and discuss pr eased legislation recommended by the I.M. L. - - Prelininary klat Mansell Ron Blakley presented a preliminary plat of Mansell Addition. The City Engineer ir=•auseted more time to study the plat. Preliminary Plat Nicol 7- Farwell A preliminary plat of Nicol Farwell Su- Division was presented by Ron Blakley for Council Con- sideration. The City Enginper stated before the City accept this plat riUht -of -way for two unnamed streets V 1 should be acquired and also recommendations of Planning Commission for annexation should be re ceived as this property is outside the City Limits.
