in Township Four (4) North of Range Three (3) West of the Boise Meridian, thence easterly
on said Quarter (.) Section line to the intersection of the center line of Poynter Avenue,

of -Pay, thence northwesterly and parallel to said right -of -way to the northerly line of

That two new sections be added to s aid O rdinance No. 501 to be known as Section 44
and 45, as hereinafter set forth. Section 44 regulates the establiabahent of wrecking yard
and wrecking houses of the City of Caldwell, which said Section 44 will read as follows,
to -wit;
"Section 44. No wrecking yard or wrecking house shall b e established in the
City of Caldwell unless it complies with all of the other requirements of the Ordinance
of which this is an amendment, and in addition theretd shall be completely surrounded by
a solid paint board, concrete fence or other enclosures of not less that 8 feet in heightl
from the level of the ground and completely obscuring from th4 outside ariew the wreckage
and parts therein contained and such wrecking yard and wrecking house, shall not be es-
tablished within the City of Caldwell except that a petition shhll be signed by the owners
of seventy -five percent (75$), both in number and in areg, of all of the property owners
within a radius of three hundred (3ool) of any part of the premises of which s aid wreck-
ing yard of wrecking house is to b e established and filed with the building Inspector of
the City of Caldwell to- gether with an applim ation for a special permit for the estab-
lishment of said wrecking yard of wrecking house end a hearing had before the Board of
AdJustment in the same manner and with the same feesss other hearings before the Board
of Adjustment for special permits."
Section 45 of said Ordinance No. 501 regulates the establishment of amusement halls,
or dance hall", community buildings, assembly halls, or auditoriums within the City of
"Caldwell.' and shall read as follows, to -wit;
"Section 45. That no amusement ball, dance hall, community building, a ssembly

hall or auditorium shall be erected within any of the Zones of the City of Caldwell un-
less they comply with a 11 of the provisions of the Zoning Ordinances of the City of Caldwe l
with respect to such places and in addition thereof shall file a petition, signed by
seventy -five percent (75%) in area and in number of the owners of all property within a

radius of three hundred feet (300 of any part of the grounds surrounding such building
or place, with tY.e Building Inspector together with an a pplication for a special permit
with the same fees and a hearing before the Board of Adjustment as incases of special per-
mits for buildings for occupation under the Zoning Ordinances of the City of Caldwell."
NOW, THEREFORE, BE IT RESOLVED, that a public hearing be had before the adoption of
- said proposed amendments or changes and that the City C lerk of the U ity of Caldwell shall
cause said notice of tdmfe and place of hearing to be published in the Caldwell News- Tribun
the official newspaper of the City of Caldwell, in two issues thereof at least fifteen day
before such hearing, and that said hearing be held in the Council Chambers in the L ity

Hall of the City of Caldwell, Canyon County, Idaho, on the 14th day of November, 1938, at
the hour of B o'clock P.M.
BE IT FURTHER RESOLVED, that such notice shall be in substantially the following form

"NOTICE OF PTJ3LIC REARING
"NOTICE IS HEREBY GIVEN that the Adjustment Board of the City of Caldwell has filed
its recommendation and report on proposed amendments to Ordinance No. 501 of the City of
Caldwell, entitled;
I An ordinance dividing the City of Caldwell, Idaho into districts or zones and pre-
scribing restrictionsamd regulations as to heighth, number of stories, size of buildings
and other structures, the per cent of the lots that may be occupied, the size of yards,
courts and other open spaces, and the location and uses of buildings, structures and lands
for residence, trade, industry and other purposes within the said Cit7,
comet my known as the Zoning Ordinance and the amendments thereto and thereof, whereby the
boundaries of "A" Residence Zone and "B" Residence Zone of the City of Caldwell will be
changed and enlarged and "Es Industrial Zone will be changed, said boundaries of said
Zones will be changed as follower
"'A' Residencg Zone shall be enlarged and changed so as to include all of College
Heights and a portion of Mountain View Addition lying East of College Heights and North
of the Southerly boundary line of College Heights Addition extended.
"rBI Residence Zone shallbe enlarged and changed so as to include all of Strahoxm
Addition not now in said IBI or 'A' Residence Zones and that portion of the O riginal Town
lying adjacent to Indian Creek and West of 6th Avenue and that portion of the City of
Caldwell not now in said IBI Residence Zone lying East of 5th Avenue North and Sauth of
the North line of Section Twenty -t n (22), Township Four (4) North, Range Three (3) West
of Boise Meridian and Went of the Easterly boundary line of the C ity Limits of the City of
Caldwell being the East boundary line of Section 22.
"In' Industrial Zone shallbe altered to exclude a narrow strip of land along
the Wilder Branch of the Oregon Short Line Railway through Strahorn Addition and the Origin
Town of the City of Caldwell.
and by adding to said O rdinance two new sections to be known as Sections 44 and 45, the
first of which to regulate the establishment of wrecking yards and wrecking houses in the
City.of Caldwell, providing that the same shall be fenced and enclosed, providing for a
hearing before the Board of Adjustment before their establishment, and providing for
filing a petition with the Building Inspector of the City of Caldwell, The second'of

in the City H of the City of Caldwell, Canyon, Idaho, on the 14th day of November, 1938,
at 8 o'clock P. M., before the adoption of such proposed amendments as contained in maid
recommendation and rpport, when and where any person or persons interested may appear be—
fore the Mayor and Council and object to such amendments or make such suggestions a may be
meet and proper in the premises.

The Regular Monthly Meeting of the City 0 oun4 l met in the Council Room of the
City Hall, with the Mayor, W. R. Hollingsworth, presiding.
on Roll Call the following Councilmen answered present: Edgar L. Oakes, F. D.
ITumford, W. E. Babcock, G. M' Fenrich and Norvil T. Hinds. Abdent: W.S. Boynton.
The Minutes of October 3rd., 17th., were read and approved as read.
Willard Robinson, L. A. Williams and L. E. Burrell appeared before the Mayor and
7ouncil and asked the City to gravel North Indiana Avenue on Canyon Hill. This matter was
referred to the Street Committee,
The Bills for October were read d on motion by Mumford, seconded by Babcock
that these Bills be allowed and Warrants be ordered drawn for the ®arious amounts all of
which had been approved by the Chairman of the Finance Committee. Motion carried.
