Thereupon the Mayor declared the motion carried and the Resolution adopted. This being the time set for receiving bids on an apuraisal of City property. I I Two bids were received and opened.from the United States Appraisal Go, and General Appraisal Co. These were aeferred to the C ity Attorney and City Engindlr for study and report back to Council. Councilman Finley requested a check be made with Fire Underwriters to ascertain if an appraisal would be accepted made by a company without an Idaho license. This being the time set for receiving bids for codifying ordinances of the City of Caldwell. Th <re were no bids received. The Mayor recommended the City enter into a contract with Sterling Codifers of Weiser. Moved by Eldredge, seconded by Shorb the Olt Attorney proceed with the necessary arraneements and draw a contract. Councilman Eldredge: Contractor should consult with Engineer, Building Inspector and other employees of the ''ity. The Mayor informed the Council the meeting was called to discuss Health and 3anitations hazards and the n odeo drounds. Application for Pool and Card License a,s read from Roy's Sport Shop the fee accompanying the application. Moved by Blomquist, seconded by Finley this license be granted. Upon Roll Call it appeared the motion was unanimously carried. The following letters were read by Chief of Police Judd: 4 September 1958 I TO* Keith Judd, Chief of Police FROM- Lt. Elwood Siegmann SUBJECT: Survey of three residences in Caldwell — 504 Elgin, 122 Elgin, and 118 Elgin. 504 Elgin. on August 11, 1958 at approximately 4 130 PH checked the three buildings at 504 Elgin. Found that I two of the small cabins were being occupied at this time. Both cabins are using one outdoor toilet, which is located back near the alley. This area has access to sewer facilities and none of the three cabins are connected to the sewer. At this time I found that this property belongs to W. E. Pendergrass of 924 No, lst,', Caldwell. On September 3, 1958. I again checked this area at 504 Elgin. Found that the same two cabins are IIII still occupied, the same toilet on the alley still being used, none of them have been hooked to the sewer at this time. I was accompanied on two checks of this property this date — once by Charles Hammond, Health Officer, and again by Wally Paddock, the Fire Chief. The two rented.cabins have adopted the house numbers I as followss the one nearest Elgin has a 50 house number with the number 3 written in in pencil. Found the cabin to be paper lined, stove pipe going directly through the roof. What appeared to be a chimney, the insulating it between the pipe and the roof. The occupant of the cabin stated he still uses the stove. The outside of the cabin and to the rear showed an old type hook up to the electric meter going through fuses — '! one 15 ampere and one 30 ampere fuse, wire being hooked onto the upper end of the fuse and taken into the cabin — also from this point to the rear cabin, which is number 5022. Found and pictured a pile of garbage, considerable flies around it, which is to the rear of the cabin that is marked 503. On the same property belonging to the same man is a cabin that is marked 5022. This cabin has what appears to be a rat burrow under the front corner of the building. It has a pile of garbage toward the rear and to one side of the property. Again it has a small insulating thimble through the roof where the stave goes through the roof. The stove pipe is bent and has a poor connection just inside and under the roof. It is blackened around the bend with considerable soot, which shows a definate smoke leak. The cabin is lined with building paper, which has fallen down in several spots. Has one electrical drop inside with a very amateurish splice on a fixed drop cord to go to a second small sleeping room to the side. To the rear of these two cabins, the outdoor toilet these occupants are using at the present time has very inadequate facilities, with holes unscreened at the top and at the side. The side hole being just above the ground and under the seat of the interior. There were a number of flies around at the time I pictured this toilet from every angle. The weeds' which were formerly around this property at 504 Elgin have been cleaned up and at the present time present no fire hazard themselves. 122 Elgin, Property belonging to Ned W. Cunningham, Box 212, Route 2, Oregon City, Oregon. This property is presently not occupied. On August 18th, accompanied by Fire Chief Paddock, I examined the property at 122 Elgin and found and pictured the following situation¢ As we went into the front', of the house, the first thing I observed was the fact that the chimney was set on studs or blocks from the floor of the house, instead of to the required concrete slab base. Also in examining the house, I found a number of amateurish wiring splices, a number of them untaped. Wiring had been strung around and not fasten —' ed down. I pictured two examples of the wiring and the chimney. Found that the interior of the house had been badly torn up and was in bad repair. The door leading to the basement portion of the house was loose on its hinges, and considerable amount of debris had been thrown down the steps and into the basement at this time. There was water standing on the floor of the basement. I was unable to get down to it to deter— mine the depth. It appeared to be an inch or so. Further examination of the premises showed that the sink drain runs directly out to the side of the house into an open ditch. The fuse box to the rear of the house contained a number of over — ampered fuses. One blown fuse, when removed, had a penny behind it. At this time,i; the Fire Chief made out a citation condemning the wiring of the house for further use without repair and removed the meter to the Idaho Power Co. Further examination shows an outdoor toilet. It seems to be in use at the present. No indoor plumbing of and kind. There are three cabins built on the rear of this property, one of them contsiAe9 a stove and a bed. The stove pipe from this stove runs out through the front wall of the shed type building with just an elbow to turn up on the outside. y3 The interior of these cabins were lined with paste board boxes. It would be very hazardous for occupancy if any fire were built in this stove. There was considerable weeds and garbage piled to the rear of the lot. V On September 3, 1958, I, accompanied by Charles Esmond, Health Officer, re- examined this same property and found the same condition still exists, even to the weed piles and garbage piled to the rear of the lot. Took a few additional pictures. In one of them I tried to show what appears to be a rat burrow unde the side into the outdoor toilet. There were some rat signs around this area at this time. I II 118 Elgin, owned by Bill Bartrop, On August 11, 1958, at approximately 5 PU I examined and took several pictures of this property. There is a lot of trash and debris piled all the way around this house and weeds all over the lot. There . are rabbit hutches and chicken pens in back of the house and due to the dirt, filth, and trash, this house seems to be unfit for habitation. On September 3, 1958, I, accompanied by Charles Hammond, Health Officer, re- examined this property Found the trash conditions were not noticeably changed. Took additional pictures. One of them showing the interior of the outdoor toilet at this property, which is completely unusable in its present state. The toilet is the WPA type and is full to overflowing at the seat. Stacked around the seat are a number of cans and buckets, which are completely full to overflowing. The toilet showed some use outside and to the rear. Hammond, Supervising Sanitarian SUBJECT: Sanitary Survey of residence located at 5011 Elgin Caldwell, Idaho DEAR SIR: This survey was conducted on September 3, 1958. I was accompanied by Lt. Elwood Siegmann of the iCaldwell Police Department. My findings follow: Three dwellings occupy this lot - 502,502z,and 504 Elgin,owned by W. E. Pendergrass. 1. On the lot, as a whole, there was considerable rubbish and garbage scattered throughout, with the possibility of rat harborage beneath the house that is listed as 502 and a log pile that is located on the ,rear of the lot. 2. There are two outside toilets located on.the rear of the lot - both are kept locked. Neither toilet ris of the "sanitary privy" type construction. One vault was open to the outside air, increasing the possibil- ity of rat harborage and of .flies entering and leaving. vaults on these toilets were.both full and no covers °.were available for the seats. 3. Garbage is not stored in covered containers. - � a public health view, I consider the above residence to be in such an unsanitary condition as to Jeopar- dize the public health of the community. Hammond, Supervising Sanitarian ' SUBJECT& Sanitary Survey of residence located at 122 Elgin, Caldwell, Idaho. DEAR SIR: a This survey was conducted on September 3, 1958- I was accompanied by Lt. Elwood Siegmann of the Caldwell Police Department. My findings follow! This house was not occuped at the time of the survey. 1. Garbage and rubbish was scattered and piled in and about the yard, constituting an excellent food ,supply for rodents. - 2. Drainage from the inside sink runs through the outside wall and onto the top of the ground, which .;would make a possible breeding area for flies and mosquitoes and a water supply for rodents. 3. The basement of the house contains' water, with some garbage and rubbish thrown into the basement, .constitnting a very serious health hazard. 4. Outside toilet is not of the "sanitary privy" type. This toilet is not fly proof and rodent proof. There is evidence of one rat burrow going from the outside down into the vault of the toilet. Sanitarian i SUBJECT: Sanitary Survey of residence located at 118 Elgin, Caldwell, Idaho. DEAR SIR: I This survey was conducted on September 3, 1958. I was accompanied by Elwood Siegmann of the Caldwell Police Department. My findings follow: This property is owned by Bill Bartrop. This was one of numerous visits that have been made withinil the last two years. There is no appreciable difference in the sanitary condition of the premises now than i there was two years ago, except for general deterioration around the house and yard. 1. Rubbish, boards and junk in general is scattered, making it possible for excellent rodent harbcrag with available food and water adjacent to the harborage. 2. The toilet is of the -sanitary privy" type, but has deteriorated to such a condition that at the present time it is not fly proof or rodent proof. The vault is completely full, with fecal matter running from the top of the riser to the floor of the toilet. There is evidence of urination and fecal matter aroundl, the outside and behind the toilet. 3. Garbage is not stored in covered containers. From a public health view, I consider the above residence to be in such an unsanitary condition as to jeopardize the public health of the community. CJH:mpr Sincerely yours, /3/ C. J. Hammond District Supervision Sanitarian 17 October 1958 Keith Judd Chief of Police Caldwell, Idaho Dear Sir; At the request of the Caldwell Police Department, I accompanied Police Officer Elwood Siegmann to the property at 504 Elgin St., Caldwell, Idaho, for the purpose of making a fire inspection. On this property were two rental cabins listed as owned by W. E. Pendergrass. Regarding the cabin facing Elgin Street, the flue, which is connected to the stove in use, is construct— ad out of a combination of irrdgation tile and stove pipe. It is sub— standard and will not meet Caldwell's Building Code. The electrical wiring inside the cabin was not visible. The service entrance is sub— standard.i' The service is not grounded at the meter. The fuse block and disconnect are in such a state of repair they l would be dangerous for anyone trying to turn off service to the cabin. The cabin in the back of the lots at the same location has the following conditions: 1. A flue made of stove pipe, which is sub— standard regards our present building code. 2. Extension cords in the cabin were in a worn and dangerous condition. This inspection was performed the 3rd day of September, 1958- Sincerely yours, /S/ W. A. Paddock Fire Chief Caldwell, Idaho WAP:mpr Keith Judd Chief of Police Caldwell, Idaho Dear Sir: 16 October 1958 On August 18, 1958, at the request of the Caldwell Police Department, I accompanied Police Officer Elwood Siegmann to 122 Elgin Street to make an inspection of the premises with regards to fire hazards. The fallowing conditions were found to exist: �. r 1. Additional outlets were wired into the wiring system with wire that didn't conform to the electril cal code for this use, ending in a box for a receptacle outlet on partitions and outside walls. Where this wire was connected to the main wiring system, the joints were unsoldered and unproperly taped in.I 2. This is a knob and tube wiring job, Some of the wires were lying loose on the ceiling ,joists. The main Junction box contained fusee that were oversize for the wires they were protecting. One 20 ampere fuse was burned out and the circuit had been reactivated by placing a penny behind it. 3, The glass on the meter was broken, apparently by a blow of an instrument such as a rock being thrown at it. Because of the above conditions, I issued a violation notice. At the same time, I removed the meter so as to avoid further damage and returned it to the Idaho Power Company office. 4. The framework of this structure is sound, but the rest of the house is run down to the extent that repairs are needed. 5. Outbuildings and yards — The accumulations of dry grass and weeds around and near the house and outbuildings did constitute a fire hazard if they were ignited. There were rooms in the outbuildings next to y3� the alley that apparently had been repaired at soma time. Some rooms were lined with cardboard. One room !i contained a stove and bed. The flue was a stove pipe with elbows running through the side wall. The above conditions increase the likelihood of loss due to fire. TAP:mpr These reports were studied by the 'ouncil. A- Paddock Fire Chief J The City Attorney advised the Council the City has the power to condemn properties for Health and Sanitary hazards, and to give thirty day written ft notice to owners setting forth conditions that would have to be corrected. Chief of Police recommended a policy be adopted by the c ouncil to abate Health and Sanitary he Moved by Vassar, seconded by ° horb the Chief of Police be authorized to issue notice to property owners of Health and Sanitation hazards, but, notice cendemningnroperty should come from the Council. Upon Roll Call it appeared the motion was unanimously carried. Councilman "horb and Nancy Jarvis, Librarian discussed the City's connection with the Library in regards to finance, also the manner in which the supply - vouchers were handled. Councilman Eldredge recommended this matter be given Council study and discussed at a later meet. This recommendation was aooroved by the Council. Mayor Simio rman presented the following recommendations on the Rodeo Grounds: RECOMMEPIDA' -"ION TO 1HE CITY COUNCIL FROM THE MAYOR SUBd Ki: RODEO GROUNDS That the Rodeo Board be allowed to use the present location and facilities thru the 1961 Rodeo or until such time as the three unit armory is built in Caldwell, but in no wise to exceed 5 years. That the City require no money to be spent on the present facilities above the amount necessary from the standpoint of safety, but rather on securing a location and making preparation to move. That at time of moving, if a suitable site and facilities are planned, all the present facilities including the Cavalry Barn be given to the "odeo Board to be used as they see fit. - That the area neaoccupied by the rodeo grounds, softball park, Cavalry Barn, and carnival site be set apart and dedicated to Armory te parking s ace ark and - la T'Y , P � P , P play- ground. That during such time as the Rodeo Board continues to use the present facilities, tAey will to the satisfaction of the City spray for insects, and weeds; and sprinkle such areas as may create a dust problem. That the use by the Rodeo Board shall not in any way limit the use of the Cavtlry Barn by military units of the National Buard, or of the United States, nor what use has been made of the premises by civic groups and the City. �i That the Rodeo Board allow no stock to be held there on the premises more than two days before or after the Rodeo. That in consideration for the use of the area and facilities for this period of time the Rodeo be aked to sign an agreement to acquire property andstart making plans to move, and following each rodeo they submit to the Council a written progress moort. These recommendations were discussed. Councilm an Vassar: Rodeo grounds should be moved and I feel the Rodeo Board will not cooperate. Councilman Eldredge: The business men of Caldwell should have a definite interest in this Rodeo situation and I am sure tPey will want to work out a solution on this rodeo problem. ii Councilman Finley: All of the Rodeo ooard members will not sanction repairing the present Rodeo 'buildings and grounds. I recommend the Cavalary Barn be used for Four H Clubs if Rodeo is moved. Mayors One of the obstacles would be moving the bleaahers...I feel the ideal location for the Rodeo is the property near the Airoort where there is ample space for expansion. Councilman Luby: Members of the Golf Club are unhappy regarding the present location of the Rodeo 'IGrounds Councilman Blomquist: Why is it necessary to move the Rodeo Grounds? I feel the Rodeo will die Iif required to move also the Rodeo Grounds are used approximately ten months a year by the riding clubs. Mayor: I alone am resionsible for thesereco:mnendations. Councilman Eldredge: I think the City Attorney should give an opinion regarding the right of th$ City to dispose of the Cavalary Barn. Ili Councilman Shorb: The Rodeo Board should have ample time to move the rodeo. What are the recommendations of the Planning Commission? Dr. Stecker: The Planning Commission does not want to kill the Rodeo but the present location 'l is not the place for a Rodeo. We do not want to see the Rodeo Board throw up their hauls and quit. The concensus of opinion is the present location would not be adequate in a few years. Moved by Finley the recommendations of the Mayor be accepted. Councilman Shorb: Plenty of time should be given the Rodeo Board to make arrangements. Councilman Blomquist: It would cost the Rodeo Board $24,000 to acquire the land near the Airport. Councilman Eldredge: I do not think we should adopt recommendations by Mayor at this time. Above motion withdrawn by Councilman Finley. The Council again discussed the recommendations and the following modified recommendations were proposed: That the Rodeo Board be allowed to use the presentlocation and facilities thru the 1961 rodeol or until such time as the proposed armory is built in Caldwell, but in no wise to exceed 5 years. That the City require no money to be spent on the present facilities above the amount nec -ii essary from the standpoint of safety, but rather on securing a location and making preparation „ to move. That at the time of moving, if a suitable site and facilities are planned, all the present facilities including the Cavalry Barn be given to the Rodeo Board to be used as they see fit, providing in the opinion of the City Attorney such property can be given to the Board. That the Council adopt the following as a policy: the area now occupied by the rodeo grounds, softball park, Cavalry Barn, and carnival site be set apart and dedicated to Armory site, parking space, park and playground. That the Rodeo Board provide the following services while they continue to use the grounds. it They will to the satisfaction of the City spray for insects, and weeds: and sprinkle such areas as may create a dust problem. The "Modified Recommendations" were discussed by the Mayor and Council. Whereupon it was moved by Councilman Finley, seconded by councilman Vassar the "Modified Recommend ations ° be accepted and used as a basis for negotiations with the Rodeo Board. The following letter was read rrcm the Canyon County Sheriff's Posse and ordered spread on the nutes: October 15, 1958 Mayor Ed Simmerman Caldwell, Idaho Dear 1 Simmerman: Our nroup understands that a plan is underway to move the Caldwell Rodeo Grounds. �j We sincerely hope that some solution can be found whereby the roceo grounds can be maintained at its present location and he renovated until such time that the ;I Rodeo Board can afford to build a new arena. { I ' Our group is very grateful to the Caldwell Night Rodeo Board as we feel that �I we have developed the Canyon County Sheriff's Posse to one of the finest groups of this type in the Northwest also feel that it has been a credit to Caldwell and Canyon County, but we could not have accomplished our recogxLtion if it had not been for the use of the Caldwell Rodeo Grounds. Ifth rodeo should be discontinued, -it would certainly work a hardship on our group as we would not have a facilutated place where we could practice, and if we cannot practice our drills, our roup will automatically lose a great percentage of its usefulness. I Also, we feel that the use of the Arena by the Junior Riding Club is very im- portant to the young people of Caldwell and surrounding area as a recreational �! program. l i{ Therefore, we urge you to give serious consideration in this matter as the Arena has many other uses besides the rodeo.
