Page 211 The Roll of the City Council was called with the following members present: McCloskey, Olesen, Williams, Raymond. Absent: Banks and Bauman. (REPORT OF McCLUSKEY REGARDING MEETING OF COMMUNITY RESOURCE) Councilman McCluskey stated that he, along with the Mayor and Councilwoman Williams, attended a Community Resource Meeting last week and the discussion did include some comments regarding the plans for remodeling the old Jefferson Junior High School. The County evidently has felt that the City of Caldwell intended to go in with the County in respect to Police facilities. Councilman McCluskey stated that it was his feeling that the City had made no decision at all regarding the County's proposal. (CERTIFICATE OF OCCUPANCY) The Mayor had copies of two paragraphs from the City Code that he presented to the members of the City Council for their study before next week's City Council Meeting. (CATERING PERMIT - ELKS LODGE FOR AIRPORT OPENING) The Mayor presented this application for a catering permit requested by the Elks Club to cater the hangar dance at the new airport on Friday, October 15th. All members of the City Council were contacted regarding this catering permit and the Chief of Police gave his approval. MOVED by Williams, SECONDED by McCluskey that this Catering Permit be granted to the Elks Club for the dance to be held at the New Airport opening on October 15, 1976. MOTION CARRIED (STADIUM LEASE) The Mayor stated that all members of the City Council had received copies of this lease for their study. The Mayor further explained that the School Board meets on Monday night and they would like to have the lease to present to their Board at that time. If they can present the lease to their Board on Monday night, a Resolution could then be presented to the City Council on Tuesday night. The Committee of Councilwoman Williams and Councilman Raymond have gone over the lease and the correctionswere included on the copy given to the members at this time. Another lease will have to be composed for the Caldwell Rodeo Board which the City Attorney was working on at that time. MOVED by Raymond, SECONDED by McCluskey that the Mayor be given approval to submit the proposed lease to the School Board for presentation at their Board-Meeting on Monday night. (DISCUSSION REGARDING TREE ORDINANCE) MOTION CARRIED The Mayor explained that the main reason for the calling of this meeting was to discuss the proposed Tree Ordinance. The first reading was held at the last City Council Meeting before any of the Council had had an opportunity to read through the Ordinance and study it. Since reading through it, there had developed Book 17 Page 212 some opposition to the Ordinance from some members of the City Council and from the Mayor as well. Some members of the City Council had also voiced an objection to discussing it at this Meeting due to the fact that Councilwoman Bauman was out of town and she was the sponsor of the Ordinance and had worked many hours on it. The Mayor further explained that he had invited Kenney Roberts as a Representative from the Beautification Commission and Jess Payne of the Parts Department to answer questions during the discussion. The Mayor then asked if the City Council would start the discussion at that time. Councilman Olesen stated that he felt it would be a waste of ev , 2xyone's time to discuss this Ordinance at this time.as Councilwoman Bauman had spent hours working on this Ordinance. Councilman Olesen further said that the Ordinance should be tabled for discussion and consideration until Councilwoman Bauman was present. Councilman McCluskey agreed with Councilman Olesen and stated that he -felt the Ordinance was somewhat cut and dried until he had read it thoroughly. MOVED by Olesen, SECONDED by McCluskey that this discussion regarding the proposed Tree Ordinance be tabled until Councilwoman Bauman was present. The Mayor requested permission to ask Kenny Roberts if he had anything to say regarding the Ordinance. Mr. Roberts stated that he felt Councilman Olesen was right. Councilwoman Bauman worked very hard on the Ordinance and he also felt that she should be present. Councilman'Raymond called for a point of order and stated that he had comments that he would like to make too, but it was not a debatable motion and now they were talking about a variation of the motion to table. The Mayor then stated that they would vote on the motion and then have the discussion following the vote. MOTION CARRIED Jess Payne explained the importance he felt in getting this tree problem under control as soon as possible. The Mayor felt that a lot of work had gone into this proposed Ordinance and that it should not be rushed through. He suggested that a Special Meeting be called again to discuss it before the second reading was held. He felt the Ordinance had a lot of good points, but it did need to be gone over and changes made. Again, Councilman Olesen stated that it should be dropped for now until Councilwoman Bauman was present. The meeting was adjourned so a discussion could be held.
