REGULAR MEETING

The Meeting was called to order by Council President Alta E.
Williams due to the absence of Mayor McCluskey as he was ill.
Council President Williams requested that everyone stand and Pledge
Allegiance to the Flag.
The Roll of the City Council was called with the following members
present: Raymond, Mallea, Hopper, Carter, and Betts. Absent:
Mayor McCluskey.
(APPROVAL OF MINUTES)
It was MOVED by Hopper, SECONDED by Carter to dispense with the
reading of the minutes of the Regular City Council Meeting of
September 16, 1980, the Regular City Council Meeting of September 23,
1980, and the Regular City Council Meeting of September 30, 1980,
and approve them as written.
MOTION CARRIE
(AUDIENCE PARTICIPATION)
Council President Williams asked if there was anyone from the
audience who cared to bring anything before the City Council that
was not on the prepared Agenda. Since there was no one, Council,-
president Williams declared that the Meeting would continue as
outlined on the Agenda.
OLD BUSINESS
(BLOCK GRANT PRIORITIES}
Mr. Lewis, the City Engineer, was recognized and gave a report on
the status of the block grant street project which is attached to
these minutes. It was Mr. Lewis's request that the City Council
members give this report some study and determine within the next
couple of weeks their decision as to priorities of the plan and any
chap es that they might give consideration to Mr. Lewis further
commented that they would be ready to work in early spring and would
let bids sometime this winter.
(INTEREST RATE ON BONDS)
Council President Williams informed the City Council that 'there was
a note from ':ors. Talley regarding a report from Rich 1 1 1 4ichaels,
Municipal Bond Officer for Idaho First Nat:ion�.i G::.I< The last bonds
sold were as follows: Boise Airport 9.250, University of Idaho
Ada Highway District 9.5 %, Boise City 9.620, Sandpoint 10.5%, and
Idaho Falls 8%. It was Mr. Michael's opinion that the City would
have trouble at 7% now because of the interest rates. He felt that
9% was more feasible. He also suggested increments; for instance;
first five years at 80, the second five years at 8.50, and the third
five years at 90.
The Council discussed the interest rate at some length. The City
Treasurer stated that there had been some inquiries from people who
already have bonds, but there was only one family that showed any
interest at all in purchasing at the 7% interest rate.
Councilman Hopper said that the escalating scale sounded interesting,
but he wondered if it would be feasible at the monetary amount of
$30,000.00. He further commented that where 7% might be a bit under
the market, he would hesitate to go to 9 He felt that Municipal
Bonds had an attraction themselves and did not need to get too close
to other money investments.
It was then MOVED by Hopper, SECONDED by Raymond that an eight percent
interest rate be accepted for L.T.D. 80.

(BID OPENING FOR L.I.D. 80)
Council President Williams called on the City Engineer, Mr. Lewis,
to open the bids for L.I.D. 80 for the construction work on IIillcres
Avenue and some on Georgia Avenue.
Mr. Lewis was recognized and stated that he would read the total
on each bid and they were as follows:
Boise Paving and Asphalt of Boise $ 21,860.99
There was a bid bond in the amount
of 5% of the bid, the proposal was
executed, and the Idaho Public Works
License number was shown.
Concrete Placing Company of Boise 22,430.80
There was a bid bond in the amount of
5% of the bid, the proposal was
executed, and Idaho Public Works License
shown.
Idaho Sand and Gravel of Caldwell 20,015.97
There was a bid bond in the amount of
50 of the bid, the proposal was executed
and the Idaho Public Works License number
shown.
J. M. IIess Construction of Nampa 22,244.00
There was a bid bond in the amount of
50 of the bid, the proposal was
executed and the Idaho Public Works
License number shown.
Nay Concrete Construction of Nampa 20,291.25
There was a bid bond in the amount of
5% of the bid, the proposal was executed
and the Idaho Public Works .License
number shown.
Mr. Lewis recommended that the bids be taken under advisement, but
he would like to have a decision as soon as possible as the job was
to be completed by November 14th.
MOVED by Carter, SECONDED by Hopper that the low bid of Idaho Sand
and Gravel in the amount of $20,015.97 be accepted subject to the
approval by the Bid Committee and the Engineering Department,

NEW BUSINESS
CREQUEST FOR ADDITION TO THE AGENDA)
Council President Williams stated that she would ask permission of
the City Council to add one item to the Agenda. This was with regard
to the arbitration with VIPCO.
MOVED by Hopper, SECONDED by Carter that permission be given for
the addition of this item to the prepared Agenda.

(REQUEST TO ATTEND FIRE AND ARSON SCHOOL)
Council President Williams read the following request submitted to
the Mayor and City Council by the Fire Chief:
A three day Fire and Arson Investigators and Fire Service
Training Seminar will be conducted and accredited by the
National Fire Academy at Boise State University on November
4, 5, and 6, 1980, from 8:00 a.m. to 4:00 p.m. daily.
I would like to send four (4) firefighters to the seminar.
Attendance will be limited to the first 160 applicants, so if

it would be possible to let these firefighters attend, I will
need to know as soon as possible so I can send in their
preregistration.
There will not be a registration fee this year as all class
material and instructors costs will be paid by the National
Fire Academy.
The cost to the City of Caldwell would be approximately ninety -
five dollars ($95.00) for all four firefighters to attend.
Councilman Betts was recognized and inquired as to what the ninety -
five dollars was for if there was no registration fee.
The Fire Chief stated that there would be diplomas presented and
also college credits as well as lunch for the men. The Chief also
said that they hoped to work it out so they would not have to bring
any extra men in that were off duty while the four men were gone.
The City Council discussed this request and it was the concensus
of the Council that it would be a good idea to send the four men.
MOVED by Hopper, SECONDED by Raymond that permission be given to
send the four firefighters to the three day Fire and Arson
Investigators and Fire Service Training Seminar to be held at
Boise State University on November 4, 5, and 6 at a cost of ninety -
five dollars and that a written report be submitted.

(RESOLUTION NO. 55 -80 - AGREEMENT WITH DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT)
Council President Williams read Resolution No. 55 -80 in full as
follows:
RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
GRANT AGREEMENT FOR THE CITY OF CALDWELL WITH THE DEPARTMENT
OF HOUSING AND URBAN DEVELOPMENT,
BE IT RESOLVED That the Mayor and City Clerk of the City
of Caldwell be, and the same hereby are, authorized to execute
that certain Grant Agreement attached hereto and made a part
hereof as if set forth in full for the City of Caldwell to the
Department of Housing and Urban Development for a grant for
housing rehabilitation and sewer and street improvements in the
amount of $500,000.00.
MOVED by Raymond, SECONDED by Betts that Resolution No. 55 -80 be
passed as presented by Council President Williams.
Roll call vote. Those voting yes: Raymond, Mallea, Hopper, Carter,
and Betts. Those voting no: none. Absent and not voting: none.

(REQUEST FOR REHAB TRAINING FOR NELL WOLFE)
Council President Williams read the following notice from the
Department of Housing and Urban Development:
Grantees who have rehabilitation programs are encouraged to
attend the workshop being held at the Portland Hilton, October
16th and 17th. There is no charge for the workshop, itself,
It is being put on by HUD's Community Rehabilitation Training
Center. Any costs of travel or hotel are chargeable to Block
Grant funds.
If you will attend but have not sent in a registration form on
a previous notice from the training center, please call or
write the Portland Area Office, Area Code 503 - 221 -4106. Mr.
Lowther and Mrs. Walker will take your calls. If they are
unavailable, please leave the information with whoever answers
the telephone.

Council President Williams informed the Council that the cost of this
training would be $337.00 and it was requested that Nell Wolfe be
allowed to attend this workshop.
MOVED by Raymond, SECONDED by Carter that Nell Wolfe be allowed to
attend this workshop in Portland on October 16th and 17th to be
financed out of the Block Grant funds.

(CATERING PERMITS)
The City Clerk presented two catering permits for approval. Both
were requested by the Eagles Lodge to be catered by the Cimarron;
one on October 11th and. the other on October 18th. Both permits `
were for benefit dances; the Chief of Police has given his approval
and the fee was paid to the Office of the City Clerk.
MOVED by Hopper, SECONDED by Mallea that permission be given for
the issuance of both of the catering permits as presented by the
City Clerk.

(RESOLUTION NO. 56.80 - ACCEPTANCE OF AN EASEMENT)
Council President Williams called on the City Engineer to present thi.
easement. Mr. Lewis was recognized and explained that this was an
underground power easement to the facilities at the new treatment
plant. This was essentially coming into the Plant along a, road
internally near the Northeast corner. He had checked it out with
the inspector and it does not interfere with any location of
facilities. It was his recommendation that the Mayor and Clerk be
authorized to sign it.
The Resolution was then. read in full by Council President Williams
as follows:
RESOLUTION AUTHORIZING MAYOR AND CITY CLERK TO EXECUTE AN
EASEMENT BETWEEN THE CITY OF C;ALDWELL AND THE IDAI -10 POWER
COMPANY
BE IT RESOLVED That the Mayor and City Clerk of the City
of Caldwell be, and the same hereby are, authorized to execute
that certain easement for electric service facilities to the
Wastewater Treatment Plant.
MOVED by Hopper, SECONDED by Carter that Resolution No. 56 -80 be
passed authorizing the execution of an easement between. the City of
Caldwell and the Idaho Power Company.
Roll call vote. Those voting yes: Hopper, Carter, Betts, Raymond,
and Mallea. Those voting no: none. Absent and not voting: none.
MOTION CARRIED
Mr. Lewis stated that he would comment that there was two night
guard lights out there and the Power Company wanted to know if the
city of Caldwell wanted. to continue those. If the City does, it will
require a special transformer and the rates will go up. It was
the City Engineer's opinion that the City inform the Power Company
that after the plant was in force the lights will not be needed
as the internal lighting within the plant would be sufficient.
(ARBITRATION WITH VIPCO)
Council President Williams informed the City Council that the City
Attorney stated that the Council was to be advised with regard to
the arbitration with VIPCO which was scheduled for November 5th in
Boise. Council President Williams said that she would suggest that
the Council postpone this item until the Mayor returned as she was
not familiar with any of it as the City Attorney had talked with the
Mayor.

MOVED by Betts, SECONDED by Carter that this item be postponed until.
the next Tuesday noon Regular City Council Meeting.

(OFFER FOR TRADE ON CITY HALL BY MR. WAR]lEN)
Council President Williams recognized Mr. Warren who was present at
the Council Meeting to discuss the possibilities of trading the City
Hall for the I.O.O.F. Hall. Mr. Warren had discussed this with the
Mayor previously and at this time requested that he be allowed to
present informally his idea regarding the offer. Mr. Warren then
explained to the Council at some length the possibilities of this
trade being accomplished.
Council President Williams stated that she would like to speak with
regard to this offer as a Council member. She could see several
things against the trade; the first was a parking problem and the
other was no money to remodel. Also brought to Mr. Warren's attention
was the need for the City Hall to be on ground level.
After a great deal of discussion, it was determined that some study
would be given to this offer and that the Mayor would talk with Mr.
Warren. Mr. Warren did express the hope that the Mayor and Council
members would. at least walk through the building to see if the plan
was at all feasible.
(COMMITTEE REPORTS)
Councilwoman Mallea reported that she attended the Recreation
Commission meeting and they were very disappointed as they did not
receive grant monies to buy the blanket to coverthe pool. They did
say that they would like some direction from the City as to what
plans to proceed with regarding parks, activities, and etc. They
were at a stalemate having finished Wilson Park and were looking for
direction from the City Council as to what project should be
pursued now. The Commission also wanted the Council to entertain
another suggestion which was the naming of the old Jefferson Field..
They were planning to present a name to the City Council in the near
future.
Councilwoman Mallea also stated that she attended the Library Board
Meeting and all was running great as usual. Their CETA program was
running out and they were trying to get a renewal.
Councilman Raymond stated that he would like to report a situation
that occurred downtown on North Kimball the day before. I-Ie told
Council members that an extra long train was stopped on North Kimball
with the engine very near the crossing. He thought that the train
probably extended to Twenty first Street. He was able to cross in
front of the engine, but when he returned in about twenty minutes the
train was still there. It did move back and forth some, but he was
sure that it was forty minutes before the track was cleared. Council-
man Raymond stated that he called the Union Pacific in Nampa and they
seemed to know nothing about the train. He also called the Police
Department in Caldwell to see if a citation could be issued. Council-
man Raymond felt that this was not a good situation and would talk to
the Mayor about it.
Councilman Raymond also reported that he attended the Retail Merchant's
luncheon and that they were a very active group. They were concerned
about the downtown cleanup and he felt there would be a lot of
activity with this in the near future. They talked about the
possibility of having garbage receptacle in the downtown area to
help keep the litter off the streets. There was also a new group
organizing that was called the Miracle Mile which was out towards
Nampa on Cleveland. There was nearly thirty merchants signed up and
they planned to advertise their part of Caldwell.
Councilwoman Williams commented how nice the Chamber Banquet was
this year and congratulated Councilman Betts for being chosen the

J.C. Distinguished Young .Man of the Year Award.
(DEEDS AND EASEMENTS)
The City Engineer reported that he had a Deed and three Easements
to present to the City Council for acceptance. The Deed was from
Mr. Giardina for the East half of most of Marshall two blocks South
of Ash. He filed a covenant that he will participate in sewer
and will plat it. There was a School District easement for the sewer
to Southdale; also an easement for water and sewer lines within
the Southdale property. IT wa:s the City Engineer's recommendation
that the City Council accept the easjements and the deed and
instruct the City ClerI< to record the same.
MOVED by Carter, SECONDED by Betts that the easements and deed as
presented by th.e City Engineer be accepted and that the City Clerk
be instructed to record them.
MOTION CARRIED
Council President Williams stated that the Council would convene
into a short meeting to discuss some personnel problems.
There being no further business, the Meeting was adjourned at
8:45 p.m.
