The prope -ty tc be so conveyed and exchanged, as set forth herein, is described as follows: I rj A tract of land situated in the Southwest buarter of Section 21, Township 4 North, Range 3 West of the Boise Meridian in Canyon County, Idaho, more particularly described as follows: Commencing at the Northeast corner of the Southwest Quarter of Section 21, Township 4 'I North, Range 3 West of the Boise Meridian; running thence South a distance of 1172.3 feet along the East boundary of aforesaid °outhwest Quarter; thence running West and parallel to the South boundary of the right -of -way of the Wilder Branch of the Oregon Shortline Rail - road a distance of 660 feet to the TRUE POINT OF BEGINNING; thence West amd parallel to the South boundary of aforesaid right -of -way a distance of 310 feet; thence South and parallel to the East line of aforesaid Southwest Quarter a distance of 410 feet; thence Fast and j parallel to the South boundary of aforesaid Railroad right -of -way a distance of 310 feet 11 thence North and parallel to the East boundary of aforesaid Southwest Quarter a distance of Ij fe 1 410 et to the point of beginning. li Upon Roll Call those voting in the affirmative were: Vassar, Blomquist, Luby, Shorb, Eldredge III and Finley. Negative: None. Absent and not voting: None. Thereupon the Mayor declared the motion carried and the Resolution adopted. Councilman Eldredge recommended the C. A. A. be notified of this exchange. Moved by Luby, seconded by Finley the City Attorney prepare an option showing the right of Chas Il i ichols to lease cemetery land from year to year, this to meet with Federal Administration regulations. it Upon Roll Call it appeared the motion was unanimously carried. The Re >ular Monthly Meeting of the City Council at in the Council Room of the City Hall, with the Mayor Ed Simmerman presiding. i Upon Roll Call the following Councilmen answered present: E. L. Vassar, Fran Blomquisty Max Luby, ,I Emile Shorb, L. P. Eldredge and Leland Finley. I 11 Applications for Card Licenses were read from R. W. Jasper, Waldorf Cigar Store and V. F. W. Club, '. I II the fee accompanying each application. Moved by Blomquist, seconded by Luby these Licenses oe granted. Upon Roll Call it appeared the motion was unanimously carried. Application for Pool License was read from Waldorf Cigar Store, the fee accompanying the application. Moved by Blomquist, seconded by Luby this License be granted. Upon Roll Call it a,neared the motion was unanimously carried. Police and Fire reports for September were read. The following letter was read and ordered spread on the Minutes: ; TO THE MAYOR AND COUNCIL OF THE CITY OF CAL1,W,LL CP_LLWELL, IDAHO GENTLEVEN: I On or before the 4th day of September, 1958, 1 was driving my automobile Westerly on Linden Street in the City of Caldwell , at about 4:00 o'clock A. M., and collided a th a pile of oil and gravel which was piled in the center of the road at the intersection of Linden and M:mtana venue. ii This pile of gravel end oil was unmarked, with no flares or lights on it. As a result of the collisio I received damages to my automobile, a 1958 'Iymouth, in the sum of TWEHTY- THREE § 50/100 ($23.50) LOLLARS, for which sum I now make claim of the City of Caldwell. i Dated this 15th day of September, 1958. /s/ Don L. Owen It was unanimously agreed the claim be denied and referred to the Lewellen Insurance Agency. The following letters were read and ordered spread on the Minutes. October 6, 1958 Mayor City Council i Caldwell, Idaho Gentlemen: The Caldwell Night Rodeo board wishes to submit to you a plan for the improvement of the present Caldwell Night Rodeo site: 1. Construction of an eight foot solid board fence replacing the present board fence. This to include the resurfacing of the back of the grandstand. Painting of both the fence and the grandstand. 2. The provision for adequate dust control facilities. 3. Spraying to control flies and other insects year round. With the complete rerencing and painting program the present rodeo structure will become an attractive asset rather than tho present unsightly one. The nrovl ^5 in of a.?ecuete dust control will bring about m & less opportunity for criticism of j the rodeo at its present site. The provisions for adequate fly control will eliminate complaints regarding health c ^nditions both at the adjoining nark and and the rodeo grounds. i The caldwell Night Rodeo board sincerely feel that with the above improvements and the many reasons already stated, that the Caldwell Night Rodeo should continue j operations at its present site. i! Respectfully, /s/ Ed Simmerman, President Caldi;yell Night Rodeo Board Ed Simmerman, Piayor City of Caldwell City Hall Caldwell, Idaho September 29, 1958 Dear Sir: The regular monthly meeting of the Caldwell Planning Commission was held in the Council Chambers of the City Hall on September 29, 1956- A motion was ia,sad that due to a pots =.ntial financial hardship on the Caldwell Rodeo Board, the Planning Commission wishes to modify its recommendations of July 25, 1958 for removal of the Ro. ^eo from its oresent location. The Planning Commission recommencs the immediate removal of the present objectionable conditions such as sanitary hazards, dust production and unsightly annearance and further recommends that acceptable structural changes be made on the present arena within the next year. Continued occgpancy of the present area should be c-ntingent u•on the presentation by the Caldwell Night Rodeo Board of an acceptable plan of improvement to the Cald- well City Council. Respectfully, /s/ Harvey 0. Hoff, Chairman Caldwell Planning Commission The Mayor informed the Council these letters would be discussed at the Council Meeting to be held October 15, 1958. The disposal of leaves was discussed. It was the consensus of opinion the fire chief should issue permits for burning leaves, also that ijburning of leaves should be confined to private property. The Mayor informed the Council this was the time not by notice for hearing protests to the exchange of certain tracts of land with the Chamber of Commerce. These were no protests filed. Thereupon the following Resolution was presented by Councilman Eldredge who moved the adoption :'thereof, which motion was seconded by Councilmab Blomeuist. RRSOLUTION By Councilman Eldredge r BE IT RESOLVO, The Mayor and City Clerk be authorized on behalf of the City of Caldwell to execute a deed to the Chamber of Commerce for Tract No. 1, situated in the Southwest Quarter of Section 21, Township I I �J I II 'r^ L North, Range 3 West of the Boise Meridian in Canyon County, Idaho. Upon Roll Call those voting in the affirmative were: Vassar, Blomquist, Luby, Shorb, Eldredge and Finley. Negative: None. Absent and not voting. None. i Thereupon the Mayor declared the motion carried and the Resolution adopted. The Mayor announced October 15, 1958,8:00 o'clock P. M., City Hall to hear Committee report on violations of the Zoning Ordinances of the City. The Mayor announced the appointment of E. Arlen Mendenhall as a member of the Mayor's Committee on Emoloyment of the Phys'_cally Handicapped and Older Workers I II hoved by Blomquist, seconded by Luby this appointment be confirmed. Upon Roll Call it appeared the motion was unanimously carried. II An Agreement between the Oregon ShortLine Railroad and the City of Caldwell was presented for renewal. - Thereapon the following Resolution was presented by Councilman Blomquist, who moved the adoption thereof., which motion was duly seconded by Councilman Shorb. Rl'S ^IhTICN By Councilman Blomquist BE IT RESOLVED, The Mayor and City Clerk be authorized on behalf of the City of Caldwell to enter into an agreement with the Oregon Shortline Railroad to maintain and operate a water oipe line cross— ing under the Caldwell Chamber of Commerce Spur. li Upon Roll Call those voting in the affirmative were: Vassar, Blomquist, Luby, Shorb, Eldredge and Finley. Negative: None. Absent and not voting: None. 9 Thereapon the Mayor declared the motion carried and the R adopted. Recommendations to combine the Recreation Board and Swimming Board were made by Councilmen Luby add Finley. Moved by Luby, seconded by Finley the City Attorney be instructed to prepare the necessary ,I papers to put t?is into effect. Upon Roll Call it aooeared the motion was unanimously carried. The following letter from Robt Jackson was read and ordered spread on toe Minutes: September 15, 1958 L Miller Western Bldg Caldwell, Idaho Dear Dean: Relative to your request concerning the stated balance of Taxes Receivable of the Armory Fund, I have found that the balance was understated by $1 When the adjustment was made at the end of your past fiscal year to adjust the balance of your taxes receivable to the amount per the operation tax ro}ls and the allocation made to the various funds, the corresponding error was made between the Road & Sprinkling Fund and the Armory Fund. This error accured due to the fact that there was no beginning balance of taxes receivable in the Armory Fund, and the Road & Sprinkling Fund Levy had bbwn changed when the one mill levy was allocated to the Armory. The adjustment required to correct the records, will be to chaXge or debit Armory Fund $p1505.52 and credit or reduce Road & Sprinkling Fund by the like amount. By Councilman Finley. i l l A RESOLUTION ACCEPTING THE ASSESSMENT ROLL OF LOCAL IKPROVO4MT DISTRICT NO. 45 FOR THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; AUTHORIZING THE CLERK TO GIVE iOTICE OF THE TIME AND PLACE FOR HEARING AND CONSIDERING OBJECTIONS TO THE SAID ASSES- 914E1T ROLL; FIXING THE TIME FOR HEARING AND CJNSIDERING SAID OB- JECTIO.IS AND PRESCRIBING THE FORM OF NOTICE. LiHEREAS, The assessment roll of Local Improvement District No. 45 for the City of Caldwell, k Canyon County, Idaho, has been completed in compliance with the provisions of the laws of the State of Idaho; in such cases made and provided, and the ordinances of the City of Caldwell, Canyon County, Idaho, said 11 assessment roll having been prepared and made out by the Committee on Streets, together with the City Engineer, containing the number of assessments, the name of the owner if known, and if not;known, that the it name is unknown, ad=_scription of each tract assess ed and the total amount of the assessments, and said li assessment roll having been so prepared was certified to the Council of the City of Caldwell by the Com- " mittee on Streets and the City Engineer. �II NOW, THEREFORE, BE IT FESJLVED by the Mayor and Council of the City of Caldwell,.Idaho: Section 1. Two bids were received and opened.from tke United States Appraisal Co, and General Appraisal Co. These were inferred to the ''ity Attorney and City Engin6i for study andreport back to Council. l i a Councilman Finley requested a check be made with Fire Underwriters to ascertain if an appraisal would be accepted made by a company without an Idaho license. i I,I This being the time set for receiving bids for codifying ordinances of the City of Caldwell. it There were no bids received. jl The Mayor recommended the City enter into a contract with Sterling Codifers of Weiser.
