That in accordance with the procedure provided in Section 4 -922 of the Caldwell Code of
1942;
(a) nie Ordinance as so proposed be submitted to the Board of Adjustment of the City of Caldwell, Idaho,
for its recommendation and report.
(b) A public hearing be held by the City Council of the City of Caldwell, Idaho at the Council Chambers
in the City Hall of said City of Caldwell on the 13th day of October, 1952, at the hour of 8:00 o'clock
P.M., Kountain Standard Time; and
(c) The City Clerk is hereby ordered and directed to give notice of said public hearing by publication
of a notice thereof in The Caldwell Kews- Tribune, a newspaper printed and published in the City of
Caldwell, Idaho, in two issues thereof published on September 25 and September 26, 1952.
Upon 'Roll Call those voting in the affinnative were: Blokquist, Burrell, Myers, Weick, Fenrich

Thereupon the Acting Mayor declared the motion carried and the Resolution adopted.

The Regular Monthly Meeting of the City Coucicil met in the Council Rooms of the City Hall,
with the Mayor Jason C. Smith presiding.
Upon Roll Call the following "ouncilmen answered present: Fran Blomquist, L. E. Burrell, John
Myers, Ernest Weick, Dale Fenrich and J. M. Bettis.
Application for Card License was read from The Sport Shop, the fee accompanying the application.
Moved by Myers, seconded by Weick that this License be granted.
Upon Roll Call it appeared the motion was unanimously carried.
Applications for Card and Pool License was read from Waldorf Cigar Store, the fee accompanying
the application.
Moved by Myers, seconded by Weick that this License be granted.
Upon Roll Call it appeared the motion was unanimously carried.

The following resolution was introduced by dyers, read in full and considered:
Resolution of the City of Caldwell, Idaho, accepting the Y'irst Amendment to the Grant Agreement
with the United States of America through the Civil Aeronautics Administration.
Be it resolved by the City Council of the City of Caldwell, Idaho:
SECTION 1. That the City of Caldwell shall accept the First Amendment to the Grant Agreement
with the Um ted States�of America.
SECTICW 11. That the Mayor of Caldwell is hereby authorized and ditected to sign the First
Amendment to the Grant Agreement in behalf of the City Clerk is hereby authorized and directed to attest
the signature of the Mayor and impress the official seal of the City of Caldwell on the aforesaid First
Amendment to the Grant Agreement. - _

'NMEREA5, The Administrator of Civil Aeronautics has determined that, in the interest of the United
States, the Grant Agreement between the Administrator of Civil Aeronautics, acting for and on behalf of
the United States, and the City of Calchvell, Idaho, accepted by said City of Caldwell, Idaho, on the 9th
day of June, 1952, should be amended as hereinafter provided:

That in consideration of the benefits to accrue to the parties hereto and further considerations
hereinafter enumerated, the Administrator of Civil Aeronautics, on behalf of the United States on the
one part, and the City of Caldwell, Idaho, on the other part, do hereby mutually agree as follows; that
1. The City of Caldwell, Idaho, is hereby released from all covenants contained in the Grant Agree
mentioned above and in Grant Agreements executed by the parties hereto on November 5, 1947,
September 8, 1948, and ctober 3, 1949, for Projects lion. 9 -10- 030 -701, 9- 10 -030- 702(902) and
9- 10-036 -903, respectively, pertaining to the follovring real property:
Commencing at the Northeast corner of the Northeast ! luarter (NE4) of the Southwest Quarter
(S91 of Section 21, Township 4 North MIT), Range 3 West (R3V) of the Boise Reridian (B.M.),
and running thence South along the East line of said f,'ortheast Quarter (NE of the South-
west Quarter (S4ld) a distance of 172.30 feet; thence hest and and narallel with the North line
of said Northeast Quarter (NE=-) of the Southwest suarter (317D a distance of 110.00 feet to
the real point of beginning; thence continuing 1 7est and parallel with the North line of said
Northeast Quarter (NE') of the Southwest Quarter (SP7;') a distance of 587.75 feet, a point

2. The City of Caldwell, Idaho, shall reserve - Xor the benefit of the public a right of flight
over the foregoing property ond shall not permit any structures or obstructions to be
constructed on said property of a hei :.ht greater than 150 feet. The City further covenants
that in the event this property is conveyed to other parties, the right of flight and the
height limitation shall be reserved to the City and to the public in the deed of conveyance
and that such rir�,ht of flight and height limitation shall run with the land.
It is hereby further understood and agreed that the maximum amount of the obligation of the United States
payable under said Grant Agreement shall not be increased by this Amendment.

moved by Blomquist, seconded by Fenrich that the rules requiring that the reading of a Bill on three
separate days be suspended and that Bill No 28, he read the second time by title and the third time in full,
section by section and placed on its final passage. The L'ayor directed the Clerk to call the roll on the
above motion with the following result: Those voting in the affirmative were: Blomquist, Burrell, Myers,
Weick, Fenrich and Bettis. Negative: None. Absent and not voting- None. The Mayor declared the motion
had passed by the necessary three - fourths majority and directed the Clerk to read Bill No ?8 the second
time by title and the thirc time in full section by section. The Clerk read the Bill as directed. The
question being "Shall Bill No 28 pass ?" The Mayor directed the Clerk to call the roll on the above question

NOW, 141EREFORE, Be it resolved by the liayor and Council of the City of Caldwell, Canyon County,
Idahos
Section 1. That it is herebv declared to be the intention of the L;ayor and Council of the City
of Caldwell, Canyon County, Idaho, to create and establish within said city a local improvement district
for sewer to be known as and called "Local Improvement District No. 20 for the City of Caldwell,"
Section 2. That said proposed improvement is an original improvement and the general character
or improvement to be made in the said proposed improvement district is the purchasing, building, and
constricting of sewers, ditches, drains, conduits and channels for sanitary and drainage purposes, or
either or both thereof, with outlets, cesspools, manholes, catch basins, flush tanks, septic tanks, and
all other sewer appurtenances necessary for the comfort, convenience, health and well -being of the muni-
cipality on hand contained in said improvement district, to be constructed of sewer title, Portland Cement,
concrete, earth, sand, gravel, stone and such excavation as may be necessary, all in accordance with the
plans and specifications therefor to be, hereafter adopted by the hayor and Council of the City of Caldwell

Section 4. That the estimated cost of said improvements herein provided for is !' 23,200.0
Section 5. That the cost and expense of the construction of said improvement shall be assessed
upon the abutting adjoining, contiguous and adjacent lots and lands benefited and included in the im-
provement district formed, each lot and parcel of land being separately assessed in proportion to the
number of square feet of such lots and lands abutting, adjoining, contiguous and adjacent thereto or in-
cluded in the improvement district to the distance back from such street, if olattad in 'clocks to the
center of the block, if platted in lots, to the center of the lots, and if not, platted, to the distance of
125 feet, and in proportion to the benefit derived to such property by said improvement, sufficient to cove
the total cost and expense of the work, the cost and expense to be assessed as herein provided for, which
includes the contract price of the improvement, engineering and clerical services, advertising, cost of
inspection, cost of collecting assessments, interest upon warrants if issued, and for legal services for
preparing proceedings and advising in regard thereto.
Section 6. Pursuant to Section 50 -2906 of the Idaho Code the total costs and expenses of all
improvements within the intersections in Local Improvement District No. 20 shall be assessed against all
of the property in said district in proportion to the benefits derived from such improvements.
Section 7. The 3Yayor and Council of the City of Caldwell shall assume and retain full and
complete jurisdiction of all construction work necessary to construct said necessary improvements and to
do the same by contract or otherwise as provided by law. The committee on sewers, together with the City
Engineer shall, ender the direction of the Mayor and Council, supervise said constriction work and see
that the same is done in strict accordance with the plans and specifications provided by the City Engineer
and approved by the City Council and such contracts as may be hereinafter entered into by said city and

Section 8. That all the property owners who may desire to protest against the making of said
improvements and against the creation of said improvement district, may file such protests against the
said improvements in the office of the City Clerk of the City of Caldwell, at any time before 5:00 o'clock
P.M., on the Third day of November, 1952, and that the City Council of said City will meet on the Third
day of November, 1952, at the hour of 8:00 o'clock P.M., in the City Council Chambers, in the City Hall in
Caldwell, Canyon County, Idaho, the authorized and usual meeting place, to hear and pass upon such protests
theretofore filed and determine whether or not to proceed with the proposed improvements.
Section 9. That the City Clerk is hereby authorized and directed to give due and legal notice
thereof and of the time within which protests against said proposed improvements or the creation of said
district may be filed, and the date when said protests will be heard and considered by the Council, which
notice shall describe the general character of the improvements proposed to be made and the estimated total
cost thereof, and shall cause notice to be published in three consecutive issues of The Caldwell =Jews-
Tribune, a daily newspaper printed and published in Caldwell, Canyon County, Idaho, the official newspaper
of said city, the last publication thereof being at least five days preceding the Third day of November,
1952, being the date fixed in this resolution within which protests may be filed; and said City Clerk
shall cause the publisher's affidavit of said publication to be filed in her office on or before the time
herein fined for the hearing of such protests; a copy of such notice shall be mailed at least five days
preceding the Third day of November, 1952, to each owner of property, if known, or his agent, if known,
within the limits of said proposed improvement district, addressed to such person at his post office address
if known, or if unknown, to the post office of the City of Caldwell where said improvements are to be made;
proof of publication of said notice in said daily newspaper must be filed with the City Clerk of the City
of Caldwell, Idaho, and the City Clerk of the said City of Caldwell must make and file in her office the
affidavit showing the filing and.mailing of such notices, said notice to be given by the said City Clerk
of the said City of Caldwell and shall be in sibstantially the following form:

Section 10. That bonds shall be issued and sold to meet the payments of the costs and expenses
of said improvements within the boundaries of Local Improvement DIetrict No. 20, which is chargeable to the
abutting, adjoining, contiguous and adjacent property and shall be paid for in ten equal annual installment:
first installment to mature within one year from date, and the last installment in not more than ten years
from date, and shall be nanbered from one (1) upwards, consecutively, and shall bear interest payable semi—
annually and said bonds may be sold at not less than par value and the city, for the purpose of meeting the
costs and expenses of such improvements as the same are installed prior to the sale of said bonds, will
issue warrants against the improvement district, payable to the contractor or the proper person, upon
estimates of the City Engineer hearing interest at the rate of not to exceed seven per cent per annum,
which warrants, together with the interest thereon at the date of the issue of said bonds shall be re—
deemed and retired from the proceeds of the sale of said bonds.
Section 11. That the construction of said improvement is necessary for the immediate preservation
of the public peace, health and safety and therefore an emergency exists and this resolution shall be in
full force and effect from and after its passage and approval.

and Bettis. Negative: None. Absent and not voting: None.
