That in accordance with the procedure provided in Section 4 -922 of the Caldwell Code of 1942; (a) nie Ordinance as so proposed be submitted to the Board of Adjustment of the City of Caldwell, Idaho, for its recommendation and report. (b) A public hearing be held by the City Council of the City of Caldwell, Idaho at the Council Chambers in the City Hall of said City of Caldwell on the 13th day of October, 1952, at the hour of 8:00 o'clock P.M., Kountain Standard Time; and (c) The City Clerk is hereby ordered and directed to give notice of said public hearing by publication of a notice thereof in The Caldwell Kews- Tribune, a newspaper printed and published in the City of Caldwell, Idaho, in two issues thereof published on September 25 and September 26, 1952. M. The Regular Monthly Meeting of the City Coucicil met in the Council Rooms of the City Hall, with the Mayor Jason C. Smith presiding. Upon Roll Call the following "ouncilmen answered present: Fran Blomquist, L. E. Burrell, John Myers, Ernest Weick, Dale Fenrich and J. M. Bettis. Application for Card License was read from The Sport Shop, the fee accompanying the application. Moved by Myers, seconded by Weick that this License be granted. Upon Roll Call it appeared the motion was unanimously carried. Applications for Card and Pool License was read from Waldorf Cigar Store, the fee accompanying the application. Moved by Myers, seconded by Weick that this License be granted. Upon Roll Call it appeared the motion was unanimously carried. RESOLUTION By CeunciLman Myers. The following resolution was introduced by dyers, read in full and considered: Resolution of the City of Caldwell, Idaho, accepting the Y'irst Amendment to the Grant Agreement with the United States of America through the Civil Aeronautics Administration. Be it resolved by the City Council of the City of Caldwell, Idaho: SECTION 1. That the City of Caldwell shall accept the First Amendment to the Grant Agreement with the Um ted States�of America. SECTICW 11. That the Mayor of Caldwell is hereby authorized and ditected to sign the First Amendment to the Grant Agreement in behalf of the City Clerk is hereby authorized and directed to attest the signature of the Mayor and impress the official seal of the City of Caldwell on the aforesaid First Amendment to the Grant Agreement. - _ )5� SECTION 111. Section 4. That the estimated cost of said improvements herein provided for is !' 23,200.0 Section 5. That the cost and expense of the construction of said improvement shall be assessed upon the abutting adjoining, contiguous and adjacent lots and lands benefited and included in the im- provement district formed, each lot and parcel of land being separately assessed in proportion to the number of square feet of such lots and lands abutting, adjoining, contiguous and adjacent thereto or in- cluded in the improvement district to the distance back from such street, if olattad in 'clocks to the center of the block, if platted in lots, to the center of the lots, and if not, platted, to the distance of 125 feet, and in proportion to the benefit derived to such property by said improvement, sufficient to cove the total cost and expense of the work, the cost and expense to be assessed as herein provided for, which includes the contract price of the improvement, engineering and clerical services, advertising, cost of inspection, cost of collecting assessments, interest upon warrants if issued, and for legal services for preparing proceedings and advising in regard thereto. Section 6. Pursuant to Section 50 -2906 of the Idaho Code the total costs and expenses of all improvements within the intersections in Local Improvement District No. 20 shall be assessed against all of the property in said district in proportion to the benefits derived from such improvements. Section 7. The 3Yayor and Council of the City of Caldwell shall assume and retain full and complete jurisdiction of all construction work necessary to construct said necessary improvements and to do the same by contract or otherwise as provided by law. The committee on sewers, together with the City Engineer shall, ender the direction of the Mayor and Council, supervise said constriction work and see that the same is done in strict accordance with the plans and specifications provided by the City Engineer and approved by the City Council and such contracts as may be hereinafter entered into by said city and those to veho;a the contracts Tray be awarded after due notice for bids has been published as provided by law 1 I � i J ss I Section 8. That all the property owners who may desire to protest against the making of said improvements and against the creation of said improvement district, may file such protests against the said improvements in the office of the City Clerk of the City of Caldwell, at any time before 5:00 o'clock P.M., on the Third day of November, 1952, and that the City Council of said City will meet on the Third day of November, 1952, at the hour of 8:00 o'clock P.M., in the City Council Chambers, in the City Hall in Caldwell, Canyon County, Idaho, the authorized and usual meeting place, to hear and pass upon such protests theretofore filed and determine whether or not to proceed with the proposed improvements. Section 9. That the City Clerk is hereby authorized and directed to give due and legal notice thereof and of the time within which protests against said proposed improvements or the creation of said district may be filed, and the date when said protests will be heard and considered by the Council, which notice shall describe the general character of the improvements proposed to be made and the estimated total cost thereof, and shall cause notice to be published in three consecutive issues of The Caldwell =Jews- Tribune, a daily newspaper printed and published in Caldwell, Canyon County, Idaho, the official newspaper of said city, the last publication thereof being at least five days preceding the Third day of November, 1952, being the date fixed in this resolution within which protests may be filed; and said City Clerk shall cause the publisher's affidavit of said publication to be filed in her office on or before the time herein fined for the hearing of such protests; a copy of such notice shall be mailed at least five days preceding the Third day of November, 1952, to each owner of property, if known, or his agent, if known, within the limits of said proposed improvement district, addressed to such person at his post office address if known, or if unknown, to the post office of the City of Caldwell where said improvements are to be made; proof of publication of said notice in said daily newspaper must be filed with the City Clerk of the City of Caldwell, Idaho, and the City Clerk of the said City of Caldwell must make and file in her office the affidavit showing the filing and.mailing of such notices, said notice to be given by the said City Clerk of the said City of Caldwell and shall be in sibstantially the following form: N O T I C E I Ll' Notice of passage of resolution declaring the intention of the Mayor and Council of the City of Caldwell, Idaho, to create and establish Local Improvement District No. 20, for the purpose of constructing a sanitary sewer system with necessary appurtenances thereto in said district and fixing the time within which protests may be filed in the office of the City Clerk and the time when the same will be heard and considered by the layor and Council. That bonds shall be issued and sold to meet the payments of the costs and expenses of said improvements within the boundaries of Local Improvement DIetrict No. 20, which is chargeable to the abutting, adjoining, contiguous and adjacent property and shall be paid for in ten equal annual installment: first installment to mature within one year from date, and the last installment in not more than ten years from date, and shall be nanbered from one (1) upwards, consecutively, and shall bear interest payable semi— annually and said bonds may be sold at not less than par value and the city, for the purpose of meeting the costs and expenses of such improvements as the same are installed prior to the sale of said bonds, will issue warrants against the improvement district, payable to the contractor or the proper person, upon estimates of the City Engineer hearing interest at the rate of not to exceed seven per cent per annum, which warrants, together with the interest thereon at the date of the issue of said bonds shall be re— deemed and retired from the proceeds of the sale of said bonds. Section 11.
