Mayor Me'luskey then called the Council's attention to the fact that Join C,
Flynn had offered to deed certain property to the City, provided t'iat the p ity would use
tLe same as a public alleyway and dedic =te the same for the use as an alley, and thereupon,
on motion duly made end seconded, it was resolved by the T"ayor end Co of the City of
Caldwell, Idnho,es follows, to -wit!

Moved by Blunt, seconded by McDannel that the above Resolution be adopted.
Motion carried.
An Affidavit of Publication of Ordinance n0. 581 was read by the pity Cleric.
Bill No 9, Proposed Ordinance No 532, wFs read for the second time.
A Petition was prevented to the A;ayor and Council signed by property owners
petitioning under ground irrigation for Flock 25 and 26, Original Plat of Caldwell.
The !Y,ayor referred this petition to the Chairman of the Irrigation Committee.
The City Attorney reported with respect to the case of Golden vs, City of Cald-
well, set trial in the District Court of the Seventh Judicial District, December 3,
1941, the report of the attorney including a communication from the attorneys heretofore,
and in the former administration employed by the City to defend said a ction, and whidh
communication was r °ad to the Council.
WHEn PON, the matter was discussed by the Coemcil and upon motion. by Councilman
YnDannel,':aecond'e& by Councilman Fresher it was voted tl it was to the best interest
of the City to defend said action, and the City P.ttorney was sutliorized to make arrange-
ments with the said attorneys for re -trial of the cause on the basis of said communication..
Councilman Newman reported to the Council that various. civic organizations de-
sired to erect a building on city property on or near the "olden Gate ° ark, said building
to be used in connection with the park, and to to used as a playroom, day nurssry and
community center, stating that the building vies to be constructed without cost to the City,
and presented to the City for said purposes.
The matter was discussed by the �onncil and citizens who were present and it was
the concensus of op6nion that the Luilding would add materially to the benefit of the
park facilities at its location, and that the City could properly cooperate in the venture
to the extent of furnis!^_ing gravel and water service connections.
IMP,EUFON, it was voted upon motion of Councilmen 17a' ;"an seconded by Councilmen
Fresher that the ,City accept the building upon its co-pletion end undertake the maintenan
and upkeep thereof, and further that the pity cooperate in its construction along the lines
above suggested.

fee accompanying each application.

The Bills for September wdre read and on motion by Dekan, seconded by Blunt that
these Bills be alloyed and 1, V&rrants i,e ordered drawn for the various amounts all of w ^ich

The Council met on Call of the Mayor, with the Mayor, H. E. McCluskey. presiding
On Roll Call the Following Councilmen answered present: Wilbur Dakan, F. E.
Newman, Floyd Blyent, E,E,Frasher and C. 0, McDennel, Absent: Thurlow Bryant.
The Mayor informed the Council the meeting was called to meet with Messers Horse -
fall and Edwards, W, P. A. -representatives from Boise,
A six year plan for W.P. A. Projects was throughly discussed and the Mayor infora
ed these gentlemen that this matter would again be taken up in the near future by the
Council.
There being no further business to come before the Council it was moved by

The Regular Monthly Meating of the City Council met in the Council Room of the
City' Hall, with tha-M H. E. McCluskey, presiding.
On Roll Call the following Councilmen answered present: Wilbur Dakan, F,E. New -
man, Floyd Blunt. Absent: Thurlow Bryant, E.E.Frasher and C. 0. McDannel.
The Minutes of October 6th., were read and approved as read.
Messers Caldwell, Elrod slid Harris,representing the Worker's Allianew,were present
and requested Signal Light at 4th., Street and the Railway Crossing.
The Mayor informed these gentlemen that this matter would be taken up with the
Union Pacific Railway.
It was voted upon motion by Newman, seconded by Dakan that the Mayor be author -
lzed directed to certify td a copy of an'- estimeted'csluetion all City property to
the Idaho Surveying & Rating Bureau, Boise, Idaho, as planned and fixed by M.A.R Agency
and Mitchell - Greves Agency of Caldwell and submitted to the Council this date,tofgling_the;
btim of $76,31o.0o, and that a copy of this appraisal be filed by the City Clerk.
The Mayor appointed Dr. F. M, Cole on the Zoning Board,
Moved by Blunt, seconded by Newman that this appointment be confirmed. Motion
cartied.
