COUNCIL CHAMBERS, OCTOBER 6TH, 1926.
The Council mat in regular session pursuant to adjournment, on October 6th, 192(
at 8:00 o'clock p. m., with Mayor haley, presiding; Councilmen, Dutton, Kimbrough, Tlumford,
McConnel, and Wheeler, present; absent: Conley. City Clerk, S. Earle Boyes, was also presex
Pursuant to motion passed at the meeting of October 4, 1926, the Council Conven-
ed as ® Committee of the Whole, and went into E:cecutive Session for the purpose of consider-
ing the bids on fire fighting apparatus.
COUNCIL IN SESSION.
Councilman I.imbrough, reporting for the Committee of the Whole, stated that the
Committee had had under Consideration all of the bids for fire fighting apparatus, and after
duly oonsidering the same, recommended the acceptance of, the bid of Nickerson Machinery Com-
pany. Thereupon it was moved by L'imbrough, duly seconded by McOonnel, that the report of
the Committee of the Whole be accepted, and that the City purchase a 750 gallon capacity
Northe ;n Pumb, manufactured by the Northern "mire Apparatus Company, of Minneapolis, ?dinnesoti
mounted on a Republic Truck, manufactured by the Republic Manufacturing company, of Alma,
Michigan, as proposed by the Nickerson Maohinery Company, of Salt Lake City, Utah. Motion
carried. Thereui?wl Councilman Kimbrough presented the following Resolution, and moved its
adoption:
RESOLUTION 110. 41. BY 2.117BROUGH.
"A RESOLUTION AUTHORIZING AIM DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF
CALDITELL, IDAHO, TO ENTER INTO A CONTRACT GIITH UICI nR201I MACHINERY COMPANY, FOR THE PURCHASE
OP A CERTAIN FIRE APPARATUS AND EQUIPMENT THER=I DESU IEED.
"UI EREAS, there is now before the Mayor and City Council of the of Caldwel
Idaho, forms of a contract with Nickerson Machinery Company, which provides for the sale to
the City of Caldwell of certain fire apparatus and equipment, whioh said contract has been
prepared in order to carry out and complete the purchase of said equipment and apparatus, in
conformity with the acceptance by said City Council of the bid of said Nickerson raohinexy
Company at a meeting of said City Council held on the 6th day of 1926; and
"WEEREAS, such form of contract has received the careful consideration of this
body, and it is believed that it is for the best interest of this municipality that such con
tract be executed forthwith; now, therefore, be it
"RESOLVED, by the Mayor and City Council of the City of Caldwell, Idaho:
"Section 1. That the 7clayor of the City of Caldwell, Idaho, is hereby authorized
and directed, in his official capacity to execute in duplicate, the contract above described
with P]iokersou Uachinery Company, and the Clerk of said City is authorized and directed to
affix the corporata seal of this municipality to each of said duplicates of said contract an
to attest the same and to certify to such duplicates as the contract authorized by this reso
lution. And when said contract has been thus executed and has also been properly executed b
the Dickerson Machinery Company, the Olerk of said City is hereby directed to deliver one of
said duplicates to the Nickerson Machinery Company and to retain the other as a part of the
records of his office."
The motion for the adoption of said resolution was duly seconded by McConnel.
The question being "Shall the Resolution pass ?" The Mayor direo�ed the Clerk to call the rol
which resulted as follows: Ayes: Dutton, imbrough, T.:umford, LoConnal, and Wheeler. Nayes:
None. Absent: Conley. Whereupon the P:dayor declared the motion carried and Resolution No. 4
adopted, and directed the Clerk to record the same upon the journal of the proeedings of the
Council, as a part of the minutes of this meeting; and thereupon the Mayor and-Olark, in opal
session of the Council, duly signed and approved said Resolution.
The Clerk presented the written applications for licenses for operating Pool and

Billiard Roans for the quarter ending December 31st, 1926, signed by I. H. Waters, George
Franklin, and G. S. Used, which had been filed with the City Clerk, who stated that the fe
provided by law had been paid by each of said applicants respectively. Thereupon, it was
moved by Wheeler, duly seconded by Dutton, that license be granted to each of said appli-
cants, and that the Ilayor be authorized to issue licenses for operating Pool and Billiard
Rooms for the quarter ending, December 319t. 1926, to I. H. 7!aters, George Franklin, and
G. S. plead, respectively. notion carried.
Thereupon the '.Jsyor annowiced that this was the time for the consideration of ob-
jections to the Assessment Roll of Local Sprinkling Improvement District No. 1, the same
having been noticed for the meeting of the Council for October 4, 1926, and said meeting
having been adjourned to this date. The Clark presented to the Council the Affidavit of Fu
1lcation of the Notice of filing of Assessment -Roll of Local Sprinkling Improvement Distrio
No. 1, which Affidavit wee and is in words and figures as follows, to-wit:
"Affidavit of Publication. State of Idaho, County of Canyon. as. mile A. Shcrb
being first duly sworn, deposes and says that he is foreman of CALIYVIELL TRIBME PU1LISH -
7HG:•i 1 0AIPA1TY, publisher of THE CALDITELE TRIBUdrE, a weekly new4aper published at Caldwell,
Idaho; that the said paper is in general circulation in the County aforesaid, and has
been for a period of 78 weeks preceding the first publication of this advertisement, a
copy of which is attached hereto, and was published in the regular edition of said THE
CALDWELL TRIBUTIE 3 consecutive weeks, beginning with the issue of Sept. 17, 1928, and
ending with the issue of Oct. 1, 1926. (Signed): 3IILE A. SHORB. Subscribed and sworn
to before me this End day of October, 1926. (Signed): NELL WILSON. Notary Public. Re-
siding at Caldwell, Idaho. (Seal)." (Copy of Notice attached).
Thereupon it was moved by Wheeler, duly seconded by Mumford, that the Clerk be in•
structed to insert said Affidavit of Publication as a part of the minutes of this meeting.
Motion Carried.
The Clark stated that no protests had been filed against the Assessment - Roll of
Local Sprinkling Improvement District No. 1. Thereupon Councilman Dutton presented the fol
lowing resolution and moved its adoption:
RESOEUTION N0. 41A. BY DUTTON.
"A P.ESOLUTION APPROVING AND CONFMINO TIM ASSESS11ENT RCTL OF LOCAL SPRIMMING
=ROVET.TENT DISTRICT NO. 1.
ITMEEREAS, The Assessment Roll of Local Sprinkling Improvement District No. 1, of
the City of Caldwell, Idaho, has been certified by the Committee on Streets and the City
Engineer, and was filed in the office of the City Clerk of the City of Caldwell, Idaho, on
the 13th day of September, 1926, and is now on file in said office; and
I IWB3RE'EAS, the 4th day of October, 1926, at eight o'clock, P. m., in the City Hall
of said City was fixed by the Council as the time and place of hearing and considering ob-
jections to said assessments as made and shown by said Assessment Roll; and
"'1'IHEREAS, the tine for filing protests having expired, and the time for hearing
and considering the same having arrived, and the said Assessment Roll having been fully and
duly considered by the Mayor and Council of the City of Caldwell, and having been found reg•
ular, valid, correct, fair and just and in compliance with the laws of the State of Idaho,
and the Ordinances of the City of Caldwell in all particulars; now, therefore, be it
"RESOLVED, by the Mayor and Council of the City of Caldwell; Idaho:
"Section 1. That the Assessment Roll of local Sprinkling Improvement District T_to
County of Canyon, state of
1, in the City of Caldwell, /Idaho, be, and the same is hereby approved and confirmed."
The motion for the adoption of said Resolution was duly seconded by Mumford. The
question being "Shall the Resolution pass ?" The P?ayor directed the Clerk to call the roll,
which resulted as follows: Ayes: Dutton, Yimbrough, I.Tumford, 1 cConnel, and Meeler. Nayee:
None. Absent' Conley. Whereupon the Mayor declared the motion carried and the Resolution
No.-41A adapted, and directed the Clerk to record the same upon the journal of the proced-
ings of the Council, as a part of the minutes bf this meeting; and thereupon the Layor, in
open session of the Council duly signed and approved said Resolution.
It was voted on motion of ','Theeler, seconded by Dutton, that the bills as approved
