The Mayor presented the following items on the Consent Calendar for approval by Members of the City Council:
1. Approve acceptance of the minutes from the Regular City Council meeting held on September 5, 2006 and the Friends
of the Depot meeting held on August 15, 2006 and September 12, 2006;
2. Approve Order of Decision for Case No. SUP- 270(A) -06 for an appeal by Jerry and Terri Timmons;
3. Approve Order of Decision for Case No. ANN- 125 -06 for an annexation request by Sallie Palleria and Brett Anthon;

SUBDIVISION)
The Mayor explained the quasi - judicial process.
Brian Billingsley, Community Development Director of 621 Cleveland Boulevard, was sworn in by the clerk and
presented the agreement between the interested parties, which the Mayor labeled as CC -1000.
Rob Hopper stated that there were a number of private roads to the south of the development involving the Lakey's area
He stated his concern that this development could possibly block any alternate access to those private roads other than
Hwy. 20/26.
Wendy Kirkpatrick, 104 9"' Avenue South, Nampa, acknowledged being previously sworn in and presented a large revised
preliminary plat, which the Mayor labeled as CC -1001. She stated that an agreement had been reached with the interested
parties concerning issues discussed at the last public hearing. She noted that the property owners at the northwest corner
have agreed to dedicate right -of -way and that road improvements would be constructed by the developer. She also
indicated that road improvements would be made along Smeed Parkway and Marble Front Road. Ms. Kirkpatrick reported
that by providing connection along Smeed Parkway, the property owners to the south would be able to access their
property.
Ms. Kirkpatrick reported that proposed revisions were made to the preliminary plat which includes an additional stub street
to the north and allows for connection of the streets running along Marble Front Road. She noted that the developer
would include pathways on both sides of the canal and a second pathway would be extended on the most northerly portion
of the canal.

Gordon Law suggested that the motion include explicit language addressing the connection to Borcher Lane to the south
and the inner connecting street on the southeasterly side of the subdivision. Also the double entry issue onto Marble Front
Road or the single entry with two culdesacs should be addressed. Discussion followed concerning these issues.
Councilman Hopper noted that Items 12.32 and 12.33 within the staff report refers to Lot 18 on the preliminary plat and
addresses the areas of concern.

amendment designating the site for low- density residential use, and a development agreement spelling out the terms and
arrangements of the rezone, be approved with the conditions listed in Section 8 of the staff report.

Brad Dugan, 23188 Canyon Lane, acknowledged being sworn in and spoke in favor of the request. He noted that the

DURING THE REGULAR CITY COUNCIL MEETING)
E1Jay Waite, 411 Blaine Street, presented the staff report concerning the value of City -owned properties located south of
the Purple Sage Golf Course. He referred to the analysis provided by Gunstream Realty located within the Council
packets. He noted that the recommendation from Gunstream Realty was to value the properties in a range from $48,000 to
$50,000 per acre. Mr. Waite stated that his recommendation would be to use the $48,000 per acre amount. Discussion
followed concerning the recommendation.
The Mayor stated that the intent is to sell the property and put the revenue into a dedicated golf fund. The interest from the
revenue would be used for upgrades thus making it a premier golf course with reasonable fees.
In response to questions by Councilman Hopper, Mr. Waite stated that there is no overflow parking agreement with the
neighboring parcel owner.
MOVED by Hopper, SECONDED by Blacker to declare the property as underutilized, set the public hearing for
November 6, 2006 at 7:00 p.m., and set a minimum price of $50,000 per acre for the fair market value.

Councilman Callsen reported that the Finance Committee has reviewed current accounts payable in the amount of
$1,453,744.55 for the period ending September 28, 2006 and a net payroll in the amount of $216,203.03 for the pay period
ending September 16, 2006.
MOVED by Callsen, SECONDED by Hopper that accounts payable in the amount of $1,453,744.55 represented by check
numbers 38265 through 38559 and the total payroll in the amount of $216,203.03 represented by check numbers 11080
through 11149 and direct deposits be accepted, payments approved, and vouchers filed in the Office of the City Clerk.
Those voting yes: unanimous.

Councilman Dakan noted that the Canyon County Animal Shelter Foundation Board would be selected for the purpose of
coordinating fund raising efforts for the animal shelter.
Councilman Callsen reported that the recently purchased fire truck has arrived and fire department personnel are being
trained on the new equipment.
Councilman Hopper reported that he would be out of town on October 16"' but would like to attend the workshop and
Regular City Council Meeting by phone. The Mayor stated that staff would provide for this accommodation.
Councilman Oates reported that the Thomas Jefferson Charter School would have its grand opening on October 3` from
7:00 to 8:00 p.m.
