aiL COUNCIL CHAMBERS OCTOBER 2, 1961. 8:00 P. M. The Regular Monthly Meeting of the City Council met in the Council Rooms of the City Hall, with the Mayor Ed Simmerman presiding. Upon Roll Call the following "ouncilmen answered present: E. L. Vassar, N. E. "Coley" Smith, Max Luby, Emile Shorb, L. P. Eldredge and Alvin K. Bates. The Cl- -rk presented to the Mayor and council the Affidavit of Publication of the Notice of the passage of a Resolution declaring the intention of the City of Caldwell, Idaho to create and establish Local Imo,,: ovement District No. 49. The Clerk presented to the Mayor and Council the Affidavit of Mailing said Notice of the passage of a Re- solution declaring the intention of the City of Caldwell, Idaho to create and establish Local Im- provement District No. h9, showing the same to have been mailed to all of the owners of property within the boundaries of said Local Improvement District No. 49. ThereUPOTI the Mayor announced that this was the time set by notice for the consideration of pro- tests against the creation of Local Improvement District No. 49. here were no protests filed. N T Thereupon Councilman Shorb introduced Bill No. 7, entitled: AN ORDINANCE CREATING AND ESTABLISHING A LOCAL STV;ER IMPROVEMENT DISTRICT TO BE CALLED AND KNOWN AS "LOCAL IMPPOVEMENT DISTRICT NO. 49 FOR THE CITY 01' CALDWELL, IDAHO" F,°ESIGNATING THE BOUNDARIES OF SAID DI5TR.ICT AND THE POINTS BETWEEN WHICH SAID IMPRO';EM,NT IS TO BE MADE;-AND PROVIDING FOR THE CONSTRUCTION OF SUITABLE SEWERS, DITCHES, DRAINS, O'NDUITS AHED CHANNELS FCR SANITARY PURPOSES WITH OUTLETS, MANHOLES, CATCH - BASINS, FLUSH TANKS AND ALL OTHER SHOWER APPURTENANCES NECESSARY FOR TH3 COMFORT, C'NVENIENCE, HEALTH AND WELL-BEING OF SAID CITY; PROVIDING THAT THE COST AND EXPENSE OF THE SAID IMPROVEMENT SHALL BE TAXED AND ASSESSED UPON ALL OF THE PROPERTY WITHIN THE SAID IMP°tOVE14F,NT DISTRICT, ABUTTING, ADJOINING, CONTIGUOUS', AND ADJACENT TO THE SAID IMPROVEMENT AND UPON THE LOTS AND LANDS BENEFITED BY SUCH IMPROVEMENT AND INCLUDED IN THE IMPROVEMENT DISTRICT; PRESCRIBING THE METHOD OF SUCH A55ESSMENT AND PAYMENT THEREOF; DIRECTING THE CITY CLERK TO ALVERTISE FOR AND RECEIVE. It was moved by Councilman Eldredge, see Tided by Councilman Shorb that the riles requiring that the reading of a Bill on three separate days be suspended and that Bill No, 7, be read the second time by title and the third time in full section by section and placed on the final passage. The Mayor directed the Clerk to call the Roll on the above motion :pith the following result: Those voting in the affirmative were: Vassar, Smith, Luby, Shorb, Eldredge and Bates. Negative: None. Absent and not voting: None. The Mayor declared the ILI motion had passed by the necessary three - fourths majority and directed the Clerk to read Bill No; 7, the second tires by title and the third time in full section by se(tion. The Clerk read the Bill as directed. The question being "Shall Bill No. 7 pass? The Mayor directed the Clerk to call the roll on the above question which resulted as follows: Those voting in the affirmative were: Vassar, Smith, Luby, Shorb, Eldredge and Bares. Negative: None. Absent and not voting: N)ne. Thereupon the Mayor declared Bill No. 7 had amassed and the Mayor in open session of the Council duly signed and a noroved the Bill and the Clerk duly signed and attested the same which became Ordinance No. 979. The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance No. 979, to be published in the News - Tribune the official newspaper of the Cite of Caldwell, Idaho. Appointment & Resi nation Fire Dept The following letter was read from W. A. Paddock, Fire chief: October 2, 1961. - - Fire Commissioners, Mayor and Council Caldwell, Idaho Dear Sirs: ° I recommend that R. D. Cashman be appointed as a Vortunteer on the Caldwell Fire Department effective Oct 1, 1961. He will replace Leonard Charlton who resigned 30th of September, 1961, Respectfully /s/ W. Upon Roll Call it appeared the motion was unanimously carried. Application for Card License was read from Oliver Vanderwilt, the fee accompanying the Moved by Councilman Smith, seconded by Councilman Luby this License be granted. Upon Roll Call it appeared the motion was unanimously carried. I Basement Idaho Power Idaho Power requested the City grant an easement over the following described property: SE of Sec. 28 -Twp. 5N -R3 WBM new golf course Moved by Councilman Smith, seconded by Councilman Bldredge, the Mayor and Clerk be authorized, on behalf of the City to execute an agreement between the City of C.,ldwell and Idaho Power Co. Upon Roll Call it appeared the motion was unanimously carried. O -door toilets Geo Sweet, City Sanitary Inspector and Huey Reed, City - bounty Sanitarian presented a man to the Council showing out -door toilets not connected with the sewer or septic tanks. This was referred to the City Engineer and City Sanitary Inspector with are�ort back to "ouncil. Chamber of Commerce ( sid?.walk Montana Street near Hi -h School) . Martin War`,erg and Bob Purcell, representing the Chamber of Commerce were present and requested the City to take some action to require the construction of sidewalks on Montana Street near the High School, Mayor Simmerman stated a. problem ' definitely exists on Montana S +reet near the High School and the Council would work toward an improvement district in that area. Interstate Highway Mayor Simmerman discussed the Interstate Highway proposal presented to the State Highway Board. It was agreed by the Council, since the proposal made by the City was not aonroved by the Highway Board, to wait ,'or the Highway Board to make a proposal to the City. Mayor Simmerman reported the new Police Station wild be ready about the 1Gth of October. Ap"intment Fire Dela_rtment (Volunteer) MavOr Simmerman announced the appointment of H. D. Cashman as Volunteer Fireman. Moved by Councilman Lucy, seconded by Councilman Eldredge this apnointment be confirmed. Upon Roll Call it anpea the motion was unanimously carried. Reports from the Police Department and the City - County Sanitarian were read and ordered filed. The Bills for September were read and on motion by Councilman Smith, seconded by Councilman Eldredp. the,e Bills be allowed and warrants orde - ed drawn for the various amounts all of which have been approved by the Finance Cbmnittee.
