RESOLUTION
By Councilman Blomquist.
WHEREAS, the 81st Congress of the United States passed Public "a- 475, which law provides for the
transfer of owner 11 ship of certain Federal Housing Projects to private persons and dorporationsi an d
WHEREAS, Cleveland Heights Housing Project, temporary housing project, known as I daho -V- 10132,
federal housing project coming within the Provision of Public Law 475, and
WHEREAS, the Caldwell Chamber of Commerce, Inc., desires to secure ownership of said project No.
Idaho- V_101 in accordance with Public Law 475 above, and
414BERFAS, as a prequisite of such transfer from the Federal Government to the corporation it is
'i necessary to obtain a waiverfrom the municipal corporation in which said housing project is located, of
the removal requirements of Sections 313, Public La No. 849of 76th Congress, as amended under which
11 authority said housing project was erected.
NOW THL..E ORE BE IT RESOLVED, By the Mayor and City Council Of the City Of Caldwell, Idaho, here- ' i
by BPOcifically approve the unconditional w--iver for removal, contained in Section 313, Public L 849,
76th Congress, as amended, with regards to the housing project designated as Idaho-V-10132, Caldwell,
Idaho,
A, for the transfer is being submitted by the Chamber of Commerce of the City of Caldwell,
Idaho, a corporation duly organized and existing Pursuant to the laws Of the State of Idaho, pursuant to
Title V1 o f said Public Law no. 8119, as amended.

Thereupon the Mayor declared the motion carried and the Resolution adopted,
There being no further business to come before the Council, it was moved by Councilman Fenrich,

A RESOLUTION ACCEPTING THE ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0. 18 FOR THE CITY OF
CALDwELL, CANYON COUNTY, IDAHO; AUTHORIZING THE CLERK TO GIVE NOTICE OF T },E TIME AND PLACE FOR HEARING AND
CONSIDERING OBJECTIONS TO THE SAID ASSESSMENT ROLL; MIND THE TIME FOR HEARING AND CONSIDERING SAID OB-
JECTIONS AND PRESCRIBING THE FORM OF NOTICE.
WHEREAS, the assessment roll of local Improvement District No. 18 for the City of Caldwell,
it
Canyon County, Idaho, has been conpleted in compliance with the provisions of the laws of the State of Idaholl
in such cases made and provided, and the ordinances of the said City of Caldwell, Canyon County, Idaho,

said assessment roll having been prepared and made out by the committee on sewers, together with the City 11
Engineer, containing the number of assessment, the name of the owner if known, and if not known that the
name is unknown, a description of each tract assessed and the total amount of the assessment, and said
assessment roll having been so prepared was certified to the Council of the City of Caldwell by the com-
mittee on sewers and the City Engineer,
NOW, THEM'ORE, BE IT RESOLVED by the Mayor and Council of the City of Caldwell, Idaho:

Section 1. That the assessment roll of Local Improvement District No 18 of the City of Caldwell,
Idaho, be, and the same is hereby accepted and placed on file in the office of the City Clerk of the City
of Caldwell, Canyon County, Idaho. That the City Clerk is hereby authorized and directed to give due mid
legal notice, in corpliance with the provisions of law, to the owner or owners of property which is as-
sessed in said assessment roll, whether named or not named, by publication 1n three successive issues in
the Caldwell News- Tribune, a daily newspaper printed and published in the City of Caldwell, Idaho, and the
i official newspaper of the City of Caldwell. Said notice shall state that the said property owners may file,
within ten days from the first publication of said notice of time to file objections to said assessment
roll, objections to said assessment roll and that objections will be considered by the Mayor and Council

on the 16th day of October, 1950, at 8:00 o'clock P. M.
Section 2. That said notice shall be in substantially the following form, to -xltt
"NOTICE OF RECEIPT OF ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 18 FOR THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO, BY THE CITY CLERK AND OF THE TIME AND PLACE FOR FILING PROTESTS TO SUCH ASSESSMENT ROLL AND J
OF THE TIME SET FOR HEARING PROTESTS B1 THE CITY COUNCIL.
"NOTICE IS HEREBY GIVEN That the assessment roll of Local Improvement District No. 18 for the
City of Caldwell, Canyon County, Idaho, is now on file in my office in the City Hall of the City of Cald-
well, Canyon County, Idaho, and that the same was filed at 5sOO o'clock P. M. on the 2nd day of October,
1950, at 800 o'clock P. M., at the City Council Chambers in the City Hall in said City of Caldwell, Can-
yon County, Idaho, to hear and consider objections to said assessment roll by the party or parties ag-
grieved by such assessment. The owner or owners of any property which in assessed in said assessment roll
whether named or not in such assessment roll may, within ten days from the first publication of this notice,
file his objections in writing to said assessment or to any part thereof which said objections must be
definite and specific as to the property or piece of property in said assessment roll to which objection is I II
made as well as the specific ground for such objection. The assessment roll will be open for inspection

Thereupon Councilman Blomquist introduced Bill No 8, entitleds
AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF, AND OWNERS OF PROPERTY IN THE CITY OF CklXr#ELL,

THAT AN APPLICATION HAS BEEN PRESENTED FOR THE VACATION OF THAT PORTION OF THE THIRD AVENUE IN CALDWELL,
IDAHO, BETWEEN THE NORTHEASTERLY BOUNDARY LINE OF MAIN STREET AND THE SOUTHWESTERLY BOUNDARY LINE OF THE
RIGHT -OF=NAY OF THE OREGON SHORT LINE RAILROAD COMPANY AS SHOWN UPON THE REVISED MAP OF CALDWELL, IDAHO,
FILED IN THE OFFICE OF THE RECORDER OF CANYON COUNTY, IDAHO, ON nJLY 29, 1891 at 3 sOO O'CLOCK P. M., IN

which was read for the first time and the Council proceeded to a consideration of Bill No 8. It was moved
moved by Councilman Fenrich, seonded by Councilman Myers that the rules requiring that the reading of a
Bill on threeseparate days be suspended and Bill No 8, be read the second time by title and the third time
in full section by section and placed on the final passage. The Mayor directed the Clerk to call the roll
on the above motion with the following results Those voting in the affirmative wares Glaisyer, Burrell,

Myers, Blomquist, Fenrich and Bettis. Negatives None. Absent and not Voting: None. The Mayor declared
the motion had passed by the necessary three - fourths majority and directed the Clerk to read Bill No 8,
the second time by title and the third time in full s ection by section. The Clerk read the Bill as directed
The question being °Shall Bill No 8 pass?" The Mayor directed the Clerk to call the roll on the above
question which resulted as follows: Those voting in the affirmative werst Glaisyer, Burrell, Myers, Blom- , I

Thereupon the Mayor declared Bill No 8 had passed and the Mayor in open session of the Council j
duly signed and approved the Bill and the Clerk duly signed and attested the same which became Ordinance
No 754. The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance No 757, to be,j
published in the Caldwell News - Tribune the official newspaper of the City of Caldwell, Idaho.
The Mayor and Council discussed the alteration of "B" Residence Zone boundaries.
Thereupon Councilman Myers, introduced Bill No 9, entitleda

642, ORDINANCE NO. 649, ORDINANCE NO. 655 ORDINANCE NO. 680, and ORDINANCE NO. 697) BY ALTERING AND CHANG-
ING TEE'BOUNDARIES OF "B" RESIDENCE ZONE OF THE CITY OF CALDWELL, IDAHO; PROVIDING THE EFFECTIVE DATE OF
I THIS ORDINANCE AND PROVIDING THE REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH.

Upon motion by Councilman Fenrich, seconded by Councilman Burrell, the following Resolution
was proposed: j
WHEREAS This date an Ordinance was introduced for passage by the City Council and approval by
the Mayor of the City of Caldwell, Idaho, amending Section 4 -103 of the Caldwell Code 1942, to alter the
boundaries of "B" Residence Zone of the City of Caldwell, Idaho.
BE IT RESOLVED:

j That in accordance with the procedure provided in Section 4 -922 of the Caldwell Code of 19423
(a) The ordinance as so proposed be submitted to the Board of Ad3ustipent of the City of Caldwell,
Idaho, for its recommendation andreport;
(b) A public hearing be held by the City Council of the City of Caldwell, Idaho, at the Council
Bhambersi in the City Hall in said City of Caldwell, on the 6th, day of November, 1950, at the hour of Es DO
o'clock P. M. and by publication of a notice thereof in The Caldwell News - Tribune in two issues thereof,

In response to roll call upon said motion, Councilmen voting "Aye" wares Glaisyer, Burrell, Myers

The Bills for September were read and on motion by Glaisyer, seconded by Burrell that these Hi]la
be allowed and Warrants ordered drawn for the various amounts all of which had been a pproved by the Finance

WHEREAS it appears to the Mayor and Council that there is a good cause for allowing said petition,
NOW, THEREFORE BE IT RKO)V3D, that one -half of the said assessments be and the same are hereby II
remitted and cancelled and the Treasurer of the City of Caldwell upon receipt of $82.08 is hereby authorixedll
and directed to charge the same off and to cancel the same upon his books and to issue all necessary papers
and instruments to terry into effect the purpose of this Resolution.
