Idaho, October 2, 1916. i i Council meet in regular session with Mayor Fred C. Boyes, presiding, Council- men present, Ackley, Dement, Hayman, Sanberg. S. Ben Dunlap, Clerk, when the following business was transacted; Adr. W. Grant ward, having filed his oath of office, took his seat as Councilman from the Third '.lard to fill out the unexpired term of Fred N. Harrington. The minutes of the sessions held September 4th., 6th., 11th., lath., 19th. and 20th., respectively, were read and upon motion of Hayman were approved Mr. Blessenger appeared and filed a claim in the sum of $21.96 as damages for accident, claimed to be due to defective street crossing at the corner of Seventh Avenue and Cleveland Boulevard. Mr. Bleseenger stated that on the evening of September 19th., 1916, he attempted to. -Grose Cleveland Boulevard at Seventh Avenue and that owing to the Street being muddy, by reason of practice of Fire Department, and the shortness of the culvert at this place, his machine was forced into the ditch. He asked to be re- imbursed for money expanded for Doctor bills for his wife and repairs to the machine. The matter was referred to the City Attorney and Finance Committee for Investigation and report. The following bills which had been O.K'd by the Finance Committee were read, it was voted upon motion of Ackley that the same be allowed and warrants be ordered a on the various funds in payment of the same as follows; -102_ GEN FUND S.. Ella Gartin in the sum of $20.00 for September barn rent, and not 0. K'd by the Finance Committee', was read. Mr. Campbell, Street' Commissioner, reported that upon being informed that the rent had been raised to x;20.00, he had made some investigation but had been unable to secure another barn. He stated that the Gartin barn was to large for the City's purposes, but was probably worth the rent asked to one who had more stock than the City. It was voted upon motion of Ackley that the claim be allowed and that a warrant be ordered drawn on the Road Fund in payment of the same. Total amount warrants ordered drawn on the Road Fund ,----- - - - - -- $1411.94 The bill of the Auto Machine Shop in the sum of $1200.00, first payment on Model 1. 12 Federal Sprinkling Truck was presented. A motion was made by Ackley that the claim be allowed and a warrant be ordered drawn on the Sprinkling Fund in payment of the same. The roll being called on the motion, the vote resulted: Ayee- Ackley, Dement, Hayman, Sanberg, Yard -5. Nayes -None. Absent- Forbes -1. The motion was declared carried and the Clerk instructed to draw the warrant. Total amount of warrants ordered drawn on the Sprinkling Fund, -- $1487.10 GRAND TOTAL WARRANTS ORDERED DRA6NN,-------------------- ---- ----- $4519.00 The following bills not O.K'd by the Finance Committee, were read. H. D. Blatchley Overpayment 1910 Taxes 6157.82 B. E. Engel Overpayment July water 5.50 The bill of H. D. Blatohley was referred to the City Attorney and Finance Committee and the bill of P. E. Engel to the Finance Committee for investigation and report. Bill No. 19, by Dement, entitled, "An Ordinance vacating, abandoning and discontinuing all of that portion of Third Street South lying between fractional Block 96 and Block "0" of the City of Caldwell, Idaho, and the alley running through said fractional block 96, as the same appears upon the plat of the said City now on file in the Office of the Recorder of Canyon County, Idaho ", was read the third time. . Messrs I. N. Paynter, F. L. Keller and Ed. Hedden appeared and protested against the passage of the Ordinance. They stated that they owned property in this portion of the City, that there was considerable traffic on Third Avenue and that the closing of the Street would hinder the future development of this neighborhood. T. E. Buckner, Esq., also appeared and requested that the ordinance be passed. He stated that his clients were desirous of erecting a canning factory in this neighbor- hood, that the vacation of the street was essential to the plan, that the benefit accruing to the citizens by reason of the factory would offset any inconvenience which those people living in this neighborhood would suffer by reason of the street being closed and that if the City vacated as petitioned it would save the expense of putting 1J in a bridge at this point. -105- The question being on the, passage of the bill, the roll being called the it vote resulted: Apes- Dement -1. Nayes- Ackley, Hayman, Sanberg, Ward -4. Absent - Forbes -1. So. Bill No. 19 failed to pass. The concrete assessmemt• roll for the month of September, 1916, as prepared by the Street Committee and City Engineer, showing the assessments against property abutting which concrete was constructed during the said month was presented. It was voted upon motion of Hayman that the ro11 be confirmed, ratified and approved. I The reports of the following officers for the month of September, 1916, were read. City Treasurer, Police Judge, Street Commissioner, City Clerk, Seaton, City Engineer and Water Commissioner. It was voted upon motion of Dement'that the reports be approved and ordered placed on file. It was voted upon motion of Dement that the City Fhgineer be instructed to notify the Pioneer Irrigation District to repair its drainage ditch in the North part of the City. A motion was made by Sanberg, seconded Ackley that the Mayor and City Clerk be and hereby are authorized and instructed to issue due -bills and interest coupons to the Auto Machine Shop of Caldwell, Idaho, in payment for the balance due on the Model L. 12 Federal Sprinkling Truck. The roll being Called on the motion the vote resulted: Ayes - Ackley, Dement, Hayman, Sanberg, Ward -5. Nayes -None. Absent- Forbes -1. The Uayor declared the motion carried. Superintendent of Fire Apparatus Sovereign, stated that the tire manfactures had discontinued making the style of tires used on the fire truck and that as it,WO mld;aoon be necessary to purchase new tires, new wheels would have to be procured for the machine. He estimated the cost to be about $300.00. It was voted upon motion of Dement that the matter be referred to the Fire Committee and Superintendent with power to act. In the matter of release of penalty and interest on delinquent City special taxes on lots 13 and 14 of Block 1, Original Townsite, it was voted on motion of Hayman that the City Clerk be and hereby is instructed to notify the County Commissioners of Canyon County that the City Council is willing to release�tha collection of the interest and penalty on City Specials on the said property, provided the amount of the assessments were paid in full. placed in line with other poles now in the said alley. It was voted upon motion of Dement, seconded Sanberg, that the Council i adopt a resolution accepting title to the alley running through the Dement Block. It was voted upon motion of Dement that the City grant Mr. G. L. Crookham permission to erect poles, for the purpose of attaching a trolly wire thereto, in the alley between Main and Arthur Streets and Fifth Avenue and Aven Street, said poles to placed in line with other poles now in the said alley. -106 - A communication from F. G. Hoffman under date of September 30, 1916, I soliciting a portion of the City's fire insurance, was read. ! � It was voted upon motion of Dement that the City Hall be insured for 9ov. of its appraised value. The Mayor referred-the matter of securing insurance to Councilman Ackley and Hayman, with power to act. Council meet in regular session with i.Iayor Fred C. Boyes, presiding, Councilmen Ackley, Dement, Hayman, .anbsrg and Ward present, S. Ben Dunlap, City Clerk, when the following business was transacted: Messrs Puxser, McLeod, Houston Frost cud Elmer Frost appeared with a complaint that the sidewalk adjoining the IIouston Frost property was about four feet below the grade of the street, that in order to gain access and egress to and from the said property the owner thereof had been compelled to fill in a portion of the sidewalk with dirt, that in wet weather this condition caused water to back up on the sidewalk for quite a distance, mak- ing the same impassable. I It was voted upon motion of Ackley that the matter be and hereby is referred to the Street Committee for immediate attention. Mr. H. P. Dicke and James L. 1.1ageo appeared and requested that the Boise Valley Traction Company and the Caldwell Traction Company Limited each be granted a franchise for street railway purposes along and across a portion of Cleveland Boulevard and Twentieth Avenue South. They stated that that portion of the streets over which a franchise was asked is now being used for street railway purposes by the said companies, and that franchises were desired in order to mak:: their use legal. Bill No. 21, by Dement, entitled, "An Ordinance granting to the Boise Valley Traction Company, its successors and assigns, an electric railway franchise along and _ I across a portion of Cleveland Boulevard and Twentieth Avenue South, in the City of Caldwell, Idaho ", was read the first time.
