The Meeting was called to order by Mayor Pasley, Page 254 The Roll of the City Council was called with the followng members present: McCluskey., Raymond, Banks, and Bauman. Absent: Olesen and Williams. (APPOINTMENT OF CITY ATTORNEY) The Mayor stated that the purpose of the Special Meeting being called was to replace the City Attorney as a letter of resignation was received from the present City Attorney, Kenneth Roberts, and accepted by the Council. He further explained that he would like to present this appointment in a different form than usual. The appointments would be just to the end of the year until a new Mayor and City Council were elected. Dennis Goff, Assistant Prosecuting Attorney, was the Mayor's recommendation to handle the City of Caldwell's prosecution work for $300_.00 a month. The Mayor then presented the 'firm of Alexanderson; Davis; Rainey, and Whitney to handle the other work, with Mr. Alexanderson having nothing to do with it. The firm would be paid on an hourly basis and when their services- were needed the Attorney available would be the one contactec This would also be until the first of the year. The'Mayor had discussed this with both Mr_. Goff and the firm of Alexanderson, Davis, Rainey, and Whitney and`he would like to officially present this to the City Council for their approval. MOVED by McCluskey, SECONDED by Banks that approval be given for Dennis Goff, Assistant Prosecuting Attorney, to handle the City of Caldwell's prosecution work and for the .firm of Alexanderson, Davis, Rainey, and Whitney to handle the other City of Caldwell's legal matters and payment to be'as stated by`the °Mayor: Some discussion then followed this motion. Councilman McCluskey said that he felt it was an excellent opportunity to try this arrangement out for a period of time. He further.,explained that °— ,. the Attorney would not be required to appear at the City Council Meetings, but when an opinion was needed the Mayor would submit the request in writing., It was also suggested that an itemized statement be submitted by.them each month. Councilman Raymond inquired as to the legality'invblvino nepotism in this case. The Mayor informed them that he had received a letter from the State Attorney General's•` Office stating that it was not a problem in this case. Roll call vote.. Those voting yes: McCluskey, Banks, and Bauman. Those voting no: Raymond. Absent and not voting: Williams and Olesen.
