VJhereuoon the Mayor declared the motion c erried and Resolution No. 15, adopted, and directed the Clerk to record the same upon the journal of the proceedings of the Council as a next of the minutes of this meeting, and thereupon the Mayor and the Clerk in open Council duly zi•aed and approved said Resolution. It was moved by Leighty, seconded by Johns, that the Mayor and Councilmen Dickens and Sandmeyer be named as a committee to act in carrying out and ms'cing the improvement provided for in Resolution No. 15, with power to act. Motion carried. It was moved by Leighty, seconded by Dickens, t'7at the City join witlf Canyon County in the purchase of a car of piling. Motion carried. Mr. J. H: Forbes presented a, claim in the sum of $3961.06, being estimate for work done on contract in Local Street Improvement District No. S, from Sept. 1st. to Sept. l9th, 1929. Thereupon it ras moved by Gordon, seconded by Dickens, that the claim Of J. H. Forbes for $3961 covering estimate for work done on contract in Local Street Improvement District No. 8, from Sept. let. to Sept. 19th, 1929 be allowed Motion c arri It was moved by Sandmeyer, second --d by Johns that a committee of two be appointed to investi„ ate the amount of dirt which can be moved by team and by Fresno with Caterpillar, and present - report to the Council at an early date. M. I yl i Council met in regular session persuant to adjournment of Sept. 19, 1929, with Mayor McConnel presiding, and Councilmen _`OL1L AN, DICKENS, GOROON, JOHNS, LEIGHTY AND SANDMEYER, PRESENT. ABSENT: NONE. Owing to the absence of the City Cleric, the „Isyo* appointed Mr. W. C. D,vet ^.s Acting Clerk, and announced that the Council was in session for the consideration of any business vhieh mieht lawfully come before it. Mr. LI. H. Eustace apreared before the Council, in connection with the proceeding for the organization of Local Street Improvement District No. 10, and su ---ested that if the )reparation of the assess,µent roll were deferred until after letting contracts for the improvement, a more equitable osocssment roll could he prepared. Thereupon Councilman Bollman introduced Bill NO. 7, By Bollman, entitled: "AN ORDINANCE Ai4END173 ORDINANCE 110. 47 ESITITLF.D "AN ORDINANCE CREATING AND ESTA3LISHIIIG A LOCAL I;YPROVEi�NT DISTRICT, IN DALD'IVELL, IDAHO, TO BE CALLED 'LOCAL STREET IMPROVEMENT DISTRICT NO. 10, FOR THE CITY OF CALDWELL, CANYON COUNTY, IDAHO'' DESIGNATING THE STREETS AND POINTS 3ETWEEN 11HICH SAID IkPr'CVE^ ^.ENT SHALL BE MADE AND PROVIDING FOR THE CONSTRUCTION OF A STREET LIGHTING SYSTEM TI ?EFEOft`; PROVIDING THAT THE COST AND EXPENSES OF SAID IMPROVE1 SHALL BE TAXED AND ASSESSED UPON ALL THE ?ROPFRTY IRT SAID I31PROVEi:BNT DISTRICT, FRONTING OF ABUTTING OR CONTIGUOUS OF TRIBUTARY TO THE PORTIONS OF SAID STREETS SO IMPROVED; PRESCRIBING THE tETHOD OF SUCH ASSESSMENT AND THE PAYMENT THEREOF; REPEALING P.LL ORDINANCES, R_TSOLUTIONS OR ,,RDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DECLARING AN EIIIERGEb10Y;" BY ADDING A NEW SECTION THERETO TO BE YNOWN AS SECTION 4a, DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS FOR MATERIALS FOP. THE CONSTRUCTION OF SAID IMPROVEMENT AND THE INSTALLATION THEREOF; SPECIFYING PROCEDURE; AND REPEALING ALL ORDINANCES OR PARTS OF OFDINANCES IN COMPLICT HD<REWITH. which was read for the first time, and the Council proceeded to a consideration of Bill No. 7. It ;vas :coved by Sollmon duly seconded by Leighty that all rules recuiring the reading of a bill on three sepa rite Adays be suspended and that Bill No. 7, be read the second time by title and the third time in full and placed on its final passage. The Mayor caused the Clerk to call the roll on the motion with the folloviing results: Those voting in the affirmative: Rollman, Dickens, Gordon, Johns, Leighty and Sandmeyer. Those voting in the negative: None. Absent: None. So the Mayor declared the motion had passed by the necessary three - fourths majority, and directed the Clerk to re ^d Bill No. 7, the second time by title and the third time in full, section by section. The Cleri: read the 3111 as directed. Thereupon the Mayor declared Bill No. 7 has pessed, and thereupon the Mayor and Clerk is open session of the Council duly s.iLned and approved -aid Bill which became Ordinance NO., 474. The Mayor thereupon directed the Clerk to make the proper entry of the same and cause , Ordinance No. 474 to be published in the Caldwell, News Tribune,. the official newspaper oI the City of Caldwell, County of Cnnyon, State of Idaho. Thereupon the City Engineer presented n. form of Call for aids, which is in words and figures, as follows: CALL FOR BIDS NTOTIOE OF RECEIVING SIDS IN LOCAL STREET IMPROVEMENT DISTRICT 1TUM13ER 10. Sealed proposals and bide will be received, by the City Council. of Caldwell, Idaho, at the office of the City Clerk in the City Hall until the 14th day of October, 1929 at 5 o'clock P.M. for the construction of a street li,hting system on those streets described in Local Street Improvement District No. 10. . The estimated amount of the +-ork trhieh includes the furnishing of all materials and equipment is as follow:: Ornamental Lighting Strndards conmlete; 1 each. Underground cable; 12750.0 Lip.. Ft. Street croesing.s, 1750.0 Lin. Ft. Said improvements to be constructed according to plane and enecific?tiors approved by the Council and r ore' on file in the Office of the City Engineer. Cony of the acme will be sent u,on payment of $5.OG to the City Clerk. No proposal or bid will. be considered unless accompanied by a certified check of a Caldwell bank in favor of the City of Caldwell for 5 percent of the amount bi as evidence of good faith, to be forfeited if the successful bidder fails, neglects or refuses to enter into a contract, and provide a suitable bond for the faithful nerfor- mance of the work and protection of the labor and material men, in case the contract is awarded him. Said bond is to be for a sam equal to the total amount of the successful bid. The City reserves the right to pay for the work either in cash or in bonds of the district. The right is reserved to reject any and ell bids or to let the work a.s a whole or in part as may apnear to the best interest of the City. By order of the Council this 23rd day of September, 1929. W.
