Mayor Simmerman offered the following parcel of land, dasignated as No. 1, to the hiehest bidder: rarcel No. 1: Lots 1,-," 15 and 16 in Block 130, Strahorn Addition to the City of Caldwell, as the same is shown on the official plat thereof, on fileand of record in the office of the Re- corder of Canyon County, Idaho. Bill No 10 (Annexation) This -.eing the time set for the second reading of Bill No 10, the Bill was read the second time by title. i I I i I I I 1 �I 63 I 7 I I i 7 lI l l � I] Protests ( Annexatim) Mr. Wayne Davis, representing Fr -d Soecht, protested the annexation of Mr. Soecht's property which consists of approximately 60 acres of farm land. Mr. Davis stated to include this property would be premature and unfair at this time and on behalf of Mr. Soecht teen. -?ed the City to omit this property from the proposed annexation. Councilman Vassar inquired if I9r. Snecht would object to annexation if his property on the north- side of Franklin Road was included, provided the property on the southside of Franklin Road was excluded from the proposed area to be annexed. Mr. Davis was requested to contact Mr. Snecht andreport back to the Mayor. Wm F. Gigray r., representing Jim (duller, stated the City was not justified in annexing the pro- perty owned by Mr. Muller. Councilman Smith explained the benefits this area would receive from a zoning standpoint. Councilman Finley discussed County zoning. Councilman Shorb stated the Cound 1 was trying to plan for future expansion of the City. Mayor Simmerman informed Mr. Davis and Mr. Gigray the Council was trying to do what they considered best for the future development of Caldwell. Mr. Davis stated he would file a formal protest within the next few days. Audit Tony Messurri, representing Jackson - Messuri presented the 1959 -60 audit for Council Approval. Mr. Messuri informed the Council a report on the office study would be made in the near future. Mayor Simmerman stated the preliminary plans for the Armory have been received. College of Idaho request to vacate loft slrin on Midrigan . - City Engineer discussed the request of the College of Idaho 8aa for vacating a ten foot strip on Michigan for gas line installation. Moved by Sidredge, seconded by Finley this request be denied. Upon Roll Call it appeared the motion was unanimously carried. Airoort , Mayor Sirmnerman reported on the proposed zoning at the Airoort and informed the Council that he had talked to Mr. Chet Moulten who had sugge-ted that the City obtain from the City of Boise a Cony Of their ordinance governing zoning for airports. A copy of the ordinance has been received and the Building Inspector, City Engineer and Councilman Luby are to give a report to the Councilmon this ordinance. En-�ineering Station flagon. City Engineer reported the station wavon belonging to the Engineering Department has been involved in an accident and the Farm Bureau Mutual Insurance Co of Idaho, carrier for the party causing the damages has refused to allow the claim. Actor ^ey to bring suit to collect damages. City Attorney was instructed to oring suit against the comoany to recover damages. Councilman Shorb gave a report on the meeting held in Caldwell by State Librarians of this area. Annexation ( compromise p- onosed ) Some further discussion of the Ordinance bein- read for annexation of certain lands on Canyon Hill was had, after which Councilman Eldredge moved and Councilman Shorb seconded that Mr. Wayne Davis be con- sulted and if this client was agreeable to compromise, that the south 40 acres of the Fred Snecht property be excluded from annexation, that the description in the Ordinance be changed accordingly and published for action atthe next regular meeting of the Council but that if such a compromise was not agreeable; the bound - cries be left to read as they are at the present time. That, whereas, there exists in the Water and Sewer Funds a surplus of TWENTY THOUSAND & NOAOO 020,000.00) DOLLARS in excess of funds required for the Bond Sinking Funds required by the Water and Sewer Bond Ordinance.. IT 15 TH'REFOR ORDERSD, That the City Treasurer is hereby authorized to transfer from the Water and Sewer Funds to the General Fund the sum of TWENTY TE:')U9AND & 1 i0 /100 ($20,000.00) DOLLARS.
