Council met in regular session perauant to adjournment of Sept. 3, 192.9, with Mayor McConnel•presiding, and Councilmen SOLLMAN, DICKENS, GORDON, JOHNS, LVIGHTY AND SANDMEYER, PRESENT. ASSENT: NONE. Owing to the arsence of the City Clerk, the Mayor appointed Mr. w. C. Dyer as Acting Clerk, and announced that the Council was in session for the consideration of any business which might lFwfully come before it. The Street Committee reported that the middle of Main Street between the easterly side of the intersection of third avenue, and the easterly side of the inter- section of ninth avenue, and the intersection of tenth avenue south with Cleveland Blvd., has since the Annual appropri ^tion for 1929 become in such defective state of repair as to become a menace to the health and safety' of the citizens of the city, and the public in general. Thereupon Councilman Dickens introduced' the following Resolution and moved its adoption: RESOLUTION NO. 15, BY DICKENS. A RESOLUTION DECLARING AN EMERGENCY, FOR THE REPAIR AND RESTORATION OF THE PAVING UPON In'kIN STREET, BET',VEEN THIRD AVENUE AND 1TIN AVENUE and AT THE INTERSECTION' OF TENTH AVENUE AND C1,7VELAND BOULEVARD, AND PTHORI?IfTG TN, 7AYOR AND CITY CCUtFCIL TO ENTER INTO AN AGREEMENT FOR THE REPAIR OF THE SAME, NOT EXCEEDING THE sumE OF $41o0.o0 WHEREAS, It is provided by Section 4056, Idaho Compiled Statues, that the City Council may, order, by two- thirds vote, the repair of restoration.of any improve- ment, the necessity for which is caused by any casualty of incident happening after the annual appropriation is made; and WHEREAS, All thet certain strip of pavement lying in the center 'of 11ein Street from Third Avenue to ?'inth Avenue, and in the intersection of Tenth Avenue' and Cleveland Blvd., where the tracks of the Boise Volley Traction Co., are laid has, cithee'the passe ;e of the annual aplropriation for 1929, become so deteriorated and unsafe no to require immediate replacement and repair in order to properly safeguard the lives and safety of the citizens of the City of Caldwell and the pudic in trereral, and the City Council has, by a two - thirds vote thereof, deaned it necessary tF t said streets be restored, and repaired; therefore, Be it Resolved., By the Mayor 2nd Council of the City of Caldwell, Idaho. Section 1. That an e.ner?ency has arisen since the passaue of the last annual rppropristion for the year 1?29, a.nd the same now exiRte, % it becomes necessary that the City of Caldwell, immediately repair, reconstruct and. restore that certain str of pavement lying in the center of Main Street, where the Boise Valley Traction Co., tracks were laid,, between Third Avenue and Ninth Avenue upon said M -in Street in the Ci of Caldwell, and at the intersection of Tenth Avenue and Cleveland Blvd., in order to protect and safegu the lives and safety of the citizens of Caldwell, and the public in general, Section 2. That the costs of said repair, restoration and reconstruction of said streets, shall not exceed the sum of #4100.00 Section 3. That the Mayor and City Council shall, immediately enter into an agreement with some construction company, capable of mskiny caid repeirc, restorations and reconstruction, for the repair of the same, at not to exceed the su ±n of 44100.00 0 I I I� i I Q� $L a The -motion for the adoption of said resolution was duly seconded by Bollman, The question being "Shall the resolution pass? The Mayor directed the Clerk to call the roll, which resulted Gs follows: Those voting in the affirmative; Bollman, Dickens Gordon, Johns, Leighty and Sa.ndmeyer, Those voting the nestive: None. Absent and not voting:: None. Whereupon the Mayor declared the motion carried and Resolution No. 18, adopted, and directed the Clerk to record the same upon the journal of the proceedings of the Council as a part of the minutes of this rceeting, and thereupon the Mayor and the Clerk in open Council duly signed and approved said Resolution. It was moved by Leighty, seconded by Johns, that the mayor and Councilmen Dickens and Eandmeyer be named as a committee to act in carrying out and m ^_king the improvement provided for in Resolution he. 19, rrith po'k'er to act. Motion carried. It was moved by Leighty, ceconded by Dickens, that the City join with Canyon. County in the purchase of a car of piling. Motion carried. Mr. J. H. Follbes presented a. claim in the sum of !h3961.06, being estimate for work done on contract in Local Street Improvement District No. 8`, from Sent. 1st. to Sept. 19th, 192 Thereupon it was moved by Gordon, seconded by Dickens, that the claim of J. H. Forbes for X3961.06 covering estimate for York done on contract in Local Street Improvement District No. 8, from Sept. let. to Sept. 19th, 1929 be allowed. Motion carrie It was mcved by Sandmeyer, seconded by Johns that a committee of two be appointed to investigate the uaount of dirt which can be moved by teem and by Fresno with Caterpillar, and present report to the Council at an early date. Motion married. The Mayor appointed Councilmen Dickens & Bollman to serve on such Committee. Eustaoe apreared before the Council, in connection vritb the proceeding; for the organization of Local Street Improvement District No. 10, and sulgested that if the preparation of the assessment roll were deferred until after letting contracts for the improvement, a more equitable assessment roll could be prepared.
