The Council met pursuant to recess and acknowledgement of notice in the following form: We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do each hereby acknowledge notice of a Recessed Meeting of the said City Council, to be held in the Council Chambers in the City Hall in the City of Caldwell, Idaho, at the hour of 8 :00 P.M., on the 17th day of September, 1962, for the transaction of all business in connection with the following object: New and unfinished business. Upon roll call, the following Councilman answered present: E. L. Vassar, Emile Shorb, Max Luby and N. E. "Coley" Smith. Absent: V. Jay Martin. Mayor Simmerman announced the first order of business would be filling the vacancy of office of Councilman from the third ward created by the resignation of Dr. Charles E. Krause. He then recommended the appointment of C. A. Davenport, a resident of the third ward and a property owner. A motion was made by Councilman Vassar, seconded by Councilman Smith that the appointment be confirmed. Motion carried. The Mayor then asked Attorney Dean Miller to call Mr. Davenport on the phone and notify him of the appoint- ment and ask him to come down to be sworn in. The next order of business was the hearing of protests on Local Improvement District No. 51, the sewer district that is being created west of 10th street and north of Linden St. There being none, Attorney Dean Miller was asked to prepare the ordinance creating and establishing the district. Due to ill health, Mr. W. W. McDowell has sold his garbage hauling business to Seal Brothers. The Mayor, after reading the contract agreement between W. W. McDowell and the City of Caldwell, stated it would be his recommendation that the Council authorize the Mayor and Clerk to draw up a similar agreemen with Seal Brothers and sign it in the interest of the City. After some discussion by the Council, ascerta.1 the eligibility of the Seal Brothers, it was moved by Councilman Shorb, seconded by Councilman Vassar that the contract for hauling wet garbage be drawn up on the same terms as the one with Mr. McDowell. The contract to run from year to year with option to renew, the expiration date being December 31st of each yea Motion carried. Mayor Simmerman reported that at the request of the Council some time had been spent by himself, the Engineer and Building Inspector studying the request of Mr. Hoff to change part of his property from residential to commercial zone. He stated they were not ready to make a recommendation on it yet but would discuss it with the zoning board at their meeting September 18th. Mayor Simmerman reported he had received one bid on the old grandstand down at the rodeo grounds from a Mr. Ray Salisbury of Route 2, Caldwell. Mr. Salisbury agreed that he will have it all torn down I and moved out of town by the 10th of November, The concrete foundation blocks will be retained by the City to be used as fill on Belmont Street. There is to be no monetary consideration. A motion was made by Councilman Vassar, seconded by Councilman Luby that we take the offer made by Ray Salisbury of Route 2, Caldwell, to take the old grandstand off the present site. Motion carried. Mayor Simmerman stated he would contact Mr. Salisbury with regards to an agreement regarding this matter. Mr. Bill Swenson, Mr. Bill Roberts, Mr. Dick Hurst, Mr, Charles Bratton and Mr. Bob Rookstool were present to discuss further the traffic and nuisance problems at the Quick Curb. Mayor Simmerman re- ported that he, the Chief of Police and the City Engineer had talked with Mr. McCluskey, owner of the Quick Curb, and with the owner of the Dry Cleaning Establishment adjoining and they are both very much interested in putting up a fence to close the alley entering Oak St. They also agreed to clean up the weed situation out there. The Mayor stated as a result of their investigations signs have been ordered from the Peniten- tiary, one to be placed entering Oak Sto from the Quick Curb stating "No Right Hand Turn" and one placed on So. Indiana Ave. entering Oak St. stating "No Left Hand Turn". Mr. Bill Roberts asked if putting dips in the street had been completely ruled out and the Mayor stated they would prefer to s olve the problem some other way if possible, even putting up a Stop Sign out of the Quick Curb onto Oak St. if necessary. Mr. Bratton asked if we have a curfew law in Caldwell. The Mayor replied in the affirmative. It was then asked if it is enforced, to which the Mayor replied "No", further explaining that the history of. curfews is that they are terrifically hard to enforce. Mr. Swenson mentioned the traffic problem concerning the "U" turning at the East Cleveland Market to which the Mayor replied, they were aware of the problem and were watching it. Mr. Bill Roberts thanked the Council and Mayor for their patience and consideration in listening to their problems, and then left the Council Chambers. Mr. William West and Mr. Herbert Spencer, representing Residential Improvement Co. appeared before the Council with applications asking that the $10.00 per day solicitor's license fee be reduced to $3.00 per quarter. On motion by Councilman Smith, seconded by Councilman Luby these applications were approved. At this time Mr. C. A. Davenport entered the Council Chambers and was given the oath of office as Councilman from the Third Ward by Attorney Dean Miller. After being congratulated by Mayor Simmerman, Mr. Davenport made the following statement: "Even though I realize the responsibilities that are mine in accepting this appointment I feel that it will be difficult to fill the seat which was occupied by Charles Krause. I was sorry to see him leave the Council. I believe in Caldwell. I would like to see Caldwell grow in a good normal solid manner and I will do everything that I can and extend every effort possible to fulfill this ,job as Councilman for the people of my ward and work for all the citizens of Caldwell. I will support all ventures that I think are beneficial to the City of Caldwell and are aonsistaut with good management in the community." Councilman Vassar reported the street crossing at 13th and Clsveland,goimg south, is in need of repair. The Engineer reported they expect to get that street repaired this fall. Councilman Smith reported on his representation of the City at an Urban Renewal Program meeting of the Public Housing Administration, Housing and Home Finance Agency, in San Francisco last week. Mayor Simmerman reported on his trip to the annual convention in Pocatello of the Idaho Association of County Commissioners and Clerks, at which he represented the Idaho Municipal Leage as Vice - President. He also reported on his trip to Philadelphia where he attended the American Municipal Association Convention. City Engineer, Melvin Lewis, having also attended the A.M.A. meeting was asked by the Mayor to supplement his report. Mayor Simmerman suggested the Council Table name plate of Dr. Krause be given to him. (ESL /� AJ,��X�PitiYYLdt'�' ayor The Council met pursuant to call of the Mayor and acknowledgement of notice in the following form: We, the undersigned Mayor and 4 embers of the City Council of the City of Caldwell Idaho, do each hereby 'acknowledge notice of a Special Meeting of the said City Council to be held in the Council Chambers i the City Hall in the City of Caldwell, Idaho, at the hour of 9:00 A. M. on the 21st day of September, 1962, for the transaction of all business in connection with the following objects Consideration of Bill No. 17. Witness our signatures this 21st day of September, 1962. M ayor Upon Roll Call the following Councilmen answered presents E. L. Vassar, Emile Shorb, V. Jay Martin, N. E. "Coley" Smith, and C. A. Davenport, Absent: Max Loby. Bill No. 17 - Ordinance No. 997 Thereupon Councilman Shorb introduced Bill No. 17, entitled: AN ORDINANCE CREATING AHD ESTABLISHING A LOCAL SEWER IMPROVEMENT DISTRICT TO BE CALLED AND KNOWN AS "LOCAL IMPROVEMENT DISTRICT NO. 51 FOR THE CITY CF C ALDWEL.7 , IDXHO "; DESIGNATING THE BOUNDARIES OF SAID DISTRICT AND THE POINTS BETWEEN WHICH SAID IMPROVEMENT IS TO BE MADE; AND PROVIDING FOR THE CONSTRUCTION OF SUITABLE SEAERS,'DITCRES, DRAINS, CONDUITS AND CHANNELS FOR SANITARY PURPOSES WITH CUTLETS, MANHOLES, CATCH BASINS, FLUSH TANKS AND ALL OTHER SEWER APPURTENANCES NECESSARY FOR THE COMFORT, CONVENIENCE, HEALTH AND WELL -BEING OF SAID CITY; PROVIDING THAT THE COST AND EXPENSE OF THE SAID IMPROVEMENT SHALL BE TAM AND ASSESSED UPON ALL OF THE PROPERTY WITHIN THE SAID IMPROVEMENT DISTRICT ABUTTING, ADJOINING, CONTIGUOUS, AND ADJACENT TO THE SAID IMPROVEMENT AND UPON THE LOTS AND LANDS BENEFITED BY SUCH IMPROMONT AND INCLUDED IN THE IMPROVE- MENT DISTRICT; PRESCRIBING THE METHOD OF SUCH ASSESSMENT AND PAYMENT THEREOF; DIRECTING THE CITY CLERK TO ADVERTISE FOR AND RECEIVE BIDS FOR SUCH MATERIALS AS MAY BE DESIGNATED BY THE COUNCIL FOR SUCH IMPROVEMENT AND OF DOING THE WORK AND LABOR FCR CONSTRUCTION OF THE SAME; REPEALING ALL ORDINANCES, RESOLUTIONS, OR ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH AND DECLARING AN EMERGENCY. which was read for the first time and the Council proceeded to consideration of Bill No. 17. It was moved by Councilman Smith, seconded by Councilman Shorb that the rules requiring the reading of a Bill on three separate days be suspended and that Bill No. 17 be read the second time by title and the third time in full, section by section, and placed on the final passage. The Mayor directed the Clerk to call the roll on the above motion with the following results Those voting in the affirmative were: Vassar, Shorb, Martin, Smith Mayor Ed Si:merman presiding.
