SEPTEMBER 16, 2002
7:00 P.M.
The Meeting was called to order by Mayor Nancolas.
The Invocation was offered by Royce Wright, of the Oasis Worship Center. The Mayor asked
everyone to please remain standing for the Pledge of Allegiance.
The Roll of the City Council was called with the following members present: Ozuna, Wells,
Blacker, Callsen, and Hopper. Absent: Dakan.
SPECIAL PRESENTATIONS.
The Mayor recognized members of the Police Department who had requested a few moments at
the beginning of the Regular Council Meeting. Bill Crawford, President of the Police Association,
addressed the Mayor and Council stating that on behalf of the City of Caldwell Police Department,
the Association wanted to recognize the Mayor, the Finance Director and Members of the City
Council. As everyone recalls, Police Departments all over the Nation have received a lot of
recognition because of the 9/11 tragedy and the situation that followed. However, they cannot do
their job without the support of our City Government. We do appreciate them and would like to
present them with a plaque stating: "To Mayor Nancolas, Finance Director E1Jay Waite and
Members of the Council including Councilpersons Ozuna, Wells, Callsen, Dakan, Blacker and
Hopper, in appreciation for your outstanding support for the Caldwell Police Department' It
means a lot to every member of our Department and this recognition comes from everyone in the
Association and their families. On behalf of the Association, we thank all of you.
The Mayor stated that this was very nice and appreciated. It was easy to support such a fine group
of individuals as we have working for us in the City of Caldwell and thank you for the protection
you give to the citizens of this Community. We were grateful for your compassion and the things
that you do for us.
ADDITIONS OR DELETIONS TO THE AGENDA.
Since there were no additions or deletions to the prepared Agenda, it was MOVED by Ozuna,
SECONDED by Blacker to approve the Agenda as printed.
Roll call vote. Those voting yes: Ozuna, Wells, Blacker, Callsen, and Hopper. Those voting no:
none. Absent and not voting: Dakan.

AUDIENCE PARTICIPATION.
The Mayor asked if there was anyone in the audience who cared to address the Council at this
time.
Tom Deknijf, 909 Dearborn, was recognized and briefly discussed a notice he received with
regard to sidewalk repair. He stated that the whole block where he lived was being sold and he
wondered if there was any way they could postpone the work on the sidewalk
The Mayor informed him that this was already taken care of and he should have received a letter
from the City. The Council took action to not take action in this area. When the project was
started, the City was not aware of this project. Basically, as long as the project keeps moving
forward, Council was happy and we know that the sidewalks will be addressed in time.
CONSENT CALENDAR:
The Mayor presented the following items on the Consent Calendar for consideration by the City
Council:
1. Dispense with the reading of the minutes of the September 3, 2002 Regular City Council
Meeting and approve as written;
2. Approve acceptance of the minutes from the Caldwell Traffic Commission Meeting of
September 4, 2002 and the Caldwell Airport Commission meeting of August 1, 2002;
3. Approve the following Resolution to authorize execution of an Agreement with Montgomery
Watson Harza for a Bio- Solids Study:
BE IT HEREBY RESOLVED by the Mayor and Council of the City of Caldwell, Idaho, that
the Mayor and Clerk of said City are hereby authorized to execute that certain Agreement
titled "Agreement for Engineering Services; Caldwell Wastewater Treatment Plan
Improvements; Bio - Solids Study'; by and between said City and Montgomery Watson Harza,
which Agreement is for the performance of engineering services related to bio- solids handling
at the Caldwell Wastewater Treatment Plant and which Agreement is attached hereto and
made a part hereof as if set forth in full.
4. Approve the following Resolution to authorize acceptance of a Crossing Agreements with the
Bureau of Reclamation and Pioneer Irrigation District:
A RESOLUTION BY THE CITY OF CALDWELL, IDAHO APPROVING CROSSING
AGREEMENT WITH BUREAU OF RECLAMATION AND PIONEER IRRIGATION
DISTRICT.
BE IT RESOLVED That the City of Caldwell, Idaho hereby approves Crossing
Agreements with Pioneer Irrigation District and the Bureau of Reclamation attached hereto in
full and hereby made apart of this Resolution. Said Crossing Agreement is for the Solomon
Canal across Linden Street.
5. Approve Orders of Decision on Steunenberg Residential Historic District; Hampton Business
Center; Weston Pointe plat extension; Cedars Subdivision preliminary plat; Aspens
Subdivision preliminary plat; Carrington Plaza preliminary plat and Castagneto rezone;
6. Approve the following Resolution to authorize the purchase of equipment for weed control:
BE IT HEREBY RESOLVED by the Mayor and Council of the City of Caldwell, Idaho, that
the City Engineer, Finance Director, and Street Superintendent are hereby directed to
purchase equipment to support weed control operations for the coming fiscal year and said
equipment purchase to be by lease - purchase option.
MOVED by Hopper, SECONDED by Callsen to approve the Consent Calendar as presented by
Mayor Nancolas.

OLD BUSINESS
(CONSIDER BILL NO. 40 REGARDING CASTAGNETO REZONE, WITH REQUEST TO
WAIVE THE RULES AND PASS ON THE FIRST READING BY TITLE ONLY AND ALSO
APPROVE SUMMARY FOR PUBLICATION)
The Mayor explained that this Bill was discussed at the last Council Meeting and the Bill was now
being brought forward to be considered by the City Council. Bill No. 40 was read by the Mayor
as follows:
AN ORDINANCE TO PROVIDE A C-4 (FREEWAY COMMERCIAL) ZONE DESIGNATION
FOR CERTAIN LANDS; DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST
OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE CITY ENGINEER AND
COMMUNITY DEVELOPMENT DIRECTOR TO DESIGNATE SAID PROPERTY AS C -4 ON
THE OFFICIAL ZONING MAP AND OTHER AREA MAPS OF THE CITY REPEALING ALL
LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
MOVED by Hopper, SECONDED by Callsen to waive the rules requiring that a Bill be read at
three separate times and read in full for one reading and pass at this time.
Roll call vote. Those voting yes: Hopper, Ozuna, Wells, Blacker, and Callsen. Those voting no:
none. Absent and not voting: Dakan.

No. 2444 after the one reading by title only and approve the Summary for publication.

NEW BUSINESS
(CONSIDER BILL NO. 39, CONSOLIDATED BONDING ORDINANCE FOR CONSOLIDATED
LOCAL IMPROVEMENT DISTRICT NO. EIGHT WITH REQUEST TO WAIVE THE RULES
AND PASS ON THE FIRST READING BY TITLE ONLY AND APPROVE THE SUMMARY FOR
PUBLICATION)
The Mayor stated that the next item on the Agenda was to consider Bill No. 39. At the suggestion
of Mr. Ayres, the City has been consolidating the Local Improvement Districts within the City.
This process has saved expenses which in turn, saves for those participating as well. At this time,
he requested that Mr. Ayres come forward with any comments he might have. Mr. Ayres
indicated that Eric Heringer would be addressing the Council on this matter.
Eric Heringer, from Seattle Northwest Securities, was recognized by the Mayor. He stated that to
consolidate several Local Improvement District has been done about eight times with the City of
Caldwell. They sold $331,843 in bonds today with an average coupon of 3.78% which was a low
rate. Mr. Heringer reviewed the process for the Mayor and Council's information.
Nick Miller, Attorney at Law, also addressed the Council with regard to the Bond Ordinance
which approves the issuance and sale of the bonds. He called attention to several items in the
document and asked if there were any questions at this time. Mr. Miller also noted that the
interest rate was favorable. He also suggested that Council consider suspending the rules and
passing the Ordinance on the first reading and to approve the Summary for publication.
The Mayor then read Bill No. 39 by title only as follows:
AN ORDINANCE PROVIDING FOR THE PAYMENT AND COLLECTION OF SPECIAL
ASSESSMENTS LEVIED IN LOCAL IMPROVEMENT DISTRICT NOS. 99 -3, 00 -3, 01 -1, 01-
2 AND 01 -3 FOR THE CITY OF CALDWELL, IDAHO; PROVIDING FOR THE HANDLING
OF FUNDS RECEIVED FROM SPECIAL ASSESSMENTS AND THE CREATION AND
ENFORCEMENT OF LIENS IN CONNECTION WITH THE SALE AND ISSUANCE OF
BONDS; COMBINING AND CONSOLIDATING LOCAL IMPROVEMENT DISTRICT NOS.
99 -3, 00 -3, 01 -1, 01 -2 AND 01 -3 INTO A CONSOLIDATED DISTRICT DESIGNATED
CONSOLIDATED LOCAL IMPROVEMENT DISTRICT NO. 8, AUTHORIZING THE
ISSUANCE AND CONFIRMING THE SALE OF $331,843 CONSOLIDATED LOCAL
IMPROVEMENT DISTRICT NO. 8 BONDS, SERIES 2002, CREATING CONSOLIDATED
LOCAL IMPROVEMENT DISTRICT NO. 8 BOND FUND, INTEREST FUND AND PROJECT
FUND; PROVIDING FOR PAYMENT FROM A GUARANTEE FUND; PROVIDING FOR A
SYSTEM OF REGISTRATION THEREFOR; PRESCRIBING DETAILS CONCERNING THE
FOREGOING; ALLOCATING TO THE DISTRICTS A PORTION OF THE CITY'S SMALL
ISSUER AUTHORITY FOR PURPOSES OF EXEMPTION FROM ARBITRAGE REBATE;
PROVIDING FOR A REASSESSMENT OF ASSESSMENTS AND THE REISSUE OF
BONDS; REPEALING CONFLICTING PROCEEDINGS; ORDERING PUBLICATION;
PROVIDING IRREPEALABILITY; PROVIDING SEVERABILITY; AND DECLARING AN
EMERGENCY.
MOVED by Hopper, SECONDED by Callsen to waive the rules requiring that a Bill be read at
three separate times and read in full for one reading and pass after the one reading.
Roll call vote. Those voting yes: Hopper, Ozuna, Wells, Blacker, and Callsen. Those voting no:

The Mayor asked for a short recess to sign the appropriate documents.
The Mayor then called the meeting back to order and proceeded with the Agenda as prepared.
(CONSIDER RESOLUTION 69 -02 TO AUTHORIZE EXECUTION OF ANIMAL CONTROL
AGREEMENT BETWEEN THE CITY OF CALDWELL AND CANYON COUNTY)
The Mayor stated that the next item on the Agenda was to consider a Resolution authorizing the
Animal Control Agreement which was recommended for approval by the Finance Director, who
has been negotiating with the County. This new Agreement reflects exactly the same agreement
as previously with a three percent increase. The City told the County that this was the maximum
increase they would accept at this time.
Councilman Wells asked whether this agreement would include cats. Mayor Nancolas stated that
this Agreement would include whatever the Ordinances were within the jurisdictions. The City of
Caldwell does not have a cat ordinance in place. Felines that were taken there would be
addressed. The Chief of Police discussed cats being included during an Appointed Officials
Meeting several months ago and noted that he simply did not have the manpower or ability to
address it at that time. It was decided at that time to not address including cats. The Mayor also
stated that several of the smaller communities have discussed getting together and putting
something together with regard to cats. He knew they were meeting, but no hard numbers were
available as yet.
The Mayor read the Resolution as follows:
RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
RENEWAL OF THE ANIMAL CONTROL AGREEMENT BETWEEN THE CITY OF
CALDWELL AND CANYON COUNTY.
BE IT RESOLVED That the Mayor and City Clerk of the City of Caldwell be, and the same
hereby are, authorized to execute a renewal of the Animal Control Agreement as attached hereto
and made a part hereof as if set forth in full by and between the City of Caldwell and Canyon
County.
