HomeMy WebLinkAbout1935-09-16city council minutesIt was brought to the attention of the Mayor and Council that the airport week becoming covered with long grass and weeds and that it would be necesary to mow it to keep it in good condition. ]oved by Boynton, seconded by Oakes that this matter be referred to the Airport ommittee with power to act. Motion carried. It was moved by Oakes, seconded by Mumford that the Council adjourn. Motion - carried. Mayor city Clerk COUNCIL CHAMBERS SEPTEMBER 16, 1935. 8:00 P. M. .The City bouncil met on call of the Mayor, with the Mayor, Emery L. Vassar, pre- siding. .On Roll Call the following Councilmen answered present: Edger L. Oakes, W.S. Boynton, k. D. Mumford, G.W. Montgomery, G. M. Fenricl and W. R. Hollingsworth. .Miss Blanche Waterman appeared before the Council and asked to have sidewalk taxes cancelled on Lot 7, New Home Addition. The matter was referred to the City Attorne, for investigation. Mr. Chas Robinson - appeared and stated that he wish to rene¢: the contract for hauling garbage. Moved by Oakes, seconded by Montgomery that the Mayor be and he is hereby authors; to make an execute a new contract with Mr. Robinson for hauling garbage for pne•year as provided by the ordinance of the City. On Roll Call the Following Councilmen voted in favor of the above motion: Oakes, Boynton, Mumford, Femrieh, Hollingsworth and Montgomery. Those opposed: None. Absent and not voting. None. Thereu -on the Mayor declared the above motion was carried, The Mayor appointed the City Engineer, City Attorney and Councilmen, Oakes and Boynton as a Committee to investigate Plumbing and Electtic inspection. Thereupon the City Attorney.advised the Mayor and Council that Ordinance No. 527 had not been properly passed due to the fact that the statue requires three - fourths vote of the whole council to pass an ordinance on suspended rules. That therefore the proceed - Inge had °on - September 3rd - on said ordinance amounted to the first reading only end that it would be necessary to read the ordinance the second and third tite.at this meeting. ,Thereupon it was moved by Fenrich, seconded by Boynton that all rules requiring a bill to'Tead on three separate days be suspended ant that Bill No. 10, proppaed Ordinanc No.527, be read the second time by title and the third time in full having been read the first time September 3rd. The Mayor direoted the Clerk to call the roll on the question stated, which resulted as follows: Those voting in the affirmative: M11 or4,1'Boyhtog, Fenrieh, Hollingsworth and Montgomery. Those voting in the negative: Oakes. Absent and not voting. None. The Mayor declared the motion carried by the necessary three - fourths majority and directed the Clerk to read Bill No 10, the second time by title and the third time in full section by section. The Clerk read the bill as directed. The question then being "Shall Bill No. 10, pass ?" The Mayor directed the Clerk to call the roll on the above question which resulted as follows: Those voting in the affirmative were: Z -1 -.- Mumford, Boynton, - _ enrich, Hollingsworth and Montgomery. Thereupon the Mayor declared Bill No. 10 had passed and the Mayor in open session of the Council duly signed and approved the Bill, and the Clerk duly signed and attested the same which became Ordinance No. 527. The Mayor directs the Clerk to make proper entry of the same and to souse Ordinance 527, to be published in the Caldwell Nawa- Tribune, the official newspaper of the City of Caldwell, Idaho. Thereupon, Councilman Fenrich, introduced Bill No 12, proposed Ordinance No. 529, by Fenrich, entitled: AN ORDINANCE AMENDING ORDINANCE NO. 5®d, ENTITLED "AN ORDINANCE DIVIDING THE CITY OFI ±CALDWELL, IDAHO, INTO DISTRICTS OR ZONES AND PRESCRIBING RESTRICT- IONS AND REGtTLATIONS AS TO HEIGHTS, RUMDER OF STORIES, SIZE OF BUILDINGSAND OTHER - STRUCTURES, THE PERCENT OF THE LOTS THAT MAY BE OCCUPIED, THE SIZE OF ..- YARDS, COURTS AND OTHER OPEN SPACES, AND THE LOCATION AND USES OF BUILDINGS, STRUCTURES AND LANDS, FOR RESIDENCE, TRADE, INDUSTRY AND OTHER PURPOSES WITH- IN THE SAID CITY, BY ADDING THERETO SECTIONS 43 AND 44 PRESCRIBING THE MIN- IMUM COST OF RESIDI,TICES TO BE ERECTED HEREAFTER IN RESIDENCE ZONES " A " AND "B" AND OTHER PARTS OF THE CITY OF CALDWELL, which was read for the first time and the Council proceeded to a consideration of Bill No 12, It was moved by Montgomery, seconded by Hollingsworth that the rules requiring that the reading of a bill on three separate days be suspended and that Bill No 12i be read the second time by title and the third time in full, section by section and placed on its final passage. The Mayor directed the Clerk to stall the roll on the motion with the fol- lowing results: Those voting in the affirmative were: Oakes, = enrich, Mumford, Boynton, Hollingsworth and Montgomery. Those voting in the negative. None. Absent and not vot- ing. -None. The Mayor declared the motion had passed by the necessary three - fourths majority and directed the Clerk to read Bill No.12, the second time by title and -the third time in full, section by section. The Clerk read the Bill as directed. The question then being "Shall Bill No.12 pass 7 The Mayor directed the Clerk to call the roll on the above question which resulted as follows: Those voting in the affirmative were: Oakes, Boynton, Mumford, FaLrich, Hollingsworth, and Montgomery. Those voting in the negative. t None: Absent and not voting: None. Thereupon, the Mayor declared Bill No. 12, had -passed, and the Mayor in open session of the Council duly signed and approved the Bill, an the Clerk duly signed and attested the same rhich became Ordinance 529. The Mayor directe the Clerk to make proper entry of the same and to cause Ordinance 529 to be published in the Caldwell News - Tribune, the official newspaper of the City of Caldwell, Idaho. The Mayor appointed the following on the Planning Board: E. L. Vassar, F.D. Mumford, Fred H. McConnel, Cleve Grooms, Minnie Davenport, W.T. �imbrough, Joe Dickens, Fil J. H. Gipson, Elizabeth Kaley, Mrs. Earl Wheeler, John Smeed and Dr. C.R. Whittueberger. Moved by Hollingsworth, by Boynton, that these appointments be confirmed.- On Roll Call the following Councilmen voted in f avor of the a,tovs motion: Oakes Boynton, Fenrich, Mumford, Montgomery and Hollingsworth.
