The following is an opinion as presented to the Mayor and Council by City Attorney Dean Miller: OPINION Sey te:eber 12, 1957. To the Mayor and City Council of the Cit of Caldwell, Idaho: You have asked for my opinion concerning the sale of the property by the airport to the Cha�:ber of Commerce for use of the Industrial Corporation. Under the provisions of Section 50 -1008, 1da),c er ode, the "ayor and City Council, by resolution, may sell any property of the municipality not acquired, used, or needed for public park, playground, or pubL c building site, and the property may be sold by publishing notice of intention to sell for two succe:aive weeks. The statute does not say iei,at tLe contents of the notice should be, and does not require that n sale should �e to the the hi;.iest bidder, or by auction, or set forth any particular terns. It is my opinion that a valid sale car, be n:ad e u'on a finding by the Council that the property was not acquired, is nor, used, and will not be needed for municipal purposes, and a further finding that the consideration is fair and equitable. I do not believe it necessary that the property be sold at auction, or by bid. HOWEVER, if at the time net for hearing there ie any substantial objection to the sale of the property, it may be unwise for the Council to sell it unless the consider - ation is genuinely adequate. Vassar, Fran @lomquist, Max Luby, I j Emile Shorb, L. 0. Eldredge and LEland Finley. Mayor Si,­rman reported several citizens had contacted him regarding the odor from beet pulp in Indian Creek. The City Attorney informed the Mayor and Council there was an injunction against the Amalgamated I. Sugar Co., restraining them fran contaminating Indian Creek with beet pulp and it would not be necessary ii for the City to file a complaint. Bids for a counter to be installed in the Office Building were road as follows. :enrich Cabinet Shop 5�-tO Caston Wocdaraft 63.84 Harnon Cabinet Shop 75.25 Moved by Short, seconded by Luby the bid submitted by Fenrich Cabinet Shop be accepted. These bids were referred to Councilmen Blomquist and Luby for study and report back to Council. i The following letter of resignation was readfhom T. W.
