"NOTICE OF RECEIPT OF ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 19 FOR THE CIY OF CALDWELL, CANYON
CO%TY, IDAHO, BY THE CITY CLERK AND OF THE TIME AND PLACE FOR FILING PROTESTS TO SUCH ASSESSMENT ROLL AND
OF THE TIME SET FOR HEARING PROTESTS BY THE CITY COUNCIL.
°NOTICE IS HEREBY GIVEN That the assessment roll of Local Improvement District No. 19 for the City
of Caldwell, Canyon County, Idaho, is now on file in my office in the City Hall of the pity of Caldwell,
Canyon County, Idaho, and that the same was filed at 5:00 o'clock P. M. on the 25th day of August, 1952,
and that the City Council will meet on the 8th day of September, 1952, at 8:00 o'clock P. M., at the City
Council Chambers in the City Hall in said City of Caldwell, Canyon County, Idaho, to hear and consider
I objections to said assessment roll by the party or parties aggrieved by such assessment. The owner or
owners of any property which is assessed in said assessmeht roll whether named or not in such assessment
roll may, within ten days from the first publication of this notice, file his objections in writing to said
assessment or to any part thereof which said objections must be definite and specific as to the property or
piece of property in said assessment roll to which objection is made as wallas the specific ground for such
objection. The assessment roll will be open for inspection at the office of the City Clerk of the City of
Caldwell, Canyon County, Idaho, on each and every day between the tours of 9 .-00 o'clock A. M. aid 5 -00
o'clock P. M., excepting Sundays, holidays and Saturdays, that with respect to Sundays and holidays said
office will be closed and on Saturdays, the assessment roll will be open for inspection between the hours
of 9 :00 O'clock A. M. and 12:00 o'clock noon.

The Regular Monthly Meeting of the City Council met in the Council Rooms of the City Hall, with
the Mayor, Jason C. Smith,presitiing.
Upon Roll Call the following Councilmen answered present- Fran Blomquist, L. F. Burrell, John
Myers, Ernest Weick, Dale Fenrich and J. M. Bettis.
Application for Pool License was read from Brink's Inc., the fee accompanying the application.
'gloved by Weick, seconded by Fenrich that this License be granted.
Upon Roll Call it appeared the motion was unanimously carried.
Application for Punch Board License was read from Saratoga Club, the fee accompanying the ap-
� plication.
Moved by Weick, seconded by Fenrich that this License be granted.

This being the time set for the consideration of objections to the assessment roll of Local Im-
provement District No 19, of the City of Caldwell, Idaho, the Clerk presented to the Council the Affidavit
of Publication of the NOTICE OF RECEIPT OF ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO 19, FOR THE
CITY OF CALDWELL, CANYON COUNTY, IDAHO, BY THE CITY CLERK AND OF THE TIME AND PLACE FOR FILING PROTESTS TO
SUCH ASSESSMENT ROLL AND OF THE TIZE SET FOR HEARING PROTESTS BY THE CITY COUNCIL, which affidavit is in

R. R. BECHTEL, being first duly sworn,deposes and says: That he is the Foreman of Caldwell News -
Tribune, a daily newspaper published at Caldwell, Idaho, within the meaning of Chapter 154 of the 1933
Session Laws of Idaho:. published six consecutive days a week except legal holidays. And that the publisher
of said The Caldwell hews- Tribune, a daily newspaper, has all the time since the 5th day of July, 1933 and
in each issue thereof, at the head of the editorial column of said newspaper, announced the day of the week
to -wit: Saturday, on which legal notice required by law or by order of ashy Court of competent jurisdiction
to be published weekly, will be published; that the said paper is in general circulation in Canyon County,

Idaho, and has been for a period of seventy -eight weeks preceding the first publication. of this advertise-
ment, a copy of which is attached hereto, and by reference thereto made a part of this affidavit, and was
published in the regular daily issues of The Caldwell News- Tribune for 3 consecutive days beginning with
the issue of August 27, 1952 and ending with the issue of August 29, 1952.

The Mayor asked if there was anyone present who wished to protest the Assessment Roll of L. I. D.
No 19.
There were no objections or protests.
Thereupon the following order was made and entered by unanimous vote of the Councils
ORDER
IN LOCAL IMPROVEMENT DISTRICT NO. 19.
AN ORDER CONFIRMING ANDAPPROVING THE ASSESSMENT ROIL IN LOCAL IMPROVEMENT DISTRICT NO. 19 OF THE
CITY OF CALDNELL, IDAHO.
The Committee on Sewers of the City of Caldwell, together with the City Engineer of said City of
Caldwell, have heretofore certified and submitted to the Mayor and c ouncil, the Assessment Roll of Local
Improvement District No. 19, of the City of Caldwell, Idaho, and it appearing that the assessment roll was
received in the Office of the City Clerk of the City of Caldwell, at 5tOO o'clock P. M., on the 25th day of
August, 1952; and that said Assessment Roll is now on file in said office;
And it further appearing that the Mayor and Council of the City of Caldwell, at a meeting of

said Mayor and bouncil, held in the City Hall of said City, on the 25th day of August, 1952, passed a reso-
lution ordering said assessment roll to be placed on file in the Office of the City Clerk of the City of
Caldwell, and fixing the 8th day of September, 1952, At 8;00 o'clock P. M., in the Chambers in the
City Hall of said City of Caldwell, at tt:e time and place for hearing and considering objections to said
Assessment Roll; and directing the City Clerk of the said City to give due and legal notice in compliance
with the provisions of law, of the filing of said Assessment Roll in his office, the date of filing the
same and the time and place at which the Council would hear and consider objections to said Assessment Roll
by parties aggrieved by such assessments and the persons by wham and the time within which said objections
should be filed, and further directing that said notice be published in three successive issues of The
Caldwell News Tribune, a daily paper printed and published in the City of Caldwell, Idaho, and the official
newspaper of the City of Caldwell; all of which more fully appears in said resolution;
And if further appearing that the City Clerk of the said City give notice of the receipt of said
Assessment Roll and of the time and place 'fixed for hearing protests thereto, directing the tine, place
and manner of filing said objections; all of which more fully appears by said notice, dated the 25th day of
August, 1952, and now on file in the office of the City Clerk of the City of Caldwell; and it further ap-
pearing that said notice was published as directed in the said resolution above mentioned, in the Caldwell
News- Tribune, the official newspaper of said City, in the issues of August 27, 1952, August 28, 1952 and
I August 29, 1952, as more fully appears by the affidavit of publication of said notice on file in the office
of the City dlerk of said City of Caldwell; and it further appearing that notice was duly and regularly
given in all respects as required by law and the orders of the Mayor and "ouncil;
And it further appearing that the time for filing objections and protests having expired, and the

time fixed andappointed for hearing and considering such objections and protests having arrived and if
further appearing that no objections or protests whatsoever have been filed in said matter; and said
Assessment Roll having come on regularly for hearing and consideration and the same having been fully and -
duly considered by the Mayor and Council of the City of Caldwell, Idaho, and said Assessment Roll, together
with all proceedings in making such assessment having by said Mayor and Council been found regular, valid,

correst, equitable, fair, just, proper and in all respects legal and according to the laws of the State
of Idaho, and the ordinances of the City of Caldwell;

NOW THKEFORE, IT IS HER f ORDERED By the Mayor and Council of the City of Caldwell, Idahoe.
Section 1. That said Assessment Roll of Local Improvement District No 19 of the City of Caldwell
- Idaho,.be and the same hereby is approved and confirmed. -
Section 2. That the City Clerk shall immediately certify and file said Assessment Roll with
the City Treasurer of the City of Caldwell, for collection of said assessments according to law; and due
j notice.of the time, place and manner of making these payments of assessments contained in said Assessment
Roll be given by said Treasurer of the City of Caldwell, in the manner provided by the laws of the State
of Idaho, and the ordinances of the City of Caldwell.

A petition signed by property owners was presented to the Mayor and Council petitioning the
creation of an improvement district for the purpose of constructing a sanitary sewer system on the follow—
ing described property.
Beginning at the Southeast corner of Lot 7 of Block 4, of Arlington Addition, Caldwell, Idaho
and running thence mouth to the South line of Logan Street, thence East on the South line of Logan Street
to the center line of 10th Avenue, thence South on trio Center line of 10th Avenue to the - center line of
Linden,Street, thence East on the center line of Linden Street a distance of 240.00 feet, thence North and j
parallel to 10th Avenue a distance of 1102.00 feet, thence East and parallel to Ash Street a distance of
180.00.feet, thence youth and parallel to Ray Avenue to the center line of Linden Street, thence Fast on
the center line of Linden Street to the center line of Ray Avenue, thence North on the center line of Ray
Averme.a distance of 613.25 feet, thence Easterly and parallel to the South line of Ash Street a distance
of 171.50 feet to a point which is 200 feet East of the East line of the W.1/2 of the S.W. 1/4 of the S. W.
1/4 ot,Sec.27, T. 4 N., R. 3 W. B. M., thence North and parallel to the said East line to the North line of
Lab Street, thence West on the North line of Ash Street to a point which is 206.00 feet East of the center
line of 10th Avenue, thence North and parallel to 10th Avenue to the center line of Elm Street, thence East
on the center line of Elm Street to the center line of Howard Avenue, thence North on the center line of
Howard.Avenue to the North line of Logan Street, thence West on the North line of Logan Street to the
point of beginning.
The Mayor instructed the City Engineer to check the property descriptions on the above mentioned
petition, prepare an - stimate of the cost of said sewer and report back to the Council.
A number of property owners appeared before the Mayor and Council and discussed the construction
of a sewer line down the alley between Albany and Belmont Streets from Fifth Avenue to Boise Avenue.
The Mayor advised that they could either form a small improvement district and issue bonds for
the sewer or work out the matter as indiU duals and pay cash, also, that the City Engineer would give them
ICI an estimate on the cost.
The Bills for August were read and on motion by Blomquist, seconded by Burrell that these bills
he allowed and warrants ordered drawn for the various amounts all of which had been approved by the
