The Mayor requested that everyone stand and give the Pledge of Allegiance to the Flag. The Roll of the City Council was called with the following members present: Raymond, L. Carter, J. Carter, Mallea, Betts, and Cowles. Absent: none. (AUDIENCE PARTICIPATION) The Mayor asked if there was anyone in the audience who cared to bring anything before the City Council that was not on the prepared Agenda. Since there was no one, the Playor declared that the meeting would continue as outlined. (APPROVE MINUTES) It was MOVED by Cowles, SECONDED by Mallea to dispense with the reading of the minutes of the August 17, 1982 Regular City Council Meeting, the minutes of the August 24, 1982 Regular City Council Meeting, and the Executive Session of the City Council of August 25, 1982, and approve them as written. MOTION CARRIED OLD BUSINESS (BILL NO. 19 - DOG ORDINANCE) The Mayor read by title only the proposed amendment to the dog ordinance for the City of Caldwell as follows: AN ORDINANCE TO AMEND TITLE IX, CHAPTER 2 OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, STATE OF IDAHO, REGARDING DOGS AND OTHER ANIMALS, BY REPEALING CHAPTER 2, AND ADDING A NEW CHAPTER 2 ESTABLISHING LICENSE REQUIREMENTS, FEES AND OTHER REGULATIONS FOR THE CONTROL OF DOGS AND OTHER ANIMALS; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. The Mayor further informed the City Council that originally it was the intent of the City to follow the ordinance from the County. In going over the City Code, it was found that the Code included other animals as well as dogs. Other animals were not included in the County's Ordinance, so it was necessary to combine both of them. The Mayor would ask that the City Council members look the proposed Bill over carefully and make any suggestions or changes they felt might be necessary. There was a clause with regard to the rabies shot, a method established so that 'Veterinarians can sell licenses, and some differences in fees. These particular items were the most obvious changes, but the Mayor asked that the Council members particularly look for anything that might have been overlooked in preparing the bill. Lhese bids were opened at the noon meeting and he would request that Councilman Raymond., who was asked to be a member of the committee to review the bids, report with regard to this award. Councilman Raymond stated that the Committee did not have a chance to meet that afternoon due to another scheduled meeting. He would, therefore, ask for a postponement on action for the bid award. until the next Regular City Council Meeting. (BID AWARD ON THE BLOCK GRANT) The Mayor also stated that these bids were opened at the noon meeting and he would ask Councilwoman Mallea to give a report on this bid award. Councilwoman Mallea informed the City Council that their Committee was not able to meet either, but they did have a report that there was some inconsistencies in one of the bids. The Committee will be meeting with the City Engineer to determined what action should be taken. They will have a recommendation at the next Regular City Council Meeting. NEW BUSINESS (REDDI PROGRAM) The Mayor stated that this item on the Agenda was for informational purposes. This program was started last week by Governor Evans and the Cities of Caldwell and 1Jampa. The Program was called 12EDDI which means, Report Every Drunk Driver Immediately. It was to work in conjunction with the Idaho State Police, not a local program. There was a particular number to be called and the idea was for citizens to report a drunk driver if seen. (PUBLIC HEARING ON THE BUDGET) The Mayor explained to the audience that there was new rules established by the Legislature effective the Ist of July with regard to procedures during a public hearing. No person would be allowed to speak before the City Council at a public hearing until recognized by the Mayor. All persons desiring to speak must sign their name on a sign -up sheet passed out among those in the audience, all persons speaking shall speak before a microphone in such a manner as will assure that the recorded testimony or remarks will be accurate and trustworthy. At the commencement of the Hearing, the City Council shall establish a time limit to be observed by all speakers. Any _person refusing to comply with rules will be prohibited from speaking during the hearing. The Mayor then requested that the City Clerk pass the sign -up sheet out among those in the audience stating that if they cared to speak with regard to the budget, they would have to sign their name. As there was no one who cared to place their name on the sheet, the Mayor then asked. Councilman Betts to give a brief explanation regarding the budget. Councilman Betts stated that this was the time set for the Public Hearing for the budget for the 1982 -83 year. The City Council had a Public Bearing at a previous meeting for the Revenue sharing portion of the budget. The total ,appropriation for this year's v ' budget was $6,613,054 of which $399,000 of Revenue Sharing. Councilwoman Mallea gave an explanation as to what Revenue sharing monies were and just what these monies were expended for. The Mayor then declared the meeting open for a public hearing. Dee Nauman was recognized and stated that she felt the Caldwell Police Department was doing a good job and she would hope that this Department was given enough monies for this budget year to continue Book 2.3 Page 245 their good work. If there was any extra monies, she would like to see the Police Department receive it to make sure that they not only continue their good work, but also a better job for next year. As there was no one else who cared to speak for or against the budget, the Mayor declared the public hearing closed. Councilman Cowles commended those members of the City Council who worked so many hours to establish the budget for the new year. He further stated that he would like to publicly thank each of them. The Mayor also added his thanks to the Finance Committee. (BILL NO. 18 - APPROPRIATION ORDINANCE) The Mayor then read Bill No. 18 by title only as follows: Ail ORDINANCE TERMED THE ANNUAL, APPROPRIATION BILL® APPROPRIATING MONEY IN SUCH SUM AND SUMS AS ARE DEEMED NECESSARY TO DEFRAY ALL PROPER EXPENSES AND LIABILITIES OF THE CITY OF CALDWELL, IDAHO, NOT OTHERWISE PROVIDED FOR THE FISCAL YEAR BEGINNING THE FIRST DAY OF OCTOBER, 1982, PURSUANT TO THE PROVISIONS OF SECTION 50 -1003, ]IDAHO CODE It was then MOVED by Betts, SECONDED by Mallea to suspend the rule requiring the reading of a bill at - three different times and that Bill No. 18 be read by title only. Roll call vote. Those voting yes: Betts, Cowles, Raymond, L. Carter, J. Carter, and Mallea. Those voting no: none. Absent and not voting: none. MOTION CARRIED MOVED by Betts, SECONDED By Mallea that Bill No. 18 be passed and entitled Ordinance No. 1630. Roll call vote. Those voting yes: Betts, Cowles, Raymond, L. Carter, J. Carter, and Mallea. Those voting no: none. Absent and not voting; none. MOTION CARRIED Councilman Raymond was recognized and stated that he would like to make some comments with regard to the preparation and process of the budget. It doesn't just happen. The Council all contribute in ideas and budget priorities, but this year the Finance Committee has really committed themselves to bringing to the total Council and the Mayor and to the citizenry a well thought out set of figures as is possible under the system of various incomes, taxes, and varieties of expenditures as go into the total City budget. Gene Betts, as Finance Committee Chairman, has distinguished himself in the procedural activities and in conducting the meetings of the group. He has initiated several new ideas and worked very close with staff in preparation of preliminary figures and taking Council questions back of the various statistics. Pat Mallea in her diligent digging and questioning the whys and whatfors is the workhorse of the Committee. Her efforts are appreciated by all of US. Her commitments to other major projects at the same time has really kept her jumping and she has kept her personality with it. We appreciate that. Jack Carter, as a new member of the Council, has shown an intense interest and a desire to learn and effect the financial direction of the City. I was impressed with that. Jack, Pat, and Gene have spent many hours away from their families and their businesses to participate in the various workshops. The rest of us on the Council would like to invite you to lunch at the Saratoga and will be notified as to the time and date in the near future and you will be our guests. (DISCUSSION REGARDING WATER WHEEL) Book 23 Page 24& The Mayor explained that the water 'wheel in downtown Caldwell by Rostock Furniture was falling 'to pieces as the bearings were out. As a result, the Mayor and City Council had been discussing the problem the last couple of weeks. The Mayor further stated that he mentioned it on his radio program and received many calls. K.C.I.D. also put it on their People Poll Program and there was not one negative call regarding the water wheel. The Mayor informed those present that he had called Dee Naumann to see if she would be interested in starting a project with the Community Improvement group to determine what should be done about the wheel. Dee Naumann spoke at some length to the City Council stating that she had discussed this issue with a number of citizens and businessmen in the City of Caldwell. She found that they were not `J willing to go $1,300 to replace something that was not pretty in the .first place. It was determined that the existing water wheel should be torn down and one of the plans suggested was to go to the High School and have the drafting class propose plans for that whole area. Mrs. Naumann °s proposal. was to rebuild a scene to look like an old grain mill and then have the water wheel to furnish water for the trees and some plants.. It was a general feeling among the people of Caldwell that Indian Creek was one of the ugliest things in Caldwell. Many cities have taken places such as this and made them into attractive areas in their city. Mrs. Naumann was asking permission to work on this project and would ask help from anyone that was interested. The Mayor pointed out - to Mrs. Naumann that the property did not belong to the City of Caldwell and to be sure and check with the owner. Mrs. Naumann stated that she was aware of this and when there was any kind of plans or formalities decided, she would bring them back to the City Council. (REQUEST FROM COMMISSIONERS) The Mayor read the following letter received from the County Commissioners: The Canyon County Board of Commissioners is requesting that Belmont Street between 12th Avenue and 13 Avenue be closed on permanent basis; street right of way be vacated and ownership be transferred to the county. Canyon County now owns all property on both sides of this one block of street. Thank you for taking this matter into consideration. The Mayor said that he would like to turn this request over to the Engineering Department for the necessary study and when this is accomplished, he would appoint a. committee to consider this request. (REQUEST FOR BEER LICENSE - AMERICAN PETROLEUM) The next item on the .Agenda was a. request for a beer license submitted by William D. Weivoda for American Petroleum located at 122 West Aven. The Mayor read the following notation from the Chief of Police: Background investigation on Bill weivoda reveals no statutory preclusion for gaining a beer license. The Mayor stated that the application seemed to be in order and he would ask the City Council to take action on this request. - (L) It was then MOVED by Raymond, SECONDED by(J.)Carter to approve the application for a new beer license for Bill weivoda for American Petroleum at 122 West Aven. MOTION CARRIED Book 23 Page 2 47 (RESOLUTION FOR APPROVAL OF AUDITOR CONTRACT) The Mayor read the Resolution with regard to the auditor's contract as follows: RESOLUTION AUTHORIZING MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF CALDWELL AND MESSURI, BATES, AND GIBBONS TO PERFORM THE MUNICIPAL AUDIT FOR THE YEAR 1981--82. BE IT RESOLVED That the Mayor and Clerk of the City of Caldwell be, and the same hereby are, authorized to execute that certain MUNICIPAL AUDIT - LETTER OF UNDERSTANDING Agreement attached hereto and made a part hereof as if set forth in full by and between the City of Caldwell and the Certified Public Accountant Firm of Messuri, Bates, and Gibbons to be completed ninety days from receipt of records. It was then MOVED by L. Carter, SECONDED by Cowles that the Resolution be passed authorizing the execution of the Agreement with Messuri, Bates, and Gibbons to perform the audit. Roll call vote. Those voting yes: L. Carter, J. Carter, Mallea, Betts, Cowles, and Raymond. Those voting no: none. Absent and not voting: none. MOTION CARRIED (ELIMINATION OF PARKING ON TENTH FROM TRAFFIC SIGNAL TO THE INTERSTATCE) The City Engineer explained that this request was submitted by Dan McCombs, Traffic Engineer for District III of the State of Idaho Divsion of Highways. The request was to eliminate parking from the new traffic signal at Tenth and Chicago all the way back to the Interstate. Mr. Redmond pointed out the area on a map for the benefit of the City Council. It was felt that this would eliminate a potential traffic hazard. Councilman Raymond questioned as to whether it would be feasible to request that they restripe and put a turn lane all the way through there in exchange for the elimination of the parking. Mr. Redmond stated that he felt this was a reasonable request. MOVED by Raymond, SECONDED by Mallea that the City Council accept the State's recommendation to eliminate parking on Tenth from traffic signal to Interstate provided that the State re- stripe and put a turn lane in. MOTION CARRIED (AMENDMENT TO U.D.A.G. GRANT) The Mayor called on the City Engineer to discuss this item on the Agenda. Mr. Redmond explained that after extensive talking to the U.D.A.G. people, the City has convinced them to re -write the grant for a lesser amount. Initially, $700,000 was requested, but this has been scaled back to a maximum of $350,000 with jobs and private development scaled back accordingly. Some terms were written in that were not in the original grant, but Mr. Redmond felt that the City could probably live with these. It was MOVED by Raymond, SECONDED by Cowles that approval be given for the amendment to the U.D.A.G. Grant as recommended by the City Engineer and that the Mayor and Clerk be authorized to execute. MOTION CARRIED (DISCUSSION ON BOISE RIVER CHANNEL WORK) The Mayor stated that this item was discussed at noon and the decision of the City Council was that the next Council Meeting at noon would be at Curtis Park. Councilwoman Mallea stated that on Book 23 Page 248 thinking it over she would suggest that they meet at the Park during a non- official meeting at noon which would be the 21st of September. The City Council agreed to this suggestion. (APPROVE PARTIAL PAYMENT FOR TONY RUSSELL.) The Mayor called on the City Engineer to present this item on the Agenda. Mr. Redmond explained that this was partial payment number 9 in the amount of $75,403.80. Primarily, this payment was for a portion of the restoration of East Cleveland which was about the last of the main items that were left to be done. Alpha Engineers and the Engineering Department reviewed the figures and all was in order. MOVED by Mallea, SECONDED by L. Carter that approval be given for the partial payment to Tony Russell in the amount of $75,403.80 as presented by the City Engineer. MOTION CARRIED (MICROFILMING OLD RECORDS) The Mayor explained that for many years an attempt has been made to get microfilming done for the records of the City of Caldwell. For one reason or another, it has not been completely finished. The Mayor further said that he would like to expend, and the money was available, about $800.00 for a plan to microfilm. Donna Talley and Betty Jo (teller would be getting the material together on weekends and they were the ones who should - try to go through all of the old records. The Mayor wanted tile. City Council to be aware of this elan. (REHAB RESOLUTION - GEORGE WASKO) Councilman J. Carter read Resolution No. 45 -82 by title only as follows: RESOLUTION APPROVING .A HOUSING REHABILITATION FOR GEORGE WASKO AND PROVIDING AN EFFECTIVE DATE. MOVED By J. Carter, SECONDED by L. Carter that Resolution No. 45 -82 be ,passed approving the Housing Rehabilitation for George Wasko. Roll call vote. Those voting yes: J. Carter, Mallea, Betts, Cowles, Raymond, and L. Carter. Those voting no: none. Absent and not voting: none. MOTION CARRIED (REHAB RESOLUTION - RUTH DOBSON) Councilman J. Carter read Resolution No. 44 -82 by title only as follows: RESOLUTION APPROVING A HOUSING REHABILITATION FOR RUTH DOBSON AND PROVIDING AN EFFECTIVE DATE. MOVED By J. Carter, SECONDED by L. Carter that Resolution No. 44 -82 be passed approving a Housing Rehabilitation for Ruth Dobson. Roll call vote. Those voting yes: J. Carter, Mallea, Betts, Cowles, Raymond, and L. Carter. Those voting no: none. Absent and not voting: none. MOTION CARRIED (DEEDS AND EASEMENTS) Book 23 Page 249 The City Engineer presented one deed to the City of Caldwell from Harley and Mary Fouts which was the small triangular piece of property off the tip of where North Third and North Illinois intersect. The City would like to have this for the future when they widen North Illinois. MOVED by Mallea, SECONDED by J. Carter that the Deed be accepted as presented by the City Engineer and that the City Clerk be instructed to have the Deed recorded. MOTION CARRIED (COMMITTEE REPORTS) Councilwoman Mallea reported that she attended the Library Meeting and conveyed to the Board the concerns and direction from the Finance Committee which was very well received. Their dance has been set for November 12 at the Fair Building and a great deal of work was going into it. They reported a great deal of use on the computers; they were in the process of getting a new Children's Librarian; there will be a storyteller at the Library on September 23rd. The Library Board was very appreciative of the Revenue Sharing monies that was given to them.. Councilwoman Mallea also informed the City Council that she attended the Crime Stopper's Meeting that morning and gave a brief report of their activities. Councilman Raymond stated that he would report with regard to the Airport Commission as they have recently had several meetings. They were arriving at some good solid figures to lease the sod farm. Also, there was a resignation which he did not have in writing as yet. This came about because the Chairman desired not to continue in this position and there was not a vacancy to appoint someone on the Commission that wanted to be Chairman. Jerry Ogstad stated that he would like to resign from the Airport Commission and the Commission would like to recommend to the Mayor the appointment of Joe Shreve, who has been active on the Commission as a Chamber of Commerce representative. It was anticipated that the Commission would elect Mr. Shreve as the next Chairman. The Mayor then stated that he would recommend to the City Council the appointment of Joe Shreve to the Airport Commission and at the same time accept the resignation of Jerry Ogstad. MOVED by Raymond, SECONDED by J. Carter to approve the appointment of Joe Shreve to the Airport Commission and accept the resignation of Jerry Ogstad from the Commission. MOTION CARRIED (MAYOR'S COMMENTS) The Mayor stated that he would like to present a claim from Luther and Bettye Taylor which he would turn over to Councilman Cowles for investigation. This claim was backed up by the Engineering Department as to it being a valid claim. There being no further business, the meeting was adjourned at 8:45 P.m.
