Boyes, presiding, Councilmen Ackley, Dement, Hayman and Lilly, present, S. Ben Dunlap, Clerk, when the following business was transacted: The minutes of the sessions held during the month of August, 1915, were read and upon motion of Hayman the same were approved. The following bills which had been 0, kId by the Finance Committee were read and it was voted upon motion of Ackley that the same be allowed and warrants be ordered drawn on the various funds in payment of the same as follows: GEYPRAL FOND S. Dement Sr. Right of way Lateral # 4 121.50 The Bellan Investment Company Interest and Etc 798.88 It was voted upon motion of Lilly that the bill of the Bellan Investment Com- pany be referred to the City Attorney and that the bills of the Idahoan, J. A. Dement Sr. and B. D. Vmphenour be referred back to the L'inance Committee for investigation. Mr. F. L. Keller appeared relative to the condition of Arthur Street stating that the crossings were in such bad shape that it was impossible to sprinkle the street thoroughly . He stated that the condition of the crossings were flue to the negligence of the railroad company and he requested the Council to have the satne fixed. The matter was referred to the Street Committee and to the Engineer for investigation and report. 1 Mr. Vaggoner appeared, stating that he owned property located on 12th and Blain Streets, along the side of which, cement sidewalks had been ordered in. He stated that he had a good board walk around this property and he requested permission to delay the construction of the cement walk until next spring. i � -12- Ir. I. S. Binford appeared with a request that tte Council grant temporary permission to the Binford Lumber Company to close the alley which rune through the yards of the said Binford Lumber Company,after business hours only. He stated that it was necessary to close the alley in order to protect the property in the yards and that the Caldwell Ice and Cold Storage Company were the only people who would in any way be inconvenienced by such an arrangement and that they hal given their consent to the closing of the yards, as evidenced by the following letter. Caldwell, Idaho, August 19, 1915. To the Honorable City Council of Caldwell, Idaho. This is to certify that we the undersigned have no objections to the Binford Lumber Company being granted the privilege of.placing gates across the alley at each end of Block 73 in the Origins] townsite of Caldwell, Idaho, with the understanding that the gates are kept open during business hours. (Signed) Caldwell Ice F: Cold Stg Cc By, Vartin Jensen, It was voted upon motion of °ayman that the Pinford Lumber Company be alloyed to construct gates in order to close the yards during the night time only. "r. G. R. Van 7ryngardner appeared with the request that the Council order in a concrete sidewalk in front of lots 17 to ^•4 inclusive, block 17 Ibrman'e Addition and in front of Tote 1 to 12 inclusive block 25 f.^ashington Heights Addition. The petition of M. H. Mead et -al for extension of the water mains from 23rd Street South on Michigan Avenue to Linden Street, thence east on Linden Street to Indiana Avenue thence south on Indiana Avenue to Cherry street, was read. The petition was referred to the water Committee and to the City Engineer for a report as to the probable cost. The petition of T. F. Bridges et--al for the exclusion from the City limits of all that property in Section 36 41T 3W, which lies north and east of the North east boundry of the 0. S. L. right of way, was read. The petition of 7. L. Douglas et -al for the exclusion from the City limits and not made subject to any tax hereinafter levied by the said City of all of Section 34 except the M1: 1/4 Section 34 Twp 4N Range 315 B.Y. was read. The petition of Julia V. Finney et -al for the exclusion from the City limits and made not subject to any tax hereinafter levied by the aald City of all of Section 35 South and "feat of the Interurban R. R. and Cleveland Boulevard, was read. The City Attorney, being present, adirised that he had ;one into the legality of excluding certain portions from the City limits and that up to the present time he had been unable to find any authority by which such action could be taken by a City. Us requested the petitioners to file a. brief showing their authorities on the question. WE Mi N -13- 0 MI H1 Mr. Harold <Tohnson appeared asking to be releived from paying a water bill charged against him for the month of August, 1915, in the sum of X8.30, stating that he considered the charge unjust as he did not use this -mount of water. The matter was referred to the water committee for report at the next meeting. A communication was read from Harry Finley of Yampa, requesting permission to erect bill- boards at the following places. Sebree Lot No. 20 and 22 Original townsite, WM. Cupp lots across from Interurban Station, TU ss Gilligan Lots an 7th next to creek, Viss Gilligan lots on SFain between 6th and 7th, Sebree lot, cornor 8th and Arthur, Sebree lot cornor 7tb. and Arthur and Sebree lot next to Caldwell Forwarding Company. It was voted upon motion of Fayman that Mr. Finley's petition be granted. A communication was read from John X. White, State Sanitary Inspector, Boise, Idaho, under date of August 31st., 1915, relative to the health ^onditions of the City. It was voted upon motion of Lilly that the health officer be instructed to rigidly enforce the health ordinance of the City and that all unsanitary conditions be remedied at once. The petition of Amos J. Miller et -al for the extension of the water works system from Cleveland Boulevard on,Aven Street to 'lain, was read. The petition of the Fire Department for the installation of a bath tub in the Fire Hall, was read. The matter was referred to the fire Committee. The time coming on regularly for the hearing of objections from any person or persons aggreived by the assessments levied on the 1915 nuisance roll, the following objections were read: C. B. Banks, lot 4 of block 24 Washington Heights Addition, in the sum of seventy five cents and A. J'. Barney, lots 9 and 10, block 101 Goandu Addition, in the sum of fifty cents. Both claiming that there were no weeds out in front of their res^ective pieces of property and that the charges against same are erroneous and unjust, and asking to be releived from Paying said assessments. It was voted upon motion of Ackley that the requests be granted. No further objections appearing the Clerk was in- structed to so note in the minutes. The time coming on regularly for the opening of bids for hay and oats, the following bids were received e.nd opened. W. C. Parker, 25,000 pounds oats at X1.45 per Cwt., W. H. Guerin, Alfalfa hay, 1'6.00 per ton, timothy and Clover $10.00 per ton. It was voted upon motion of Hayman that action on the bids be deferred until the next meeting. The depository bond of the First National Sank in the sum of t25,000, dated August 16th., 1915, and the depository bond of, the Wastern National Bank in the sum of "25,000, dated August 7th., 1915, were presented. It was voted upon motion of Ackley that the bonds be approved and accepted. -14- The 1915, Sprinkling Roll as prepared by the Street Committee was presented. It was voted upon motion of Ackley that the same be confirmed, ratified and approved and that the Clerk be instructed to advertise the same as required by law, and that the Council hereby fixes Monday October 11th., 1915, at Q o'clock P. Pd. for the purpose of hearing and considering objections by any person or persona aggreived by the said assessment roll. The City Engineer, being* present, recommended that the 0. S. L. R. R. Company be required to ballast their road bed on Aven Street and to p in street crossings and also to r °move their tract off of the sewer in the alley north of the main line. The quarterly report of the City Treasurer for the quarter ending July 51, 191`), was read. It was voted upon motion of FFayman that the same be approved. The reports of the following officers for the month of August, 1915, were read. City ?engineer, City Clerk, Supt of mater Works, Street Commissioner, Police Judge, Saxton and City Librarian. It was voted upon motion of Hayman that the reports be approved and ordered filed. The Vayor announced the appointment of Mrs. Thomas P. Buckner on the Library Board to fill out the unexpired term of Curtis Fayden, r�si.gned. It was voted upon motion of Ackley that the appointment be approved. In the matter of drainage for the north side of town the attorney was asked to exprnse an opinion as to the legality of the City joining with the Pioneer District and draining this section of the City. The City to stand one -third of the expense. The attorney stated that he had made some investigation and that it was his opinion that the proper way to make such improvement, was to form an improvement district and assess the property benefited for the cost of the work. It was voted upon motion of Lilly that Council ad;jorn until Tuesday evening September 14th „ 1915, at B o'clock P. M. Vayo r.1 Attest. City CILvrk. Ben Dunlap, Clerk, when the following business was transacted: Bill No. 6, by the finance Committee, entitled, "An ordinance providing for the levy of a tax assessment for the purposd of paying the current expenses of the City of Caldwell, Idaho, for the fiscal year beginning* on the first Tuesday in May, 1915, as here- tofore appropriated ", was read for the first time. I . ICI A motion wee made by Ackley, seconded 3bment, that the rules be suspended and the reading on three separate days be dispensed with and that bill No. 6 be read the second time by title and the third time in full and placed on its final passage. The roll being called on the motion, the vote resulted.
