The Regular Yonthly Meeting of the City Council met in the Council Room of the
City Hall, with the Mayor, Edger L. Oakes, presiding.
On Roll Call the following Councilmen answered present; W.E.Babcock, C. o. me-
Dannel, Oscar Stengel, W.B. Handford, G. M. Fenrich and M.S.Sandmeyer.
The Minutes of previous meetings were road and approved as read.
Mr. S. L. Dildine appeared before the mayor and Council and stated that Ployd
Griffith wished to lease the City Camp Ground.
The Mayor informed Asir. Dildine that the p ity did hot wish to lease the Camp
Grounds.
Thereupon the following Resolution was presented to the Mayor and Council by
Councilman Sandmeyer, who moved the adoption thereof which motion was duly seconded by
Councilman Handford.
RESOLUTION
By Sandmeyer.
WHEREAS, The City of Caldwell has purchasd road equipment consistingco£ a sprinki
ler and flusher from the Evans Motor Company of Caldwell, Idaho for the sum of Four Thou-
sand Nmne Hundred and Seventyfive Dollars ($4975.00), and one oil distributer from the ols
Manufacturing Company of Boise, Idaho, for the sum of Two Thousand Two Hundred and Twenty
Dollars (12220.00), and one Huber roller from the Intermogntain equipment Company of Boise
Idaho, for the sum of Thirty -si Hundred Dollars (?3600.00), and,
1 =REAS, It appears to the Mayor and Council that it is for the best interest
of the City to purchase acid equipment partly for cash and partly on deferred payment plan
NOW, T=EFOTE, BE IT RESOLVED That the City of Caldwell complete the purchase
of said road equipment and that the payment be made as follows; one -half of the purchase
price thereof, to be raid in c.ah upon the delivery of said equipment, the remaining por-
tion of the said purchase price thereof, to be paid in o„sh upon the delivery of said
equipment, the remaining portion of the said purchase price thereof, to be paid on deferra
payment on or about the 5th day of September, 1940, a nd that the Mayor and the City Clerk
of City of Caldwell, are and they are hereby authorized and directed to execute a con-
ditional sales contrnot on behalf of said City in the usual form, and
BE IT FTJP.T=, RESOLVED, it appearing to the 4, "ayor and City Council that there
is sufficient unds in the Cemetery Endowment Fund, which may be used as an investment
on such securities as said conditional sales contracts so executed by the City, that the
Treasurer of the 01ty of C be and he is hereby authorized and directed to advance
end payfrom the said Cemetery Endowment Funds, from monies on hadd and not otherwise ap-
rropriated, a sufficient sum of money to the said Evans Motor Company of Caldwell, Idaho,
;he Olsen Manufacturing Company of Boise, Idaho and the Intermountain Equipment Co., of
;oise, Idaho, and to take and assignment of the conditional sales contract on each of said
contracts to be held by him in lieu of cash in said funds.
Dated this 5th day of September, 1939.

The Mayor informed the Council that this was the date set for opening bids for
oiling, surfacing, grading and graveling.
The ^"ayor directed the Clerk to open and read the bids filed.
There was only one bid filed which was from vorrison- Enudsen for $10,003.60.
This bid was taken under advisement.
Thereupon Councilman Sandmeyer presented the following Resolution and moved the
adoption thereof, which motion was dulyseconded by Councilman Handford.

STREET I!TFOV!2 DISTRICT NO. 16, OF T-E CITY OF CALDFELL, IN THE COFUTTY OF
CANYON, STATE OF IDA °0, AND INVITING AND RECEIVING SIDS THEREFORE.
BE IT RESOLVED by the Fayor and Eounoil of the City of Caldwell, Idaho:
Section 1. That Notice is hereby authorized, ordered and directed to be given
and published as hereinafter provided, that the 1 and Council of the City of Caldwell,
Idaho, propose to sell and invite written proposals for the purch of bonds of Local
Street Improvement District No 16, of the City of Caldwell, Canyon County, Idaho, in the
amounts and for the purposes specified in the following form, to -wit;

Public Notice is hereby given that sealed bids for the purchase of bonds of Local
Street Improvement District No. 16, of the City of Caldwell, in the County of Canyon, State
of Idaho, will be received at the office of the City Clerk, until Monday, to -wit the 2nd
day of October, A.D., 1939 at the hour of 8;00 otclock p. m. Said Bonds shall be in an
,mount aggregating the principal sum of Sic Thousand Eight Hundred Dollars and Fifty -six
cents ($6800.56), in denominations of Five Hundred Dollars ($800.00) each, except Bond No.
1, which shall be in the amount of Three Hundred Dollars and Fifty -six cents (0300.56);
said bonds shall be numbered consecutively from one up, to be dated August 1, 1939, payable
numerically in ten installmakto of approximately equal amounts each year, each installment

of bonds maturing in the respective years annually from 1940 to 1949, inclusive; but shall
ba subject to sell on any interest data following the delinquency of any installment of the
assessment; said bonds tobear interest at the rate not exceed sic per cent (6%,) per annum,
payable semi - annually on the first day of February and August of each year at some bank
in the City of New York, State of New York, to be designated at the time of the sale of su
bonds, or at the office of the City Treasurer of the City of Caldwell, Idaho.
Bidders are to submit said bids specifying the lowest rate of interest and premi

if any above par, at whine the bidder will purchase said bonds, and all tenders, bids or
offers to purchase must be addressed to the Mayor and Council of the City of Caldwell, Ida-
ho, without condition or qualification, and be accompanied by a certified check on some
bank in the State of Idaho, payable to the City Treasurer of said City in the amount of
Three Hundred and Forty Dollars ($340.00), to be forfeited to the City as liquidated damag
should thersuccessful bidder fail or re''use to take up:or pay for the bonds within thirty
days after the notice by the city of its readiness to deliver said bonds; unsuccessful d
bidders will be returned their certified checks.
All bids shall be conditioned upon the approving of a satisfactory legal opinion
as to the legality of the said i•-sue; provided, however, that said bonds shall not be cold
for less than their face or par value and accrued i ^terest at the time of disposal by the
City Treasurer, under the general supervision of the Mayor and Council. The said City will
furnish the bonds. Each of the said bonds and each of the coupons attached thereto, shall
be duly and regularly issued in form and contents in conformity with Chapter 25, Title
49 of Idaho Code Annotated of the State of Idaho, and all other rlhtka thereunto enabling,
or in amendemtn thereof.
The City Council reserved the right to reject any or all bids.
SECTION 11. That said notice shall be the same ps hereby ordered, published at
least once a week for a period of not less than three consecutive calendar weeks prior to
the 2nd day of October, A.D., 1939, in the Caldwell !taws Tribune, and the City Clark is
hereby authorized and directed to cause said notice to be published as hereinabove mention-
ed and procure proof of said publication in duplicate in the form of publisherst affidavit
one of which he shall preserve as a part of the recores a nd files in his office, and the
other of which he shall furnish to the purchaser of said 'bonds.

Mr. H, W. Hurd, representing the Columbia Equipment Co., stated that his Company
had a patrol which they would rent to the City. This matter was referred to the Road
Committee and the City Engineer.
Thereupon Councilman Handford, presented the following RLsolution and moved the
adoption thereof, which motion was duly seconded by Councilman Fenrich.

port to the Mayor and the Council !of the Cit,; of Caldwell, and
WHEREAS, It appears to the Mayor and Council of the City of Caldwell that the

NO11, THEREFORE BE IT RESOLVED that a new ordinance be prepared setting forth the
monthly rates to ber_harged, and fixing minimum rental and providing for the payment of
water rental in advance and repealing all ordinances or parts or ordinandes in conflict
therewith, and that the same be presented to the Mayor and Council for consideration.

IMPROVEMENTS IN LOCAL STREET TNPROVMaEPTT DISTRICT 110. 16, ITITHOUT THE LETTING OF A CON*
TRACT THEREFOR ANT' WITHOUT FURTHER CALLING FOR BInS. -
WHEREAS, heretofore pursuant to Resolution No. _, passed approved by the Mayo
and Council on August 7, 1939, the Clerk of the City of Caldwell, advertised for bids to
be received by the Council of said city at the office of the City'Clerk until the 5th day
of September, 1939, for the graveling, grading, surfacing and ollAg of the streets in
Local Street Improvement District No. 16; and
WHEREAS, all bids received by said City Council pursuant to said advertisement,
or otherwise, having been rejected, and it appearing for the best interest of the City
and of said Improvement District that no further call for bids be made, and
WHEREAS, it is provided in sections 49 -2537, 49 -2833 and 49 -2934 of the Idaho
Code Annotated, that the City may purchase the materials and hire the labor necessary
for having the work done without the letting of any contract therefor and without the
further calling for bids; now, therefore
Be it resolved by the Mayor and Council of the "ity of Caldwell, Idaho;
Section 1. That the City of Caldwell, in the C ounty of Canyon, State of Idaho,
purchase the materials and hire the labor necessary for having the work done in Local
Street Improvement District No. 16, in accordance with the plans and specification theref

and without further calling for bids.

which wss read for the first time and the Council proceeded to the consideration of Bill N
1, proposed Ordinance No. 564. It was moved by Sandmeyer, seconded by Babcock that the
rules requiring that the reading of a Bill on three separate days be suspended and that
Bill No 9, be read the second time by title and the third time in full, section by section
,and.placed on its final passage. The Mayor directed the Clerk to call the roll on the
motion with the following result; Those voting in the affirmative were. Babcock, TecDanne:
Stengel, Randford, Fenrich and Sandmeyer. Negative; None. Absent end not voting; None.

which had been approve by the Ch„irman of the Finance Committee. Motion carried.

The Council met on Call of the Mayor with the mayor, Edgar L. Oakes, presiding.
On Roll Call the following Councilmen answered present: W.E.Babcock, C. 0. Mcs-
Dannal, Carer step el, W.?. Handford, G. M. Fenrich and M.S.Sandmeyer:
The 7ayor informed the Council that the T-,?eating was called to take up the
matter of the Ackley Contract.
Mr. Hugh Ackley and Mr. Ben Dunlap were present and discussed this matter with
the Mayor and Council.
The Mayor informed Mr. Ackley that the City could not tenter into this Contract,
but would accept an easement. Mr. Ackley speed to an Easement

The City Council met on call of the Mayor with the Mayor, Edgar L. Oakes, presid-

The Mayor informed the Council that the Meeting was called to take up new and
'inished business.
Messrs. F. IT. Brown and Joe Wilson appeared and requested the Mayor and Council
open Idaho Street south to Hazel Street,
The Mayor informed these gentlemen that Idaho Street would be extended as soon
needed.
The Clerk read a petition requesting the Cit^ to grade and gravel Maple street
from Indiana Avenue to 1Tontana Avenue.
The ? dayor appointed the Road Committee and the City Engineer to investigate this
matter and report at the next Council Meeting.

rules requiring that the readir7 of a Bill on three separate days be suspended and that
