Council met in regular session with Mayor Dunlap presiding and Councilmen DAVIS, DUTTON, HOFFMAN, JACKSON, AND MCCONNEL, PRESENT. ABSENT: MUMFORD. Mrs. Lula Kipp appeared before the Council asking for a sidewalk along the from Kimball Ave. west south side of Fillmore Street /to the center of the block 'to Connect with a sidewalk in front of her property. The matter was referred to Dutton and MoConnel. BILL NO. 22, BY MCCONNEL, ENTITLED " AN ORDINANCE VACATING THAT PART OF 11TH AVENUE LYING BETWEEN DEARBORN STREET AND EVERETT STREET IN THE CITY OF CATZMEEb, IDAHO ", was read the first time in full. It was opted on motion of Jao$son, seconded by Davis, that the Gity of Caldwell start action against all parties liable to recover Special Assessments levied against the Boise Valley Traction Co. Fred Mitchell stated that if the City could arrange to take the last $3500.00 of Local Street Improvement District No. 5 Bonds that he could place the remainder of the issue, and that he personally would take the last two $100.00 bonds. It was noted on motion of MoConnel, seconded by Dutton, that the City Treasurer be authorized to exchange warrants issued on the Local Street Improvement District No. 5 in the sum of 03500.00 for Bonds of the some district. It was voted on motion of Dutton, seconded by MoConnel, that the Treasurer be authorized to release all bonds numbering from Ilcto -104 inclusive upon the payment of the principal sum and accrued interest. p�rew..+e It was voted on motion of Jackson, seconded by Davis, that Dutton be authorized to a 3� sore piece of gravel land from U. Uyematau and Shinya in the sum of $1000.00, payable in Local Street Improvement District No. 5 Bonds. Minutes of last meetings read and approved. BILL NO. 23, BY DUTTON, ENTITLED "AN ORDINANCE ESTABLISHING AND .DEFINING AVEN STREET, IN THE CITY OF CALDWELL, IDAHO, AND PROVIDING FOR THE TAKING OF CERTAIN PROPERTY FOR PUBLIC USE, AND DECLARING THE TAKING OF SUCH PROPERTY TO BE A PUBLIC NECESSITY FOR STREET AND RAILIROAD RIGHT -OF -WAY PURPOSES ", was read the first time in full. On motion made by Mo@onnel, seconded by Dutton, that the rules requiring a bill to be read on three separate days be Suspended, and that Bill No. 23 be read second time by title, third time in full section by section and placed on its final passage. The Mayor directed the Clerk to call the roll on the motion with the following result: AYES: DAVIS, DUTTON,. HOFFMAN, JACKSON AND MCCONNEL. NAPES: NONE. ABSENT: MUMFORD. The Mayor declared the motion carried. Bill No. 23 was read second time by title, third time in full section by section, and on the .question as put by the Mayor "Shall Bill No 23 Pass "? The Mayor directed the Clerk to call the roll with the following result: AYES:- DAVIS, DUTTON, HOFFMAN, JACKSON AND MCCONNEL. HAYES: NONE. ABSENT: MUMFORD. The Mayor declared the motion carride by the necessary) 3/4 majority, and Bill No. 23 now become Ordinance No. 457. The Mayor and Clerk signed and approved same in open session of the Council, and the Clerk was directed cause same to be published in the Caldwell Newe- Tribune the official newspaper of the City of Caldwell, I *aho, and record it in the Book of Ordinances.
