Moved by Olesen, seconded by Burrell that this appointment be confirmed. Motion unanimously carried. There being no further business to comebefore the Council, it was moved by Councilman McNeill, seconded by Uouncilman Thornock that Council adjourn. Motion carried. or COUNCIL CHAMBERS, SEPTEMBER 3, 1946, 8:00 P. M. The Regular Monthly Meeting of the City Council met in the Council Rooms of the City Hall with 0. L. Crookham, Jr., presiding. On Roll Call the following Councilmen answered presents J. R. Sloop, Leo J. Mason, Pete Olesen, L. E.Burrell, D. L. Thornock and R. H. McNeill. The Minutes of August 5th, and 26th, w er6 read and approved as read. J. Hammond, has been appointed Deputy Health Officer, with powers and authority given such Deputy Officer by the provisions of Ordinance No. 677 of the City of Caldwell, Idaho, BE IT RESOLVED (a) That as such Deputy Health Officer, Mr. C. J, Hammond shall devote approximately one -half of his time and services to the performance of duties in the p ity of Caldwell, Idaho) (b) That as a part of performance of services in the City of Caldwell, Mr. Hammond shall drake in- vestigations, determine facts for the State Department of Public Health relative to all health and sanitatior� conditions in the City of Caldwell, Idaho, particularly in food handling establishments, restaurants ass d hotels, which are within and under the jurisdiction of the State of Idaho Department of Public Health. (c) That Mr. Hammond shall receive as compensation for half time services devoted to the City of i t Caldwell, Idaho, the sum of ;8$.00 per month (subject to Federal and State Social Security deductions and Federal Income Tax withheld) to be paid directly to Mr. Hammond. It was moved + by Councilmai Burrell, seconded by Councilman Sloop that the rules requiring that the reading of a Bill on three separate days be auapended and that Hill No 17, be read the second time by title and the third time in full section by section and placed on the final passage. The Mayor directed the. Clerk to call the roll on the above motion with the following results Those voting in the affirmative w ere: Sloop Mason, Burrell, ien,Thornock &McNeill: Negative: None. Absent and not voting% None. The Mayor declared the motion had passed by the Necessary three - fourths majority and directed the Clerk to read Bill No 17, the second time by title and the third time in fullsection by section. Thereupon the Ma ^or declared Bill No 17, had passed and the Layor in open session of the Council duly signed and approved' the Bill, and the Clerk duly signed and attested the same which became Ordinance No 684- The mayor directed the Clerk to make proper entry of the same and to cause Ordinance No 684 to be published in the Caldwell News - Tribune the official newspaper of the City of Caldwell, Idaho. Moved by Mason, seconded by Clasen that the City accept platof "City Addition-' to Caldwell, Idaho. Motion carried. RESOLUTION By Councilmas Mason. Upon Motion of Councilman Mason, seconded by Councilman Thornock, the following resolution was pro osea: WHEREAS, the fo- lowing described real property owned by the City of Caldwell, Idaho, and situated within the City of Caldwell, County of Canyon, State of Idaho, to -wits Blocks 1 2 and 3 as shown on the Official Plat of "City Addition" to Caldwell, Idaho, which Plat was accepted and approved by the Mayor and Uouncil of Caldwell, Idaho, on September 3, 19h6o was not acquired by the City of 6 aldwell, Idaho, and has not been used and is not being used for public park purposea, for playgrounds or for public building site; and WHEREAS, said property is not needed fotmunicipal purposes and it is considered to the advantage oe and beat interests of the City of Caldwell, Idaho, and to Its residents and property owners that the above i descrited real property be sold at public sale to the highest bidder or bidderay BS IT RESOLVED: (a) That the above described real property in its entirety, or in parcels of one block each, be sold by the City of Caldwell, Idaho, at public sale to the hi _,hest bidder or bidders. (b) That notice of the intention of the kayor and Co.moil of the City of Caldwell, Idaho, to (sell the above described real property, at public sale, be given by the Clerk of the City of Caldwell, Idaho, Iby publication of such notice in The Caldwell News - Tribune, a newspaper of general circulation in the City of Caldwell, Idaho, once each week for two successive weeks. (c) That the notice of ,,ublic sale of said real property so published shall designate .he 7th day �of October, 1946, at 9500 o'clock P. M., as the date upon which arW objection to such sale may be made in person or be filed with the Clerk of the City of Ealdwell, Idaho, and as the date on or prior to which sealed ,bids for the purchase of said real property in its entirety or in parcels of one block each will be received and the date upon which such bids so received shall be opened and either accepted or rejected. Said notice shall state the following terms of sales Cash in lawful money of the United States of America, at least ,ten per cent of the purchase price offered shall accompany the written bid or offer of purchase, the balance of the offered purchase price to be paid upon delivery to the bidder whose offer to purchase is accepted, of ,a policy of title ;insurance issued by a title insurance company qualified to do business in the State of IiId*o, insuring a merchantable title to said real property in the City of Caldwell, Idaho, or an Abstract of Title extended to the date of sale showing a merchantable title to said real property in the Bity of Caldwell, Idaho. The payment accompanying an offer to purchase which is rejected by the Council of the City of Caldwell, Idaho, shall be immediately returned to the bidder thereon.
