The Special Meeting was called to order by Mayor Pete Cowles.
The Mayor requested that everyone stand for the Pledge of
Allegiance to the Flag.
The Roll of the City Council was called with the following
members present: Raymond, J. Carter, L. Carter, Mallea, Marcus,
and Marmon. Absent: none.

(AWARD BID FOR STORM DRAINS)
The Mayor called on the City Engineer to present the
- recommendation with regard to the bid award for the storm drain
construction. Mr. Redmond stated that a memo was prepared with
the Department's recommendation as follows:

The results of the bid opening for installation of storm drain,
are as follows:
5th and 10th Avenue Drains
Paul Construction, Meridian $30,406.75
Masco, Inc., Boise 66,506.00
Bodiford Construction, Meridian 25,465.50
Brown Construction, Nampa 24,570.00
9th Avenue Drain
Paul Construction, Meridian 46,408.75
Masco, Inc., Meridian 66,506.00
Bodiford Construction, Meridian 38,467.00
Brown Construction, Nampa 43,521.75
The recommendation from Mr. Redmond was to award to Brown
Construction for the 5th and 10th Avenue project, and to
Bodiford Construction for the 9th Avenue project.
MOVED by Raymond, SECONDED by Marmon to award the low bid
submitted by Brown Construction of Nampa for the 5th and
10th Avenue drains in the amount of $'24,570.00 and award the
low bid submitted by Bodiford Construction of Meridian for
the 9th Avenue drain in the amount of $38,467.00.

(RESOLUTION OF INTENTION TO CREATE AND ESTABLISH LOCAL IMPROVEMENT
DISTRICT NO. 86 -1)
Mayor Cowles requested that Councilman Marmon present the
Resolution No. 28 -86 declaring the intention of the City of
Caldwell to create and establish Local Improvement District No.
86 -1 as follows:
A RESOLUTION DECLARING THE: INTENTION OF THE CITY OF CALDWELL TO
CREATE AND ESTABLISH LOCAL IMPROVEMENT DISTRICT NO. 86 -1 FOR THE
CITY OF CALDWELL, IDAHO, FOR THE PURPOSE OF CONSTRUCTING STREET
IMPROVEMENTS; STATING THE S'T'REETS UPON WHICH THE SAID

IMPROVEMEN'T'S ARE TO BE MADE, THE GENERAL CHARACTER OF SAID STREET
IMPROVEMENTS, THE ESTIMATED COST OF THE SAME AND THAT SUCH COST
IS TO BE AFFIXED AGAINST THE ABUTTING, ADJOINING, CONTIGUOUS AND
ADJACENT LANDS ALONG AND UPON WHICH SAID STREET IMPROVEMENTS ARE
TO BE MADE AND UPON THE LOTS AND LANDS BENEFITED BY SUCH
IMPROVEMENTS AND INCLUDED IN THE IMPROVEMENT DISTRICT FORMED, AND
THE METHOD BY WHICH THE COSTS AND EXPENSES OF THE IMPROVEMENTS
WITHIN THE INTERSECTION ARE TO BE PAID; FIXING THE TIME WITHIN
WHICH PROTESTS AGAINST SAID PROPOSED IMPROVEMENTS MAY BE FILED IN
THE OFFICE OF THE CITY CLERK; AND FIXING THE TIME WHEN SUCH
PROTESTS SMALL BE HEARD AND CONSIDERED BY THE COUNCIL.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
Section 1. That it is the intention of the Mayor and City
Council of the City of Caldwell to improve the streets in said
City as follows:
Street Improvements
Owyhee Lane (from South Florida Avenue east approximately
457 feet).
Idaho Avenue (from approximately 200 feet north of Maple
Street south to Walnut Street).
Maple Street (from Idaho Avenue west approximately 170
feet).
South Florida Avenue (from Beech Street north to Cherry
Street).
Section 2. That the general character of the improvements
shall be as follows:
The improvements to be constructed on the streets are
concrete curb and gutter, gravel base, asphalt surfacing
adjacent to all properties and the necessary widening and
drainage to complete the streets. Sidewalks will be
constructed where requested by the property owner.
On South Florida Avenue, the st=reet improvements shall be
limited to curb and gutter improvements on one side only and
traveled way improved to a 27- -foot width. Said partial
improvements shall be on the west side of South Florida
Avenue.
On Maple Street, improvements will be limited to
construction of street improvements down to the commencement
of a Proposed future offset cul - -de -sac. Curb lines on the
north side of the street will be extended beyond the curb on
the south side by approximately 50 feet. The full pavement
width will be extended to the end of the longer curb and
gutter section.
On Owyhee Lane, the existing irrigation facilities will be
relocated out of the traveled way.
Section 3. Said improvement is a further and additional
improvement.
Section 4. The total cost estimated of the improvement is
$114,627.00.
Of the estimated total cost, $7,129.00 is estimated to be
the cost of the street improvements to be paid by the City of
Caldwell. The total cost of the street improvements, less the
cost of the street improvements paid by the City of Caldwell, is
to be levied and assessed against the abutting, adjoining and
adjacent lands and lots of the streets upon which the
improvements are to be made and upon the lots and lands to be
benefited by the improvements and included in the improvement
district to be formed.

Section 5. That an improvement district be formed for the
purpose of making these improvements„
Section 6. That the boundaries of the improvement district
to be formed are described in Exhibit A attached.
Section 7. The portion of the cost to be levied against the
benefited property shall. be apportioned among the benefited
parcels in the following manner:
1. Street improvement costs will be assessed as follows:
(a) Idaho Avenue, Maple Street and Owyhee Lane
The construction costs for street improvements will be
assessed on a per -foot basis to the abutting, adjoining,
contiguous ands adjacent lots and land:, including the
relocation of irrigation facilities on Owyhee Lane.
(b) South Florida Avenue
The construction costs of the street improvements will be
assessed on a per -foot basis to the abutting, adjoining,
contiguous and adjacent lots and lands on the side of the
street on which the major portion of the work will be
performed. On South Florida Avenue, the property on the
west side of the street shall bear all costs.
(c) Sidewalks requested by the property owner in any area
will be assessed to the adjacent property.
(d) The cost of a concrete entrace in all street areas will
be assessed to the property it serves.
II. The administration costs„ including the engineering,
inspection, legal publications, interim financing and other
non - construction costs are to oe prorated to the areas for
the street construction on the basis of the construction,,
costs for the improvement in each area_ The prorated costs
to each area are to be distributed within each area on a
per -foot basis as set forth in Section I.
Section G. Protests against said improvement or the
creation of such improvement district to be formed shall be in
writing and filed in the office o!` the City Clerk in the City
Hall in the City of Caldwell on or before 5:00 p.m. Monday,
September 15, 1986, and such protests shall be heard and
considered by the City Council at a meeting of the City Council
to be held at 7:30 p.m. on said day,.
That the City Clerk be and is hereby directed to give notice
of the passage of this Resolution and the time within which
protests against such improvement district may be filed, and the
date such protests will be heard and considered by the City
Council as herein provided, describing in such the general
character of the improvements to be made and the estimated total.
cost thereof and refer in said notice to the said Resolution on
file in the office for further information in .regard thereto, and
shall cause such notice to be published in the Press Tribune, a
daily newspaper of general circulation within said City and the
official newspaper thereof in three consecutive issues and cause
a copy of such notice to be mailed to each owner of property, if
known, or his agent, if known, or if not known, to the Post
Office address, if known, or if not known, to the Post Office in
said City, the first publication of such notice and the mailing
of the same to be not later than 10 days before the expiration of
the filing of protests.
After the reading of the Resolution, the Council discussed the
proposed L.I.D. briefly with the City Engineer. Mayor Cowles
then asked the Council to take action on the Resolution of
Intent.

MOVED by Raymond, SECONDED by Marmon that Resolution No. 28-86 be
passed declaring the intention Of the City of Caldwell to create
and establish Local Improvement District No. 86-1.
Roll call vote. Those voting _yes: Raymond, J. Carter, L.
Carter, Mallea, Marcus, and Marmon. Those voting no: none.
Absent and not voting: none.
MOT-TON CARRIED
There being no further business, the meeting was adjourned at
1:10 P.M.
